HomeMy WebLinkAboutCounty Council for March 17 1983WHATCOM COUNTY COUNCIL Minutes March 17, 1983 The Whatcom County Council meeting was called to order on Thursday, March 17, 1983 at 7:37 p.m. by Chairperson Cole with all members present. APPROVAL OF MINUTES Van Zanten noted a correction in the minutes of the March 3, 1983 Council meeting on page three, bid award for the Public Defender's Word Processing Equipment. She noted Hansey moved to approve the bid and said motion was passed by Council. The Chair ordered correction of the minutes accordingly. Muenscher made corrections to his motion on page eight. The motion was to give conceptual approval to the T.R.C. proposal. Also condition #5 should be inserted as part of the motion. Muenscher also made corrections on page nine, line 7 to add the word "the" after the word "pay" and on line 8 to strike the word "total ". Muenscher moved to approve the March 3 Council minutes as corrected and to authorize the Chair to make the necessary gramatical corrections to the first paragraph on page nine. Motion passed. . The minutes of March 10 Council meeting, March 10 Special Council meeting and the March 10 Joint City /County meeting were approved as presented. EXECUTIVE ITEMS TRANSFER - DISTRICT COURT BUDGET This transfer will be held until the next meeting until a supplemental budget is approved for the District Court Budget. TRANSFER - SHERIF.F /JAIL BUDGET The amount of the transfer in the Jail Budget is $18,077.00. Hansey reported the Finance Committee recommended approval of the transfer. Hansey so moved. to approve the transfer. Motion passed. Whatcom County Council Minutes March 17, 1983 page two BID AWARD - CONSTRUCTION OF SLATER ROAD Executive Louws recommended the bid of Whatcom Builders, Inc. in the amount of $203,040.50 for the construction of Slater Road from milepost 0.24 to milepost 0.84. Hansey reported the Finance Committee recommended approval of the bid upon the figures being confirmed by the Executive. The Executive has so confirmed the figures of Whatcom Builders, Inc. Hansey so moved to authorize acceptance of the bid. Motion passed. PROGRESS OF NEW PUBLIC SAFETY BUILDING Executive Louws gave a progress report of the new public safety building. He stated the project is 65% complete to date. He is also.looking at possibly being able to install one of the skybridges. Executive Louws will be conducting a tour with the Council on March 24, 1983 at 4:00 p.m. OPEN SESSION ALAN KACHELMEIER 820 High St. Bellingham Spoke to the implementation of the conditions relating to the Solid Waste matter adopted at the March 3, 1983 Council meeting. CLAY MC DONALD Alcohol Administrative Board 3950 Northwest Drive Submitted a copy of a draft proposal to create a Whatcom County Substance Abuse Administrative Board, drafted by Jack Wright, and spoke against it. ED O'CONNOR 801 North Forest Opposed to the proposal of. Jack Wright... RAY HALL 4683 Aldrich Road Opposed to the proposal of Jack Wright. BARB STARR Alcohol Administrative Board 2728 W. Maplewood Opposed to the proposal of Jack Wright. The proposal would eliminate the present County Coordinator., she claimed. Whatcom County 'ouncil Minutes March 17, 1983 page three BILL KEEL 1392 Country Lane Spoke to the Ordinance regarding the Comprehensive Plan and Zoning Text for the Urban Fringe Subarea. Requested the Council to hold a hearing on the portion of the Plan which deals with the proposed General Manufacturing zoning in the Curtis Road area. PATRICK ALESSE 9865 Harvey Road Opposed to the release by the County of a restrictive covenant concerning real property at Birch Bay, the release, :having been requested by Ron Mace. ERNEST LIMBACHER 1453 Wynn Road Opposed to the vote taken by the Planning Commission in regards to the zoning in the Curtis Road area. PAULA SMITH Blaine Concerned with public access at property at Birch Bay with regards to the release of a restrictive covenant requested by Ron Mace. MAC SETTER Deputy Prosecuting Attorney 3233 Heights Drive Spoke to the Resolution in support of House Bill No. 870 which imposes a tax upon beer, wine, and distilled spirits for the purpose of providing funds to assist law enforcement and alcoholism rehabilitation agencies in deterring and treating drunk drivers. HF. AR T MaR ORDINANCE - BUDGET FOR REAL ESTATE TAX CAPITAL IMPROVEMENT FUND Hearing was declared open on THE ORDINANCE ESTABLISHING A BUDGET FOR THE REAL ESTATE CAPITAL IMPROVEMENT FUND. No testi- mony was received and the hearing was closed. FINAL CONSIDERATION OF ORDINANCES ORDINANCE - ESTABLISH REAL ESTATE CAPITAL IMPROVEMENT FUND Hansey reported the Finance Committee recommended "do pass" of THE ORDINANCE ESTABLISHING THE REAL ESTATE CAPITAL IMPROVEMENT FUND. Hansey so moved the ordinance for final passage. Motion passed unanimously. Motion passed on a 6 -0 vote (Muenscher out). ORDINANCE - ORDINANCE AMENDING ORDINANCE 82 -85 THE ORDINANCE AMENDING ORDINANCE 82 -85, AN ORDINANCE OF THE COUNTY"COUNCIL OF WHATCOM COUNTY AUTHORIZING THE ACQUISITION, CONSTRUCTION AND INSTALLATION OF THE EXPOSITION.BUILDING ON THE GROUNDS OF THE NORTHWEST WASHINGTON FAIR, AND THE REPAIR AND REPLACEMENT OF COUNTY ROADS AND DRAINAGE FACILITIES; PROVIDING FOR THE ISSUANCE AND SALE OF LIMITED TAX LEVY GENERAL OBLIGA- TION BONDS OF THE COUNTY IN THE PRINCIPAL:7SUM OF $1,300,000; PROVIDING THE LEVY OF TAXES TO PAY THE PRINCIPAL OF AND INTEREST ON SAID BONDS; AND PROVIDING FOR THE SALE THEREOF, BE" MODIFYING SECTION 2.B ENTITLED "ROAD IMPROVEMENT ", was held in Finance Committee. OTHER BUSINESS BOARD OF EQUALIZATION Nominations were open to the Board of Equalization (from Districts 1 and 3). Roehl nominated Jack Mulhern, 1st District and Stan Brunner, 3rd District. Johnson nominated Bob Bruce, 3rd District. Hansey nominated Arne Hanna, 1st District. Hawley nominated Lloyd Halladay, 3rd District. Van Zanten moved to close the nominations. Motion passed. The appoint- ments will be made at the next Council meeting. DISSOLUTION OF FIRE PROTECTION DISTRICT NO. 20 Correspondence received from the County Auditor requesting that Whatcom County Fire Protection District No. 20 be dissolved. Van Zanten moved to refer the matter to the Public Services Committee. Motion passed. PRELIMINARY PLAT OF NORTHWEST MOBILE PARK Correspondence received from Donovan Kehrer, Building and Codes Department requesting clarifi- cation of conditions for Preliminary Plat of Northwest Mobile Park. Roehl moved to refer the matter to the Planning and Development Committee. Motion passed. Whatcom County Council Minutes March 17, 198_ page five PRELIMINARY PLAT OF GROUSE MEADOW ESTATES Hearing Examiner recommendations regarding the Preliminary Plat of Grouse Meadow Estates were received.. Johnson moved to refer-the matter to the Planning and Development Committee. Motion passed. PRELIMINARY PLAT OF YELTON ESTATES Hearing Examiner recommendations regarding the Preliminary Plat of Yelton.Estates were received. Hansey moved to refer the matter to the Planning and Development Committee. Motion passed. DRAINAGE IMPROVEMENT DISTRICT NO. 31 ASSESSMENT ROLL The Johnson creek Drainage Improvement District No. 31 assessment roll was received. Roehl moved to add 10% to the assessment for errors and expenses in the amount of $10,265.66 for a total assessment amount of . $112; 922.22. * Motion passed. MOTION - Roehl moved to place the matter of Northwest Mobile Park back on the agenda for consideration. Motion passed. Roehl moved to adopt the proposed revisions of the Technical Committee (which were transmitted to the Council via memorandum from Donovan Kehrer of the Bureau of Buildings and Codes, dated March'2, 1983) to the 'conditions of Northwest Mobile Home Park with corrections noted by Van Zanten that condition No. 7 should be numbered as condition No. 9 and condition No. 11 should be numbered as condition No. Motion passed. �9 CORRESPONDENCE - RON MACE RESTRICTIVE COVENANT Correspondence was received from Craig P. Hayes, attorney for Ron Mace, regarding the release by the County of a restrictive covenant concerning real property at Birch Bay. Roehl moved to refer the matter to the Planning and Develop- ment Committee. Motion passed. INTRODUCTION OF RESOLUTIONS AND ORDINANCES Hansey introduced and moved for final passage THE RESO- LUT.ION REVISING THE ADVANCED TRAVEL EXPENSE REVOLVING FUND. Van Zanten moved to amend the resolution on line 11 to delete "Joan Ogden" and insert "Whatcom County Auditor." Motion to amend passed. Motion to adopt the resolution as amended passed. Motion passed. Van Zanten introduced and moved for final passage THE RESO- LUTION ESTABLISHING MODIFIED SELECTION PROCEDURES FOR NOR -BELL NURSING HOME. Motion passed. Roehl introduced and moved for final passage THE RESOLUTION FIXING TIME AND PLACE OF HEARING ON ASSESSMENT ROLL FOR WHATCOM COUNTY ROAD IMPROVEMENT DISTRICT NO. 5. Van Zanten moved to amend the resolution on line 13 to strike the date and authorize the Chair to insert the appropriate date. Motion to amend passed. Motion to adopt the resolution as amended passed. Johnson introduced A RESOLUTION TO TRANSFER REAL PROPERTY FROM WHATCOM COUNTY TO WHATCOM COUNTY FIRE DISTRICT NO. 14 and i moved its referral to the Planning and Development Committee. Motion passed. The following ordinances were referred to the Finance Committee upon introduction by Hansey and motion by Hansey, the motion having passed: 1) Ordinance confirming, ratifying and approving the formation of Whatcom County Road Improvement District No. 5 2) Ordinance authorizing a revised budget for the District Court Budget within the Current Expense Fund 3) Ordinance adopting a 1983 budget for 1982 Northwest Washington Fair Construction Fund 4) Ordinance establishing the Emergency Service Communication System Fund. Van Zanten introduced AN ORDINANCE IN THE MATTER OF GRANTING A NON - EXCLUSIVE FRANCHISE TO JOE LOUIE WATER ASSOCIA- TION, INC., FOR A PERIOD OF 25 YEARS PURSUANT TO STATE LAW, SECTION 9.30 OF THE WHATCOM COUNTY HOME RULE CHARTER, TO OPERATE AND MAINTAIN WATER MAINS AND WATER DISTRIBUTION LINES ALONG CERTAIN ROADS WITHIN THE UNINCORPORATED AREAS OF WHATCOM COUNTY and moved its referral to the Public Services Committee. The matter was referred to the Committee of the Whole. The Chair added to the agenda THE ORDINANCE AMENDING SECTION 2.24.270.155 OF THE WHATCOM COUNTY INTERIM ZONING ORDINANCE AND SECTION 20.40.153 OF THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE TO REDUCE SETBACK REQUIREMENTS FOR SEASONAL FARM LABOR HOUSING AND CAMPING FACILITIES.
