HomeMy WebLinkAboutCounty Council for March 10 1983WHATCOM COUNTY COUNCIL Minutes March 1'0 , 1983 71 Upon recessing on March 3, 1983 the Whatcom County Council reconvened on Thursday, March 10, 1983 at 8:39 a.m. with all members present except Roehl, Hawley questioned the continuance of the meeting. Cole referred to a memorandum received from the Prosecuting Attorney's office advising the Council there was no legal problem with the way the March 3, 1983 meeting was handled. UNFINISHED ITEMS OF BUSINESS FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES RESOLUTION - CAPITAL IMPROVEMENT PROJECTS Van Zanten moved for final passage the resolution on cap- ital improvement projects related to buildings and facilities for Whatcom County, Washington. Van Zanten moved to accept draft III of the resolution for consideration Motion passed to accept draft III. Van Zanten stated the Public Services Committee recommended passage of the draft resolution. Hawley stated concerns with whether or not the resolution followed the intent of SB 4972. Motion to adopt draft III of the resolution passed. Van Zanten moved to receive the suggested amendments from Paul Shissler, received at the meeting of March 3, 1983, requesting that a Design Advisory Committee be created, and refer the matter to the Public Services Committee for review. Motion passed. ORDINANCE - ALCOHOLISM PROGRAM FUND Hansey moved for final passage the ordinance authorizing a revised budget for the Alcoholism Program Fund. He reported the Finance Committee recommended "do pass" of the ordinance. Motion passed unanimously. 0 w Whatcom County Council Minutes March 10, 1983 page two ORDINANCE - DEFINITION OF TERM "FRONT YARD" Johnson moved for final passage the ordinance in the matter of amending the definition of the term "Front Yard" set forth in the Whatcom County Interim Zoning Ordinance, Section 2.24.840 and in the new County Zoning Ordinance, Title 20, Section 20.94.450. Johnson reported the Planning and Development Committee recommended "do pass" of the ordinance. Motion passed unanimously. OTHER BUSINESS PUBLIC TRANSPORTATION BENEFIT AREA (PTBA) Discussion was, held regarding the Public Transportation Benefit Area. Hansey moved the following: "That the Whatcom County Council authorizes and directs the Council Chairman to convene, pursuant to RCW 36.57A.020 a public transportation improvement conference at the earliest time possible and shall send written notice to the legislative authority of each city within the County 30 days prior to the convening of the conference. Such conference shall be for the purpose of evaluating the need for and the desireability of the creation of apublic transportation benefit area within certain incorporated and unincorporated portions of the County to provide public transportation services within such area." Van Zanten raised several questions to the motion; 1) What areas would be involved, 2) what would be the revenues derived, and 3) what would be the potential costs. Letters were received from Whatcom County Council on Aging and Ann Donelson and James Eastman in support of PTBA. A petition was also received containing 63 signatures requesting that t.ranait'service be expanded to encompass the entire County. Hansey motion passed. SKAGIT COUNTY DISASTER APPEAL Chair Cole brought to the Council's attention a request by Skagit County Board of Commissioner's for a letter of support for their appeal of the President's denial of a disaster de- claration for Skagit County. Cole submitted a proposed letter to Council. • Whatcom County Council Minutes March 10, 1983 page three Johnson moved to accept Cole's letter and have the Chair so send it. Motion passed. BOARD OF EQUALIZATION The resignations from Joyce E. Baumann and Russ Motschenbacher were received. Nominations will be held at the next meeting. Nominations may:-.be made one each from District 1 and District 3 or two from District 3. CORRESPONDENCE - J. A. GRANT Correspondence was received from J. A. Grant stating concerns regarding Whatcom County Law and Justice system. The matter was referred to the Law and Justice Committee. CORRESPONDENCE - WATER'DISTRICm_NO. 13 Correspondence was received from Water District No. 13 informing the Council of the appointment of Julian Pavesi to serve out the remainder of the term of H.E. Isenhart. The Elections Department has been notified. HEARING EXAMINER PROCEDURES Consideration was held of the.Hearing Examiner procedures as outlined by Cole in his memorandum to Council. Van Zanten stated it was her understanding that assistance would be given in planning related issues, but Cole and Hansey stated a different view. Johnson moved to adopt the procedures as outlined by Cole. Van Zanten moved to add at the end of item 8 the following: "The higheast priority for research and analysis asistance given to the Council by the Hearing Examiner's office shall be in planning related matters." Van Zanten's motion passed. Motion to adopt the procedures as amended passed. INTRODUCTION OF RESOLUTIONS AND ORDINAECES RESOLUTION - SEXUAL HARASSMENT Hansey introduced and moved for final passage the resolution in the matter of the adoption of a policy for Whatcom County employees prohibiting sexual harassment in the workplace. Motion passed. r � Whatcom County Council Minutes March 10, 1983 page four RESOLUTION - SOUTH BEACH WAY Hansey withdrew his proposed resolution in the matter of removing the barricade near the end of South Beach Way at Neptune Beach and restoring the roadway to public use. The Executive has recently ordered the barricade be removed. ORDINANCE - NOXIOUS WEED CONTROL BOARD Hansey introduced and ordinance amending Ordinance No. 81- 61,.Whatcom County Code Chapter 2.27 relating to enforce- ment powers of the Noxious Weed Control Board. The ordinance was referred to the Finance Committee. MOTION Johnson moved to adjourn the meeting. Motion passed. Meeting was adjourned at 9:42 a.m. RESPECTFULLY SUBMITTED BY Clerk H
