January 6, 1983
The Whatcom County Council meeting was called to order on
Thursday, January 6, 1983 at 7:32 p.m. by Chair Roehl with all
members present except Van Zanten.
Minutes of the December 16, 1982 meeting were approved as
presented.
OPEN SESSION
Hugh Foulke, Neptune Beach, spoke against the barricade at
South Beach Way.
EXECUTIVE ITEMS
There were no executive items presented.

s' Hearing was declared open on the Ordinance regarding the
matter of modifying the speed limit on portions of Goodwin Road.
No testimony was received and the hearing was closed. Johnson
reported the Law and Justice Committee recommended "do pass" of
the ordinance. Johnson so moved for final passage of the
ordinance. Motion passed unanimously.
Hearing was declared open on the Ordinance to establish
speed limits on roadways within the Brownsville Plat. No
testimony was received and the hearing was closed. Johnson
reported the Law and Justice Committee recommended "do pass" of
the ordinance. Johnson so moved the ordinance for final passage.
Motion passed unanimously.
Hearing was declared open on the Ordinance regarding the
matter of placing a stop sign on Columbus Street at its inter-
section with Coronado Avenue. No testimony was received and
the hearing was closed. Johnson reported the Law and Justice
Committee recommended "do pass" of the ordinance. Motion
passed unanimously.

FINAL CONSIDERATION OF ORDINANCES
✓ Hansey moved for final passage the Ordinance amending
Ordinance No. 82 -93 in the matter of the adoption of the final
budget of Whatcom County for the year 1983. Hansey moved to
accept the substitute draft of the ordinance. Motion to accept
the substitute draft passed. Hansey revi ewed the changes.
Motion to adopt the ordinance passed unanimously.
i Hansey moved for final passage the Ordinance authorizing
a fee schedule for the Whatcom County Treasurer. Hansey
reported the Finance Committee recommended passage of the
ordinance. Motion passed unanimously.
Hansey moved for final passage the Ordinance to change
the regulations governing non - conforming uses and parcels as
contained in the Whatcom County Interim Zoning Ordinance by
amending Whatcom County Code Sections 2.24.640.650 and
2.24.640.760 and by adding new Sections 2.24.640.660 and
2.24.640.680. Hansey moved to amend the ordinance on page
three, line 14 to strike 1120.83.660" and insert 112.24.640.660 ".
Motion to amend passed. Motion to adopt the ordinance as
amended passed unanimously.
OTHER BUSINESS
j Planning Commission recommendations were received regarding
the Open Space and Timberland applications of Reemer, Zweegman,
Weaver, Lockwood, Benson, McDougal and Anthony. Hansey moved
to refer the matter to the Planning and Development ,Committee
for review. Motion passed.
Open Space applications were received from the following:

Hansey moved to refer the applications to the Planning Commission
for review. Motion passed.
Hearing Examiner recommendations on the application of
Glacier Management, Inc., for Preliminary Plat approval to
create and develop a residential subdivision known as "The
Glacier Management Plat" were received. Hansey moved to refer

the matter to the Planning and Development Committee for review.
Motion passed.
A petition for the formation of "Sumas River Drainage
Improvement District ". signed by 179 residents of the area,
was received and forwarded to the Boundary Review Board for
review and consideration.
INTRODUCTION OF RESOLUTIONS AND ORDINANCES
Hansey introduced the following two ordinances and they
were referred to the Finance Committee:
1. Resolution establishing a policy for movement from
Step 4 through Step 7 of the salary plan by exempt
employees
2. Ordinance adopting a 1983 budget for the Public Works
Department 1982 Road Construction Fund
Hawley introduced the following two ordinances and they
were referred to the Finance Commi't'tee:
✓ 1. Ordinance adopting 1983 budget for the 1983 Sewer
Construction Fund
v 2. Ordinance of the County Council of Whatcom County,
Washington, authorizing the acquisition, construction
and installation of sewerage facilities in the
vicinity of the Nor -Bell Nursing Home; providing for
the issuance and sale of limited tax levy general
obligation bonds of the County in the principal sum
of $585,000; providing the date, form, terms and
maturities of said bonds; providing for the annual
levy of taxes to pay the principal of and interest
on said bonds; and providing for the sale thereof.
Hansey introduced the ordinance amending Section 8.12.030
of the Whatcom County Subdivision Regulations. The ordinance
was referred to the Planning and Development Committee.
Johnson introduced the Ordinance to establish the speed
limit on certain County roads and it was referred to the
Law and Justice Committee.
REPORT OF COMMITTEES
Johnson reported the Law and Justice Committee had met
with residents of Neptune Beach regarding the barricade at
South Beach Way. The Committee recommended that the Council
request the Executive to reconsider the issue and to take
into consideration alternative #1 of Ed Henken's letter

dated January 4, 1983, which states as follows:
"Remove the barricade, thus returning the access to its
pre- barricade status; see what happens as to whether
Mr. Don McSwain or any others request the barricade and
if so, follow proper procedure, including holding a
hearing at that time."
Johnson so moved to accept the Committee's recommendation and
have the Chair send a memo to Executive Louws to that effect.
Motion passed.
The following meetings were set:

Gene Bedlington, for Thursday, January 13, 1983 at
3:45 p.m.
Committee of the Whole -- presentation by the Park Board
set for Thursday, January 13, 1983 at 5:00 p.m.
Meeting adjourned at 7:59 p.m.
