February 3, 1983
The Whatcom County Council meeting was called to order on
Thursday, February 3, 1983 at 7:32 p.m. by Chairperson Cole
with all members except Muenscher. Muenscher entered at 7:40 p.m.
The minutes of the January 20, 1983 and February.l, 1983
Council meetings were approved as presented.
OPEN SESSION
Rita Foley, 3878 Blue Canyon Road, submitted a petition
regarding the powers of County Boards and Commissions. The
petition was referred to the Public Services Committee.
Robert Frost, 5602 Guide Meridian, spoke to the elected
officials' ,6a.lari+e$.
Joel Douglas made comment to the solid waste issue. He
stated there needs to be more public input. Let the people
vote on the issue, he suggested.
Joe Parcher, 2408 View Ridge, spoke regarding solid waste.
favoring the proposal of the Olivine Corporation.
Skip Saler, Profession of Business at WWU, CPA, 3705
Ridgemont, spoke to the solid waste issue. He reviewed the
costs of the proposals, favoring Olivine.
EXECUTIVE ITEMS
Bid Award -- Executive Louws presented four computer
software contracts with Compu -Tech, Inc. for the following
1) Auditor -- $20,000 -- Recording data and the
Auditor's fee sheet
2) Treasurer -- $24,000 -- General receipts and fund
accounting system
3) Public Works -- $35,000 -- Complete accounting,
inventory, and function requirements for Depart-
ment
4) Sheriff -- $3,500 -- Automating labor intensive
reporting functions
The monies will be coming out of Central Services. Hansey
reported the Finance Committee recommended the Executive

be authorized to enter into said contracts. Hansey so moved.
Motion passed.
The Executive also presented an overlimit transfer in
the Developmental Disabilities Fund in the amount of $15,206.00.
The money is to go towards a personal services contract for a
six -month period. Hansey reported the Finance Committee
recommended approval of the transfer. Hansey so moved. Motion
passed.
Executive Louws stated he would be bringing a disaster
report.:to the Council at the meeting of February 17.

Hearing was declared open on the Ordinance amending Section
8.12.030 of the Whatcom County Subdivision Regulations.' The
following testimony was given:

No further testimony was given and the hearing was closed.
Hansey moved to refer the matter to the Planning and Develop-
ment Committee. Cole stated two letters were received on
this matter from Jerry Ellenz and Dan Zender. They will be
entered into the record. Hansey motion passed.
Hearing was declared open on the Ordinance to establish
the speed limits on certain County roads (Marine,Drive, Rural
Avenue and Skagit Street). No testimony was received and
the hearing was closed. Van Zanten moved the ordinance for
final passage. Motion passed unanimously.
FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES
Van Zanten moved for final passage the Resolution on
Capital Improvement Projects related to buildings and
facilities for Whatcom County. Van Zanten moved to accept
draft II of the resolution. Motion to accept draft II
passed. Van Zanten reported the Public Services Committee
recommended "do pass" of the resolution. She pointed out
this respiution_is only a:pplan which the County Executive is
required to prepare per Council resolution, that budgeting is still required.
Roehl spoke against the resolution. He stated concerns
of where the sources of funding would come from; the Real
Est4te Excise Tax or elsewhere.
Johnson moved to delete on page one of the resolution
the third "WHEREAS ".
Roehl moved to refer the resolution back to the Public
Services Committee for further review. Motion passed.
The Ordinance amending Ordinance No. 82 -64 in the matter
of revising the ,Alcoholism Revolving Fund was held in the
Finance Committee.
OTHER BUSINESS
Nominations were open to the Open Space Advisory Committee
(2 positions). Van Zanten moved to nominate and appoint
Mr. Art DeJong and to hold the second position open until the
next meeting. Motion passed. Mr. DeJong was so appointed.

Van Zanten moved to close the nominations and make the appoint-
ment at the next meeting. Motion passed.
Nominations were open to the Lake Whatcom Advisory Committee.
Government members will so be appointed by their various agencies.
The appointments so far are:

Dick Olson, Department of Natural Resources
Those who have yet to appoint a representative are the Bellingham/
Whatcom County Public Health District, City of Bellingham, Whatcom
County Executive.

All nominations were closed. Appointments will be at the meeting
of February 17, 1983.
Consideration was held of the application for preliminary
plat of Glacier Management Plat. Johnson reported the Planning
and Development Committee recommended approval. Johnson so
moved to approve the preliminary plat subject to the Hearing
Examiner conditions. Motion passed.
`Cosiderat on was held of the following Open Space applica-
`tions :- Reimer, Lockwood,` _ Zweegman, Benson, Anthony,
and' ver. Hansey reported the Planning and Development Committee
reviewed the applications along with the Planning Commission
recommendations. Hansey moved to grant all the applications
with the exception of Benson, per the Planning Commission
recommendations. Motion passed.
The following petitions were received and referred to the
appropriate committee:
1) Amendment to Whatcom County Code Title 9 Section 04.030
referred to Law and Justice
2) Non- exclusive franchise for the Joe Louie Water Association
referred to Public Services
3) Non - exclusive franchise for Cablevision filed by Tom Isenhart
referred to Public Services
4) Extension of Lake Samish Cablevision non - exclusive franchise
referred to Public Services

Hawley gave a report of the status of the Special Committee
on Transportation and Solid Waste. The Committee is still looking
at both proposals. The Committee is also awaiting a report back
from an Engineer who reviewed the proposals. The matter will be
scheduled for the February 17, 1983 Council meeting.
Hansey reported the Administrative Appeal of Gene Bedlington
was being held in the Planning and Development Committee. The
Council felt that all members should meet on the matter and
Johnson so moved to refer the matter to Committee of the Whole
instead of Planning and Development. Motion passed. The Committee
of the Whole meeting will be schedule for February 17, 1983 at
9:30 a.m.
INTRODUCTION OF RESOLUTIONS AND ORDINANCES
Van Zanten introduced and moved for final passage the
resolution in support of amending Chapter 70.05 of the Revised
Code of Washington. Van Zanten moved to amend the resolution on
line 142 at the end of the line after the word "by" add the
following: "and be under the administrative direction of ".
Van Zanten also amended the resolution on line 24 to strike
the period at the end of the sentence and add "and allow for
their administrative control by the Executive branch." The
amendments were so incorporated. Motion to adopt the resolution
as amended passed.
Johnson introduced n Ordinance amending Section 8.44 of the
Whatcom County Subdivision Regulations for the purpose of
expediting short subdivision variance requests. The ordinance
was referred to the Planning and Development Committee.
Hansey introduced an Ordinance adopting a supplemental
budget for the Referendum 37 Construction Fund 1983 Budget and
it was referred to the Finance Committee.
Roehl introduced and moved for final passage a resolution
of intent in the matter of vacation and abandonment of a portion
of County Road No. 223. This resolution will set a hearing
on the vacation and abandonment for March 3, 1983. The resolution
was so adopted.

COMMITTEE REPORTS
The Museum Board nominations will be held at the February 17
meeting.
Johnson submitted a petition from Fire District No. 14 to
declare certain county property surplus. Johnson moved to refer
the petition to the Planning and Development Committee. Motion
passed.
Hawley reported the Special Committee on Transportation and
Solid Waste considered the petition protesting the closure of
the Birch Bay - Lynden Road Dump. The Committee recommended the
dump to be closed. This matter will be scheduled for the February 17,
1983 Council meeting.
