HomeMy WebLinkAboutCounty Council for December 1 1983., OFFICIAL PROCEEDINGS WHATCOM COUNTY COUNCIL MINUTES -- DECEMBER 1, 1983 The Whatcom County Council meeting was called to order on Thursday, December 1, 1983 at 8:11 p.m. by Chairperson Cole with all members present except Johnson. HAWLEY MOVED TO EXCUSE JOHNSON. Motion carried. EXECUTIVE ITEMS ,/ OVERLIMIT TRANSFER Executive Louws presented an overlimit transfer in the Jail Construction Fund in the amount of $20,000. HANSEY SO MOVED TO APPROVE THE TRANSFER AS PRESENTED. He reported the Finance Committee recommended approval'of the transfer. Motion carried. NOR -BELL CONTRACT V Executive Louws presented the 1984 Nor -Bell Nursing Home Employees contract with AFSCME. He stated a six percent (6%) salary increase is included. HANSEY MOVED TO APPROVE SAID CONTRACT. He reported the Finance Committee recommended approval of the contract. Motion carried. He reported the Finance Committee recommended "do pass" of the ordinance. Motion to adopt the ordinance passed unanimously. ✓ ORDINANCE -- SHERIFF BUDGET HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE AUTHORIZING A REVISED BUDGET TO THE CURRENT EXPENSE FUND, SHERIFF BUDGET THEREIN. He reported the Finance Committee recommended "do pass" of the ordinance. Motion to adopt the ordinance passed unanimously. ORDINANCE -- SALES TAX At this time HANSEY MOVED TO CONSIDER THE ORDINANCE AMENDING ORDINANCE N0. 82 -68 REDUCING THE SALES TAX RATE IN WHATCOM COUNTY COMMENCING JULY 1,/ 1984. Motion to consider the ordinance passed. HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE AMENDING ORDINANCE NO. 82 -68 REDUCING THE SALES TAX RATE IN WHATCOM OCUNTY COMMENCING JULY 1, 1984. Motion to adopt the ordinance passed 5 -1 (Hawley voting no). SPECIAL ORDER OF BUSINESS Benjamin Thompson, 9315 Point Elk Creek Road, Mt. Baker Chamber of Commerce, spoke to the United States Forest Services being provided in Whatcom County. He requested the Council to send a letter of support to Congressman Al Swift, requesting that a GAO audit be performed to justify the cost effectiveness of the consolidation of the Whatcom and Skagit County Services. VAN ZANTEN MOVED TO HAVE THE CHAIR DRAFT A LETTER AND SEND IT TO SWIFT REQUESTING THAT A GENERAL ACCOUNTING OFFICE AUDIT BE PERFORMED TO JUSTIFY THE COST EFFECTIVENESS OF THE PROPOSED CONSOLIDATION. Motion carried. OTHER BUSINESS ✓ PRELIMINARY PLAT OF RICHALOU ESTATES Consideration of preliminary plat approval of Richalou Estates was held by the Council. Hansey reported the Planning and Development Committee recommended approval of the preliminary plat. HANSEY SO MOVED TO APPROVE SAID PLAT WITH THE CONDITIONS ATTACHED OF THE HEARING EXAMINER. Planning Commission Findings, Reasons and Motion in the matter of amendment to the Birch Bay Comprehensive Plan Maps WHATCOM COUNTY COUNCIL MINUTES -- DECEMBER 1, 1983 PAGE 3 ✓"3• Petition to vacate lot line filed by Mr. and Mrs. John Kwasnica v'APPEAL OF KIEWITT CONSTRUCTION Application to appeal requesting review of a decision of the Hearing Examiner regarding Shoreline Management Act, filed by Kiewitt Construction was received. A Committee of the Whole meeting was set on the matter for 9:00 a.m., December 6, 1983. HAWLEY MOVED NOT TO HOLD THE MEETING IN CLOSED SESSION. Roehl and Cole spoke against the motion. Motion failed. HANSEY MOVED THAT IT IS THE.INTENT OF THE COUNCIL TO PLACE THE MATTER OF DETERMINATION OF THE APPEAL ON THE AGENDA OF DECEMBER 15, 1983 OR AT A SPECIAL MEETING PRIOR TO THE 29TH OF DECEMBER. Motion carried. ,/-CORRESPONDENCE -- WHATCOM COUNTY CABLEVISION f Correspondence from Whatcom County Cablevision withdrawing its intent to change the rates to subscribers in the Lynden area was received. CORRESPONDENCE -- RON MACE COVENANT Correspondence from Craig P. Hayes, Attorney requesting consideration of removal of a restrictive covenant from a Shoreline Substantial Development Permit of Ron Mace. .Craig Hayes was present and stated it was up to the Council to made a decision regarding the covenant. Pat Allesee, opponent, agreed with Hayes' statement, that the decision was up to the Council. ROEHL MOVED TO LIFT THE RESTRICTIVE CONVENANT BASED ON CONDITION NO. 12 of the HEARING EXAMINER'S REPORT DATED FEBRUARY, 1983 AND PARAGRAPH FIVE OF THE SHORELINE HEARINGS BOARD DECISION, DATED SEPTEMBER 14, 1983, AND THAT THE CHAIR BE DIRECTED TO SO DRAFT WRITTEN FINDINGS OF THE COUNCIL'S DECISION. VAN ZANTEN MOVED TO DEFER ACTION ON THE MOTION TO THE DECEMBER 15, 1983 MEETING AND REFER THE MATTER TO THE PLANNING AND DEVELOPMENT COMMITTEE. Motion carried. v.-It this time Roehl moved to add to the agenda under Introductions the following: _'1. Ordinance amending Whatcom County Code Title 3 and Ordinance 80 -55 which amended Ordinance 79 -9 relating to simplified procedures for approval of transfers and /or revisions within departmental budgets -2. Ordinance establishing service fees and authorizing and agreeing to the City of Bellingham 1984 adopted fee schedule as per City Ordinance #9054 amending and thereto relating to Ambulance Service charges 3. Ordinance authorizing a revised budget to the 1983 Developmental Disabilities Fund Motion carried. Brought samples of what Ludtke is hauling. -Spoke to Ludtke sludge hauling on Marine Drive. There has been no covering put on the site. -Spoke to Ludtke sludge hauling on Marine Dr. The large trucks will damage the roads. - Stated the sludge from the site runs down the road. Muenscher stated he has requested the Health Department to take samples at the site. No report has been received back as yet. ROEHL MOVED TO REFER THE MATTER TO THE PUBLIC SERVICES COMMITTEE AND TO REQUEST THE HEALTH DEPARTMENT AND ADMINISTRATION TO IMMEDIATELY LOOK INTO THE MATTER AND REPORT BACK TO THE COUNCIL IN TWO WEEKS. Submitted letter -Spoke regarding Federal Reserve System. HANSEY INTRODUCED AND MOVED TO REFER THE FOLLOWING RESOLUTIONS AND ORDINANCES TO COMMITTEES: `1. Resolution of the Whatcom County Council clarifying the intent of Odinance No. 83 -31 pending formal amendment thereof, referred to Planning and Development 2. Ordinance requiring permits and certificates and the payment of fees and charges in conformance with the Uniform Fire Code, 1979 Edition, Article 4, Section 4.101, and Ordinance No. 82 -10, Section 2.04.020 -A, referred to Finance 3. Ordinance exteding the francise of Nation Wide Cablevision for a period of six (6) months, referred to Public Services 4. HANSEY MVOED TO ADOPT THE PROCEDURES AS SET FORTH WITH AN AMENDMENT TO CHANGE THE DATE OF "DECEMBER 8, 198311 TO 'DECEMBER 9, 1983 at 4:00 p.m.,, Motion carried. Hawley questioned what had been done regarding Jacob Smith's letter concerning the Birch Bay Drive Bulkhead. Cole stated he has requested the Executive to look into this.
