March 10, 1983
A Special meeting of the Whatcom County Council was
called to order Thursday, March 10, 1983 at 7:40 a.m. by
Chair Cole in the Council Conference Room. Members
Hansey, Johnson and Muenscher were present. Hawley entered
the meeting at 7:45 a.m. Also present were Executive, Louws,
Gene Moses, Bruce L. Disend, Debbie Auble and Steve Valandra.
SPECIAL ORDER OF BUSINESS
BRIEFING ON LEGAL MATTERS:
SEATTLE CITY LIGHT CONTRACT
Louws reported that he would have a proposed settle-
ment within 8 to 10 days. He felt it would be premature
to discuss details at this time. He will meet with
Mayor Royer on Monday.
CLEAN -UP OF LAKE WHATCOM - LEGAL RESPONSIBILITY AND
LIABILITY
Disend and Moses responded to questions as to who is
responsible for completing clean -up of.Lake Whatcom.
Disend feels the State is. As to who is liable for injuries
occurring to boaters /skiers, Moses stated it would depend
on facts of case, but he would most likely argue that the
State is responsible.
MOTION
At this time Hansey moved to discuss the remaining
agenda items in closed session. Motion passed.
The following items were discussed in closed session:
1) Point Roberts Voter's Association vs. Whatcom County
2) Nichols vs Whatcom County
3) Smith and Olson Creeks - Legal responsiblity and
liability.
Meeting adjourned at 8:30 a.m.
