PETITION - PROPOSED NUDE DANCING FACILITY IN POINT ROBERTS, FILED BY CYNTHIA TUCK This agenda item will be held over until the January 15th meeting of the Law and Justice Committee. ORDINANCE - EROTIC DANCE STUDIOS This agenda item will be held over until the January 15th meeting of the Law and Justice Committee. ORDINANCE - PROHIBITING NUDITY IN PLACES WHERE LIQUOR IS SOLD OR CONSUMED This agenda item will be held over until the January 15th meeting of the Law and Justice Committee. RESOLUTION - REAFFIRMING THE STATUS OF SOUTH BEACH WAY FROM SUCIA DRIVE TO THE OCEAN WATER AS A PUBLIC ROADWAY Hansey read the resolution aloud. Dick Metcalf, 4779 Sucia Drive, spoke in support of the concept of the resolution and requested that his attorney and the Council's attorney meet together to clear up any language. HANSEY MOVED TO RECOMMEND APPROVAL OF THE RESOLUTION Ind THE MATTER OF REAFFIRMING THE STATUS OF SOUTH BEACH WAY FROM SUCIA DRIVE TO THE OCEAN WATER AS A PUBLIC ROADWAY OPEN FOR PUBLIC USE SUBJECT TO THE REPORT FROM THE ATTORNEYS. The motion carried. RESOLUTION - DIRECTING COUNTY EXECUTIVE TO PREPARE AN ORDINANCE AMENDING ORD. 84 -100 TRANSFERRING THE FIRE MARSHAL SERVICE Chairperson Johnson distributed a substitute resolution to the Committee members. Executive Van Zanten spoke in support of the substitute resolution and provided background information on the resolution. Law and Justice Committee December 18, 1984 Page 2 HANSEY MOVED TO RECOMMEND APPROVAL OF THE SUBSTITUTE RESOLUTION DIRECTING THE COUNTY EXECUTIVE TO PREPARE AN ORDINANCE AMENDING ORDINANCE 84 -100 TRANSFERRING THE FIRE MARSHAL SERVICE AND SUPPORTING FUNDS FOR THE POSITION FROM THE SHERIFF'S DEPART- MENT TO THE PUBLIC WORKS DEPARTMENT. The motion carried. MEMORIAL TO SHERIFF'S DEPARTMENT, PROSECUTING ATTORNEY'S OFFICE AND THE DISTRICT COURT - PROSECUTION OF FRIVOLOUS OR TRIVIAL CASES Chairperson Johnson read page eight, Section 2.4 of the Home Rule Charter and spoke in opposition to the memorial. Hansey stated that the purpose of the memorial was to request the Sheriff's Department, Prosecuting Attorney's office and District Court to review their priorities. Sheriff Mount explained how priorities and cases are handled in his office and spoke in support of tabling this memorial indefinitely. Chairperson Johnson tabled this memorial indefinitely.' He also stated that a letter will be drafted for his signature to Cynthia Tuck explaining that her petition and the corresponding ordinances will be held over until the second meeting in January.
