HomeMy WebLinkAboutCounty Council for August 16 1984OFFICIAL PROCEEDINGS WHATCOM COUNTY COUNCIL Minutes -- August 16, 1984 The Whatcom County Council meeting was called to order on Thursday, August 16, 1984 at 7:30 p.m. by Chairperson Cole with all members present except Jim Hawley. MINUTES MUENSCHER MOVED TO APPROVE THE MINUTES OF THE AUGUST 2, 1984 COUNCIL MEETING AND THE MINUTES OF THE AUGUST 9, 1984 SPECIAL COUNCIL MEETING. Motion carried. EXECUTIVE ITEMS BID AWARD - PACIFIC WATER WORKS SUPPLY -- PARKS, BLAINE AIR FORCE BASE County Executive Van Zanten reported that there had been only one bid received and that the Finance Committee had recommended that the bid of $27,211.28, including tax, by Pacific Water Works Supply for supplies for water main repair requested by the Parks Department for work at Blaine Air Force Base be authorized by the Council. Council member Becker suggested that the first three bid awards be handled as a group and the last two bid awards be dealt with individually. BID AWARD - WHATCOM BUILDERS, LAHTI DRIVE County Executive Van Zanten reported that the bid of Whatcom Builders of $20,400.00, including tax, for the overlay of Lahti Drive was acceptable and recommended authorization. BID AWARD - WILDER CONSTRUCTION. HANNEGAN This bid award is for $105,400, including tax, and is for the overlay of Hannegan Road. BECKER REPORTED THAT THE FINANCE COMMITTEE RECOMMENDED THE ABOVE THREE BID AWARDS BE AUTHORIZED AND MOVED THAT THE THREE ABOVEMENTIONED BID AWARDS BE AUTHORIZED AS PRESENTED BY EXECUTIVE VAN ZANTEN. Motion carried. BID AWARD - WILDER CONSTRUCTION. WOODS /KELLOGG ROADS Executive Van Zanten reported that this award had been reviewed by the Whatcom County Engineering Department, Project Engineer, the City of Bellingham, and the Trillium Corporation, and they all concur with the recommendation of awarding the bid to the low bidder and authorizing the Executive to apply for an addition to the CERB loan in the amount of $94,448.00. Council Minutes August 16, 1984 Page 2 BECKER MOVED TO AUTHORIZE THE EXECUTIVE TO ACCEPT THE LOW BID AND FURTHER THAT THE COUNCIL AUTHORIZE THE ADMINISTRATION TO JOIN THE TRILLIMI CORPORATION IN REQUESTING THE STATE C.E.R.B. BOARD TO INCREASE THE LOW INTEREST LOAN TO ENCOMPASS THE ADDITIONAL AMOUNT IN THE SUM OF $94,448.00. Motion carried. AUTHORIZATION TO REJECT BIDS FOR CRAWLER DOZER Executive Van Zanten changed the authorization to reject all bids to a recommendation to accept the low bid. MUENSCHER MOVED TO ACCEPT THE LOW BID OF MELBROOK EQUIPMENT IN THE AMOUNT OF $88,655.82, AS RECOMMENDED IN THE MEMO DATED AUGUST 6, 1984. Motion carried. REPORT OF THE EXECUTIVE Executive Van Zanten reported on the status of the County Jail. Construction is nearing an end, and verbal assurance of certification of the jail has been received from the State Correctional Standards Board that written confirmation will be received, possibly as soon as the beginning of next week. It was also reported that during 1985 -1986, four different payments will be received from the Correctional Standards Board, up to a maximum of $150,000, which will reimburse the County for revenues expended during the jail construction. Executive Van Zanten also reported on the status of the Planning Commission's review of the Shoreline Master Plan. PRESENTATION, SEMIAHMOO PROPERTY - BLAINE CITY COUNCIL A Blaine City Councilmember had requested that formal presentation of the Semiahmoo property ownership be withdrawn from this meeting's agenda. HEARING PETITION TO VACATE BUSH STREET, PINE STREET AND SUTTER STREET, filed by M. Reid. The hearing was declared open in the matter of a PETITION TO VACATE BUSH STREET, PINE STREET AND SUTTER STREET. Being that no testimony was received, the hearing was closed. Roehl gave a brief history of the street vacation. ROEHL MOVED TO APPROVE THE PETITION FOR THE VACATION OF BUSH STREET, PINE STREET AND SUTTER STREET BY MARY REID, SUBJECT TO THE Council Minutes August 16, 1984 Page three PAYMENT OF THE VALUE OF THE PROPERTY AS DETERMINED BY THE ENGINEER. CHAIRPERSON COLE RESTATED THE MOTION AS TO APPROVE THE PETITION FOR VACATION PROVIDED THAT PAYMENT IS RECEIVED IN ACCORDANCE WITH THE ENGINEER'S VALUATION OF THE PROPERTY. Motion carried. OPEN SESSION Bob Anderson, Land Use Consultant 203 W. Holly Bellingham, WA Bill Trimm, Director Whatcom County Planning Dave Wolfe Whatcom Homebuilders Association Faruk Taysi 116 Forest Lane Bellingham, WA Dick Fowler Board of Realtors Asked for a clarification of unclear wording in the proposed Planned Unit Development Ordinance, page 3, line 22. Also spoke to the need for a binding Site Plan Subdiv- ision Ordinance in order to make the PUD Ordinance work. Answered Mr. Anderson's question on the intent of the wording in the PUD Ordinance and stated the need to remain consis- tent with the concept of mixing uses. Spoke in support of the PUD Ordinance without any conclusionary zoning. Spoke to Councilman Cole's amendment proposal. Spoke in support of the PUD Ordinance as amended. Bob Tull Stated -- -that the PUD Ordinance Box 1126 appears to be an amendment Ferndale, WA to Title 20 which is applicable to every zone district except agriculture. He would like to know whether or not it is intended to apply county -wide. Council Minutes August 16, 1984 Page 4 Bill Trimm, Director Answered Mr. Tull's question by stating that the Ordinance is an amendment to Title 20, and that it is applicable to every zone district except the agriculture zone district. FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES ORDINANCE - COUNTY -OWNED WATER SYSTEM BECKER MOVED FOR FINAL ADOPTION OF AN ORDINANCE RELATING TO AND REGULATING THE USE OF COUNTY -OWNED WATER SYSTEM AND PROVIDING FOR THE SALE OF WATER, FIXING THE PRICE THEREOF, PROVIDING A METHOD OF COLLECTING CHARGES THEREFOR, AND PROVIDING PENALTIES FOR VIOLATIONS. The Chairperson stated that the motion before the Council is the adoption of the third revision of the Ordinance dated July 11, 1984. BECKER MOVED THE FOLLOWING AMENDMENT: "The County Executive will assist applicants and facilitate the groundwork and feasibility of the application. No financial assistance will be granted to the applicant." Motion to amend carried. BECKER MOVED THE FOLLOWING AMENDMENT: Page 5, line 6 Sec. 3 Change "July 31, 1984" to "September 30, 1984 ". Motion to amend carried. Motion to adopt the ordinance carried unanimously. ORDINANCE - CONTROL OF LARGE DOMESTIC ANIMALS HANSEY MOVED THAT THE COUNTY EXECUTIVE BE INSTRUCTED TO NEGOTIATE AN EXTENSION OF THE HUMANE SOCIETY "S CONTRACT WITH WHATCOM COUNTY FOR THE THREE REMAINING MONTHS OF 1984, UNDER THE SAME TERMS AND CONDITIONS OF THE OLD CONTRACT, LESS THE LARGE ANIMALS, AND THAT AN AMOUNT BE DETERMINED TO BE REDUCED FROM THE CONTRACT IN CONSIDERATION OF THE FACT THAT THE HUMANE SOCIETY WILL NOT BE HANDLING LARGE ANIMALS AND THAT A BUDGET TRANSFER ORDINANCE BE PREPARED TO REFLECT THE BUDGETARY TRANSFER. Council Minutes August 16, 1984 Page 5 Hansey spoke to the motion. Johnson spoke in support of the motion provided that someone working in this capacity is qualified to make judgements about the condition of animals. Becker spoke in support of the motion. Muenscher spoke on what was taking place presently during the interim period of the Humane Society contract. CHAIRPERSON COLE MOVED THE FOLLOWING AMENDMENT: (from page 2 of the August 9, 1984 minutes) "Authorize the Executive to extend the contract for total animal control services, through December 31, 1984, provided that: 1. The Sheriff's Department monitor the contract on behalf of Whatcom County; 2. A program of professional training for animal control officers be instituted by the Society and approved by the Sheriff's Department; 3. Animal control officers working under the contract be qualified and perform to the satisfaction of the Sheriff; 4. No citation involving large animals shall be issued without first consulting a doctor of veterinary medicine, and 5. That a request for proposals be issued by the Executive for the provision of animal control services in 1985." Hansey spoke against the amendment. Johnson asked questions about #2 of Cole's amendment. Muenscher spoke against the amendment. Motion to amend failed. . Hansey added to his original motion, with the consent of the Council, the following: "AND THAT A REQUEST FOR PROPOSALS BE ISSUED BY THE EXECUTIVE FOR THE PROVISION OF ANIMAL CONTROL SERVICES IN 1985." The motion was adopted as revised. ORDINANCE - PLANNED UNIT DEVELOPMENT MUENSCHER MOVED TO BRING THE PLANNED UNIT DEVELOPMENT, DRAFT #2 ORDINANCE BEFORE THE COUNCIL. Motion carried unanimously. Councilman Johnson chaired the meeting commencing at this time. Councilman Cole spoke about his proposed amendments to the Planned Unit Development Ordinance. Council Minutes August 16, 1984 Page 6 COLE MOVED THE FOLLOWING AMENDMENT: #1, PUD Ordinance) (See attached Amendment Muenscher requested clarification from the Planning Department as to why the Ordinance was originally drafted with the Planning Department as the enforcing Department of this Ordinance. Bill Trimm, of the Planning Department explained that the former County Executive had advised the Planning Department to draft the Ordinance with this language due to the Department's.background in design consideration. ROEHL MOVED THE FOLLOWING AMENDMENT TO COLE'S AMENDMENT #1: p. 24, line 21 'Buildings and Code Administrator, upon consultation with the Technical Committee," p. 24, lines 282 and 29 "Buildings and Code Administrator, upon consultation with the Technical Committee," p. 24, line 31 Delete "in the opinion of the Planning Director" p. 27, line 232 "Buildings and Code Administrator, upon consultation with the Technical Committee." p. 28, line 6 "Buildings and Code Administrator, upon consultation with the Technical Committee.". Motion to amend the Amendment #1 carried. Executive Van Zanten spoke to the Amendment #1 as amended, stating that in her opinion it was a workable amendment. Motion to adopt Amendment #1 as modified by Roehl's amendment carried (See the attached Amendment #1, as amended). COLE MOVED THE FOLLOWING AMENDMENT: (See attached Amendment #2, PUD Ordinance) ROEHL MOVED TO AMEND COLE'S AMENDMENT #2 BY SUBSTITUTING IT WITH ROEHL'S PROPOSED AMENDMENT #2 (See attached Roehl Amendment #2). Roehl spoke to his proposed amendment to Cole's amendment #2, particularly to the first sentence. Becker spoke in favor of the Roehl amendment. Motion to amend Cole's Amendment #2 carried 4 -2 (Cole, Hansey). Motion to adopt Amendment #2 as amended carried. Council Minutes August 16, 1984 Page 7 COLE MOVED THE FOLLOWING AMENDMENT: (See Amendment #3, PUD ORDINANCE, attached) Cole spoke to his motion, stating:that this would keep Planning Commission Public Hearings out. Faruk Taysi expressed his opinion and the opinion of two of the Planning Commission members on this issue, and he expressed that it would be better to remove the Planning Commission Public Hearings as suggested by this amendment. BECKER MOVED TO AMEND THE AMENDMENT #3 WITH THE FOLLOWING: (2) Delete "or enact" and "or modification" and insert "enacting a" before the word "significant ". Motion to amend carried unanimously. Motion to adopt the Amendment #3 as amended carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT: (See Amendment #4, PUD ORDINANCE, attached) Cole spoke to his motion, stating that this would provide the County with more diversity and affordability in future developments. BECKER MOVED TO AMEND THE AMENDMENT #4 WITH THE FOLLOWING: (10) Delete "diversity ". Insert the word "creativity" in its place. Becker spoke to her amendment to Cole's Amendment. #4. Motion to amend carried. MUENSCHER MOVED TO AMEND THE AMENDMENT #4 WITH THE FOLLOWING: (10) Delete "and industrial development." Motion to amend failed. (1 -5) Motion to adopt Amendment #4, as amended carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT (See Amendment #5, PUD ORDINANCE, attached) Cole spoke to his motion, stating that this would remove the requirement of a public hearing, although the Council could hold a public hearing if it so desired. Motion to adopt Amendment #5 carried unanimously. Council Minutes August 16, 1984 Page 8 COLE MOVED THE FOLLOWING AMENDMENT #6, PUD ORDINANCE) (See attached Amendment Cole restated his amendment making the following editorial change: .026 Strike the word "diversity" and replace it with the word "creativity ". The motion to adopt Amendment #6 carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT: (See attached Amendment #7, PUD ORDINANCE) Cole spoke to this.,amendment. The motion to adopt Amendment #7 carried unanimously. ROEHL MOVED TO AMEND SECTION .108 BEGINNING ON PAGE SIX AND CARRYING OVER TO PAGE SEVEN BY ADDING THE FOLLOWING SECTION AFTER SECTION (e) ON PAGE SEVEN: "(f) A fifteen percent (15 %) increase in base density for the creation and preservation of public access and use of shorelines." Cole spoke in favor of the amendment. Faruk Taysi addressed the Council and asked for clarification as to the amount of access that would be required. Mr. Taysi stated that he felt the Council should specifically define a standard. Cole stated that the Council could always come. back and clarify this further. BECKER MOVED TO AMEND ROEHL'S AMENDMENT BY INSERTING THE WORD "SIGNIFICANT" BEFORE THE WORDS "PUBLIC ACCESS ". Motion to amend carried. Motion to adopt the amendment to section .108 carried. Following a five minute break, the Council once again addressed the PUD Ordinance. COLE MOVED THE FOLLOWING AMENDMENT: page 2, line 8.5 Insert the word "aesthetic" before the word "values ". Motion carried unanimously. Council Minutes August 16, 1984 Page 9 COLE MOVED THE FOLLOWING AMENDMENT: page 2, line 13.5 To read as follows: "The project would ppev�de meet an important social eede -ems need that cannot be realized with the underlying zone." Motion carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT: page 6, line 8 Change the words "Prosecuting Attorney" to "Bureau of Buildings and Code Administration" Cole spoke to his amendment. ROEHL MOVED TO AMEND THE AMENDMENT TO ADD THE FOLLOWING: page 6, line 8 Insert after the words "Code Administration" the words "upon consultation with the Prosecuting Attorney" Motion to amend the amendment carried unanimously. Motion to adopt the amendment as amended carried unanimously. BECKER MOVED THE FOLLOWING AMENDMENT: page 6, line 7 Correct the spelling of the word "covenants". Motion carried unanimously. Cole raised a question about the language on page 8, line 27, regarding the reference to "Whatcom County Road Standards ". Cole stated that this reference should be deleted unless they actually exist. Roehl responded to Cole's statement by stating that road standards are in the process of being developed. ROEHL MOVED THE FOLLOWING AMENDMENT: page 8, line 27 "Whatcom County Rroad Sstandards." Motion carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT: page 9, line 22 "Whatcom County Lland Aalteration 8standards" page 9, line 24 "Whatcom County Bdrainage 8st andards" Council Minutes August 16, 1984 Page 10 page 8, line 27 Remove the word "the" before the word "Whatcom" page 9, line 21 Remove the word "the" before the word "Whatcom" page 9, line 23 Remove the word "the" before the word "Whatcom" Motion carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT: page 11, line 8.5 Replace the word "his" with "his /her" Motion carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT: ' page 12, line 6 Section 20.85.200, Insert an introductory paragraph that reads "The information requested in the following section will be submitted with PUD applications." Motion carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT: page 13, line 16 Change the word "applies" to "apply" page 15, line 29.5 Delete the word "cultural" and substitute the word "physical" in its place. Becker spoke in opposition to the changing of the word "cultural ". The amendment failed. Cole asked that the typographical error of the word "applies" on page 13, line 16, be corrected to read "apply ". Becker pointed out the typographical error of the word "it's" on page 15, line 28, and asked that it be corrected to read "its ". COLE MOVED THE FOLLOWING AMENDMENT: page 17, line 12 "Bdrainage and R,road 8standards" Motion carried unanimously. Council Minutes August 16, 1984 Page 11 COLE MOVED THE FOLLOWING AMENDMENT: page 25, line 30 Change to read as follows: "All improvements shall be built to applicable standards in force at the time of initial PUD application submittal." Motion carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT: page 27, line 1 Delete "complied" and insert the word "met" in its place. Motion carried unanimously._ COLE MOVED THE FOLLOWING AMENDMENT: page 27, line 2 Change to read as follows: "All required improvements have been installed or adequate security has been provided for development." Motion carried unanimously. Cole stated that in the back of the PUD Ordinance a fee of $100 shall be submitted by any applicant requesting a pre - application conference, which is essentially a new fee. He asked what other fees would be charged during the application process. Bill Trimm stated that the $100 would be credited toward the standard application fee for the PUD, which are specified under Section 401. The fees vary according to the zone district. COLE MOVED THE FOLLOWING AMENDMENT: Exhibit 2, Chapter 20 Delete the words "Except for planned HEARING EXAMINER unit developments," 20.92.245, page 3 "Limited Jurisdiction" Motion carried unanimously. COLE MOVED THE FOLLOWING AMENDMENT: Line 5 of the Ordinance Add to the Title "AND AMEND CHAPTER Title 20.04 TO SET FORTH THE DUTIES OF THE BUILDINGS AND CODE ADMINISTRATION" Council Minutes August 16, 1984 Page 12 Line 17.5 of the Ordinance Line 20 of the Ordinance Line 20.5 of the Ordinance Motion to amend carried. Delete "in accordance with" and substitute the words "based upon" "Chapters 20.92 and 20.04" Delete "is" and insert in its place the word "are". Motion to adopt the ordinance as amended carried unanimously. ORDINANCE - 1984 DEVELOPMENTAL DISABILITIES FUND BUDGET BECKER MOVED TO ADOPT AN ORDINANCE TO REVISE THE 1984 DEVELOP- MENTAL DISABILITIES FUND BUDGET. Becker spoke to her motion and gave a brief explanation of the ordinance. Motion to adopt the ordinance carried unanimously. ORDINANCE - 1984 CURRENT EXPENSE FUND, PURCHASING BUDGET BECKER MOVED TO ADOPT AN ORDINANCE TO REVISE THE 1984 CURRENT EXPENSE FUND, PURCHASING BUDGET. Becker spoke to her motion and stated that the Finance Committee recommended approval. Motion to adopt the ordinance carried unanimously. OTHER BUSINESS APPLICATION OF WELSH DEVELOPMENT - SEACLIFFE PARK ROEHL MOVED THAT THE COUNCIL SCHEDULE A PUBLIC HEARING IN THE MATTER OF THE APPLICATION OF WELSH DEVELOPMENT, INC., FOR A MAJOR DEVELOPMENT PERMIT AND PRELIMINARY PLAT APPROVAL TO CREATE A RESIDENTIAL SUBDIVISION AND RECREATIONAL DEVELOPMENT KNOWN AS "SEACLIFFE PARK ". BECKER MOVED TO AMEND THE MOTION WITH THE FOLLOWING: "LIMIT THE PUBLIC HEARING TO ISSUES AS FOLLOWS: 1. THE STABILITY OF THE SLOPE 2. THE DISPOSITION OF EXCAVATED SOIL 3. WATER ALLOCATION 4. SLOPE RECESSION RATE 5. CONFORMITY TO THE POINT ROBERTS COMPREHENSIVE PLAN BUT NOT TO EXCLUDE OTHER ISSUES. THE PUBLIC HEARING WILL BE HELD ON- SITE." Council Minutes August 16, 1984 Page 13 Motion to amend carried. The main motion, as amended, carried. The following items were received and referred as follows: 1. Application of Robert E. Moore for preliminary plat approval to create and develop a residential subdivision to be known as "Moorland Estates" (suggested referral Planning and Development Committee) 2. Petition for a vacation of lot line between Lots 95 and 96 in Division 3, Sudden Valley, filed by Olive F. Lockitch (suggested referral Planning and Development Committee - schedule public hearing) 3. Petition for a vacation of a road between the Grandview and Enterprise Roads filed by Peter Harksell, Sr. (schedule for public hearing, suggested referral Planning and Development Committee) 4. Correspondence on the Kiewit Co. land at Cherry Point filed by Ray Doubt (suggested referral Parks Department) 5. Correspondence on the herbicide spraying at Point Roberts, filed by D. and S. Chamberlain (suggested referral Executive) 6. Correspondence on the Comprehensive Plan amendment for domestic water service plan and sanitary sewer plan (service for the I -5 Exit 270 area) (suggested referral Planning and Development Committee) 7. Correspondence expressing concerns of the Point Roberts Board of Directors (suggested referral Planning and Development Committee) RESIGNATION OF HEARING EXAMINER The resignation of the Hearing Examiner, Stafford Smith, was accepted at this time. ROEHL MOVED TO ADVERTISE IMMEDIATELY FOR A HEARING EXAMINER. JOHNSON MOVED TO AMEND THE MOTION BY ADDING THAT THE CHAIR SHOULD BE DIRECTED TO EXPRESS APPRECIATION ON BEHALF OF THE COUNCIL TO THE HEARING EXAMINER. Motion to amend carried. Roehl stated that he felt the Council as a whole should review the applications received for the Hearing Examiner's position. Roehl withdrew his motion, and it was decided that Cole would draft an advertisement for the position of Hearing Examiner. Council Minutes August 16, 1984 Page 14 INTRODUCTION OF RESOLUTIONS AND ORDINANCES The following items were introduced by consent and referred as follows: 1. Resolution in the matter of cancellation of warrants over one year old in accordance with the provision of R.C.W. 32.22.100 (held until next Council meeting, September 6, 1984) 2. Ordinance authorizing a revised budget for the 1984 Current Expense Fund Medical Examiner budget therein (suggested referral Finance Committee) 3. Ordinance authorizing a revised budget for the 1984 Current Expense Fund, Assigned Council Budget therein (suggested referral Finance Committee) 4. Ordinance authorizing revisions to the 1984 Current Expense Fund, Sheriff's and Prosecuting Attorney's Budgets therein (suggested referral Finance Committee) 5. Ordinance repealing Whatcom County SEPA Ordinance adopted May 30, 1978, and adopting Whatcom County Environmental Policy Administration Chapter 16.08 (suggested referral to Planning and Development Committee) 6. Ordinance in the matter of granting a non - exclusive franchise to the City of Blaine, Washington, for a period of 25 years pursuant to State Law, and Section 9.30 of the Whatcom County Home Rule Charter, to operate and maintain water mains and water distribution lines along certain roads within the unincorporated areas of Whatcom County (schedule public hearing, suggested referral Public Services) REPORT OF COMMITTEES AND OTHER ITEMS OF CONCERN FROM COUNCILMEMBERS Muenscher brought to the Council's attention that the Bakerview Nursery was considering moving to Skagit County. He urged the Council to take a position. MUENSCHER MOVED TO HAVE THE ADMINISTRATION CONTACT THE BAKERVIEW NURSERY TO REGISTER THE COUNTY COUNCIL'S PROTEST TO THE MOVE TO SKAGIT COUNTY. The Bureau shall act as a coordinating agent to ensure that the regulatory process is expeditious, and shall recognize input provided by other departments having appropriate expertise including: the Bureau of Engineering for solid waste, road drainage and land alteration; the Fire Marshall for fire related issues; the Bellingham- Whatcom County Health District for domestic water, waste disposal and noise; and the Planning Department for land use and general site design. All departments of county government shall cooperate fully with the Bureau in the exercise of their duties relative to land use controls and regulations. Council Minutes - Addenda August 16, 1984 Page 3 AMENDMENT #3, PUD ORDINANCE (as amended by Becker motion) Rewrite of page 23, section 340 (County Council) The County Council shall meet to consider the Hearing Examiner's recommendation within twenty -one (21) days of receipt thereof, at which time it may: (1) approve or disapprove the recommendation, or remand the matter to the Hearing Examiner with instructions; or (2) in the event the Council wishes to consider enacting a significant change that does not arise from the record, hold its own public hearing, after giving notice thereof, and approve or deny the planned unit development based upon its own findings .and conclusions. The Council's decision shall be based upon the official record, W.C.C. 20.85.335 and other applicable law.
