HomeMy WebLinkAboutCommittee of the Whole for March 29 1984WHATCOM COUNTY COUNCIL COMMITTEE OF THE WHOLE Minutes -- March 29, 1984 The Whatcom County Council Committee -of- the -Whole meeting was called to order on Thursday, March 29, 1984 at 7:40 p.m. by Chair- man Roehl, with all members present. Continued review was held of the proposed Urban Fringe Compre- hensive Plan and Zoning Texts. Chairman Roehl proposed the following items be dealt with at this meeting: 1. Curtis Road area 2. Guide Meridian & Kellogg Road area (Trillium) 3. Stair Step area near the airport 4. Squalicum Mountain 5. Miscellaneous, comp, plans, etc. C U R T I S R 0 A D Chairman Roehl suggested deleting all references to the SIC codes in the entire zoning code. Bill Trimm, Planning Department, felt that the deleting of SIC codes would not be detrimental. JOHNSON MOVED TO DELETE REFERENCE TO SIC CODES IN THE ENTIRE ZONING CODE CATEGORIES. Motion carried. The following language was before the committee: 20.66.050 Permitted Uses .052 Manufacture of miscellaneous textile goods and fabrication of apparel including clothing, hats, caps, millinery fur products; and miscellaneous fabricated textile products. COLE MOVED TO DELETE THE WORDS "INCLUDING CLOTHING, HATS, CAPS, MILLINERY FUR PRODUCTS" AFTER THE WORD "APPAREL." Motion carried. COLE MOVED THAT THE COMMITTEE RE- INSTATE THE PLANNING COMMISSION'S RECOMMENDATION FOR DESIGNATION OF THE CURTIS ROAD AREA AS GENERAL MANUFACTURING AND RE- INSTITUTING THE LANGUAGE THAT WAS STRIKEN BY THE COTW IN THE COMPREHENSIVE PLAN AND ZONING TEXT. Roehl spoke regarding the motion, in that a compromise should be reached with what the residents want. He would favor a LII zone. Cole stated that he felt economic development should occur somewhere and feels that a LII zone is a "down zone." Roehl spoke regarding promoting growth which %ompatible with the other properties, and ;also stated that a number of operations could be promoted.in the area.as it is now proposed. Hawley agreed in that a compromise should be reached with what the residents want. COTW - .Urban Fringe March 29, 1984 Page 2 Cole feels that the area would be "down zoned," and also stated, on the -one hand, the Council says it will do everything to promote economic /industrial growth in areas where it appears appropriate, and on the other hand, through processes that are very cumbersome and "nit- picky" kill the opportunity for development to occur. Chairman Roehl clarified that "half" of the residents wanted RR zoning and "half" wanted GM zoning. A compromise of a LII zone with expanded uses was proposed. Motion to re- instate the Planning Commission's recommendation failed 2 -5 (Johnson, Roehl, Becker, Hawley, Muenscher). COLE MOVED TO CHANGE THE COMPREHENSIVE PLAN AND ZONING TEXT MAP AND REQUEST THE STAFF TO DEVELOP APPROPRIATE LANGUAGE AND DOCUMENTS TO IMPLEMENT THE CURTIS ROAD AREA AS "SLM," AS IT NOW EXISTS. Cole spoke regarding his motion in that the SLM designation should be left as in the plan, then come back and deal with the concept of the development standards and performance zoning and institute standards perhaps along with a new definition of LII. Roehl stated that the language proposed in the LII is far better than in the SLM designation. Hansey spoke against "down zoning" this area from SLM to LII. Roehl urged councilmembers to vote against the motion. Cole restated his.motion to CHANGE THE COMPREHENSIVE PLAN AND ZONING TEXTS AND MAPS, AND REQUEST THE STAFF TO DEVELOP SUCH FURTHER DOCUMENTS AND /Oft LANGUAGE AS NECESSARY TO DESIGNATE THE CURTIS ROAD AREA AS "SLM." Motion failed 2 -5 (Johnson, Roehl, Becker, Hawley, Muenscher). The following language was before the committee:. 20.66.050 Permitted Uses .059 Fabrication of electrical equipment including radio and television sets; communications equip - ment; electronic components and accessories; and electric lighting equipment and lamps. HAWLEY MOVED TO ADD THE WORDS "INCLUDING HOUSEHOLD APPLICANCES AND INDUSTRIAL APPARATUS';' AFTER THE WORD "LAMPS." Motion carried. The following language was before the committee: 20.66.650 Development Standards - Proposed .657 Enclosure:' All manufacturing or fabrication processes which are capable of producing off- site impacts of a potentially detrimental nature shall be conducted within enclosed structures. ROEHL MOVED TO AMEND .657 TO CHANGE THE WORD "PRODUCING" TO "PRODUCE" AND STRIKE THE WORDS "ARE CAPABLE OF" AND "POTENTIALLY." COLE MOVED TO AMEND THE MOTION TO INCLUDE ADDING THE WORD "PHYSICAL" AFTER THE WORD "PRODUCE." Motion carried. COLE MOVED TO AMEND BY ADDING THE WORDS "SUFFICIENTLY ENCLOSED TO MITIGATE THE IMPACT" AFTER THE WORDS "SHALL BE." Motion carried to amend. Chairman Roehl clarified that .657 will be added after .655 to become 20.66.656. Chairman Roehl stated the amended section to read as follows: 20.66.656 Enclosure: All manufacturing or fabrication processes which produce physical offsite im- pacts of a detrimental nature, shall be suffi- ciently enclosed to mitigate the impact. Motion to approve as amended carried. COTW - Urban Fringe March 29, 1984 Page 4 S T A I R S T E P A R E A Chairman Roehl clarified the location of this area as the property fronting the freeway on the east side from the Slater Road, south to Bakerview. Chairman Roehl suggested that the zoning in the area south of the navigation lights to the Bakerview Road be changed. Roehl also stated that due to the flight pattern (of the airport) and the noise contour, he felt that it was not the place for residential growth (currently zoned RR2) - -he preferred LII. HAWLEY MOVED TO CHANGE THE AREA (as described on the 3/84 re- vision of the Urban Fringe Subarea proposed zoning map as that situated adjacent to Frontage Road, south of the property zoned Airport Opera- tions and north of the area proposed for Residential - Rural -2 dwellings units per acre (RR2). This area is situated in portions of Sections 3,10, and 11, Township 38 North, Range 2 East, W.M.) NORTH OF BAKER - VIEW, WHICH IS PROPOSED RR2, TO LII AND ALSO TO DIRECT PLANNING STAFF TO DEVELOP APPROPRIATE LANGUAGE DESIGNATING THE AREA AS LII. Idotiou carried. HAWLEY MOVED TO CHANGE THE ZONING NORTH OF THE "OLD" RR2 AND SOUTH OF THE R2A AND MAKE THAT AREA LII. Motion carried 5 -2 (Johnson and Roehl) . HAWLEY MOVED TO CHANGE THE ZONING MAP TO DESIGNATE THE AREA - BETWEEN THE "BLUE" AREA AND THE WALDRON ROAD AS LII. Hawley withdrew his motion, due to a concern whether the legal notice of hearing specified this area as a proposed zone change. This item will be dealt with at the next meeting. G U I D E M E R I D I A N / K E L L O G G R O A D JOHNSON MOVED TO CHANGE THE ZONING MAP TO LII ON KELLOGG ROAD AND GUIDE MERIDIAN AREA FOR THE TRILLIUM PROPERTY. This is a southerly extension of LII. Motion carried 6 -0 (Cole abstained). Bill Trimm, Planning, stated that new language is needed to described the RR2 designation per a previous council motion. (Docu- ment 3, page 5). Chairman Roehl referred to a letter from Phillip Serka, dated March 8 and 15, regarding residential /rural water /sewer. COLE MOVED TO ENACT THE AMENDMENTS AS PROPOSED IN MR. SERKA'S LETTERS OF MARCH 8 AND 15, as follows. Motion carried. COTW - Urban Fringe March 29, 1984 Page 5 a) Comprehensive Plan Page 20, paragraph 1 at the top of the page, amended as follows: Land currently served or planned to be served with enly a partial or full range of urban level services, i.e., publicly provi ed sewer and /or water, fire and sheriff protection and storm drainage where appropriate. Page 47, 1.02 - Within the areas designated as RESIDENTIAL -RURAL the land use patterns are intended to reflect the level of services available. Thus, land uses within RESIDENTIAL -RURAL areas should be provided with public sewer and /or water, volunteer fire protection, law enforcement services from the Sheriff's Department and County maintained rural arterials and local access roads with adequate capacity for rural traffic volumes. Page 59, 1.07.1 - Residential Rural - On -site domestic waste water, disposal systems, public sewer facilities, individual wells and /or one additional public utility, i.e., water provided by Whatcom County Water District No. 2, No. 7 and No. 16; sewer service provided by the City of Bellingham; volunteer fire protection from a Whatcom County ire rotec- tion District; public service oriented law enforcement from the Whatcom County Sheriff's Department; and transportation provided by a collector arterial or general access street, maintained by Whatcom County. b) Title 20 - Whatcom County Zoning Code 20.32.251...Where the conventional subdivision method is used to create new building lots, the minimum lot size shall be one acre or if public sewer Ajlsl /or water, and, where specified in the comprehensive plan, storm water drainage facilities are provided the minimum lot size shall be 18,000 square feet. 20.32.252 Maximum Density and Minimum Lot Size RR with public sewer and /or water and, storm water rentention collection facilities where identified by the appropriate subarea comprehensive plan policies. GROSS DENSITY - 2 dwelling units /lA. 20.32.253 Minimum Lot Width and Depth RR with public sewer and /or water and storm water collection and retention facilities where identified by the appropriate subarea comprehensive plan policies. i. t COTW - Urban Fringe March 29, 1984 Page 6 Cole suggested that the committee take up any items held over from this meeting at the next scheduled meeting. Johnson requested the Planning Department staff to include the road names as they pertain to the "stair step" area. Hansey requested that the Council attorney investigate two items before the next meeting, as follows: 1. Check to find out the implications, if any, of the language in the legal notice regarding the public hearing for the urban fringe area, which states, in part," which includes but is not limited to." 2. In light of the requirements needed in order, to..chan p _A14v*&v use plan to a lesser one, find out what those reasons are to make sure that the Council is not subjecting itself to litigation. Roehl noted items that will be discussed at the next meeting, scheduled for Tuesday, April 2, 1984 at 7:30 p.m., as follows: 1. Stair step area 2. Guide Meridian 3. Curtis Road 4.
