HomeMy WebLinkAboutCommittee of the Whole for August 9 1984SPECIAL COUNCIL and COMMITTEE -OF- THE -WHOLE MEETING Minutes -- August 9, 1984 The Special Council and Committee -of- the -Whole meeting was called to order on Thursday, August 9, 1984 at 7:23 p.m. by Chairperson Cole with all members present except Johnson and Hawley. GENERAL DISCUSSION /REVIEW OF ORDINANCE RELATING TO LARGE ANIMAL CONTROL HANSEY MOVED TO GO INTO A COMMITTEE -OF- THE -WHOLE MEETING. Motion carried. A general discussion of animal control issues and a review of an ORDINANCE RELATING TO THE CONTROL OF LARGE DOMESTIC ANIMALS IN THE UNINCORPORATED AREAS OF WHATCOM COUNTY PROVIDING FOR ADMINISTRATION, REGULATION, ENFORCEMENT AND PENALTIES, AMENDING BY MODIFYING CHAPTER 6.04 OF THE WHATCOM COUNTY CODE AND DESIGNATING THE DEPARTMENT OF PUBLIC WORKS AS THE RESPONSIBLE AUTHORIZED AGENCY FOR ADMINISTRATION AND ENFORCEMENT OF CONTROL OF LARGE DOMESTIC ANIMALS was held. County Executive Shirley Van Zanten reviewed her recommendations regarding the ordinance. Doddie Honrud, Director of the Humane Society, stated that she preferred the recommendation of the Executive that would continue contracting with the Humane Society, with more specific direction in areas of concern. Dr. Sharon Hoofnagle, veterinarian, spoke in support of the Humane Society's work in the community, and stated her concerns regarding the possibility of having another department, who may be untrained, handle the responsibilities of animal control. Jane McKnight, Humane Society Board of Directors, spoke regarding the need for more training for the Humane Society officers and staff. Bruce Cottle, county resident, urged Council to give serious consideration regarding the situation with the Humane Society. Doug Olsen, county resident, spoke in support of the Humane Society. Sheriff Larry Mount spoke in support of having a unified program for the control of large and small animals, and that his department will work with the County to provide the enforcement of animal control. Muenscher spoke in support of having the County issue an RFP (Request for Proposals) for the control of small animals, and urged the Council to pass the ordinance that is before the Council. Becker spoke in support of contracting with the Humane Society for the control and enforcement of animals. HANSEY MOVED TO COME OUT OF A COMMITTEE -OF- THE -WHOLE MEETING AND GO INTO A FULL COUNCIL MEETING. Motion carried. Special Council Committee -of- the -Whole August 9, 1984 Page 2 CHAIRPERSON COLE MOVED THE FOLLOWING AMENDMENT: "Authorize the Executive to extend the contract for total animal control services, through December 31, 1984, provided that: 1. The Sheriff's Department monitor the contract on behalf of Whatcom County; 2. A program of professional training for animal control officers be instituted by the society and approved by the Sheriff's Department; 3. Animal control officers working under the contract be qualified and perform to the satisfaction of the Sheriff; 4. No citation involving large animals shall be issued without first consulting with a doctor of veterinary medicine; and 5. That a request for proposals issued by the Executive for the provision of animal control services in 1985. HANSEY MOVED TO AMEND COLE'S MOTION, AS FOLLOWS: "MOVE FOR FINAL PASSAGE OF THE ORDINANCE AS PROPOSED, AND IN ADDITION TO, PASS THE MOTION MADE BY CHAIRPERSON COLE" Hansey withdrew his motion due to a conflict with both motions. Muenscher spoke against Chairperson Cole's motion. Roehl spoke in support of Chairperson Cole's motion. Chairperson Cole's motion to amend failed 3 -2 (Muenscher and Hansey). It was the consensus of the Council to have this matter placed on the agenda for the August 16, 1984 Council meeting. ORDINANCE - AMENDING TITLE 20 Faruk Taysi, Planning Commission, reviewed an ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, TITLE 20 TO ADOPT CHAPTER 20.85, PLANNED UNIT DEVELOPMENT (PUD). Bill Trimm and Jon Holan, Planning Department, also reviewed the ordinance. It was the consensus of the Council to place this matter on the agenda for the August 16, 1984 Council meeting. Special Council Committee -of- the -Whole August 9, 1984 Page 3 BRIEFING BY PROSECUTING ATTORNEY - THE BREAKERS APPEAL A briefing was held by Bruce Disend, Deputy Prosecuting Attorney, regarding *an appeal to the Whatcom County Council to review a decision of the Hearing Examiner regarding the application for conditional use permit 11 -84 and Shoreline S -4 -84 permit. Mr. Disend stated the primary objection to the Hearing Examiner's recommendations is the condition that requires a paved parking lot. Mr. Disend also stated that the applicant has requested a waiver of the requirement of the transcript. ROEHL MOVED TO REQUEST THE APPLICANT TO PROVIDE EITHER A PARTIAL TRANSCRIPT OR TO OBTAIN A STIPULATION AS TO THE FACT THAT ARE PERTINENT TO THIS APPEAL. Motion carried.
