HomeMy WebLinkAboutCommittee of the Whole for April 3 1984MW TAW WHATCOM COUNTY COUNCIL COMMITTEE OF THE WHOLE Minutes -- April 3, 1984 The Committee of the Whole meeting was convened on Tuesday, April 3, 1984 at 7:41 p.m. by Chairperson Roehl with all members present -except Becker. Becker arrived at 8:35 p.m. Continued review was held regarding the proposed Comprehensive Plan and Zoning Texts for the Urban Fringe Subarea. Chairman Roehl announced that any materials given to the Council members after the close of the public hearing, will not be part of the public record. Chairman Roehl stated that some property owners objected to materials being passed out after the public hearing. Chairman Roehl asked Bruce Disend, Deputy Prosecuting attorney, to comment on the question of whether the Curtis Road area would be "down zoned" if zoned LII. Mr. Disend stated that based on the uses that are allowed in a SLM and LII zoning, it did not ap- pear to be :a "down zone" and that the Council is free to do so, providing that sufficient reasons exist. Mr. Disend also stated that the current SLM zone is just an interim zoning designation. In regards to the issue of the Legal Notice, Mr. Disend felt that it is good practice to give specific notice to those areas where the zoning designation is going to change, as opposed to a legal notice which is too broad. Mr. Disend recommended to the Council in that a situation such as this, where specific properties of a limited area are being dealt with, the preference would be to give those individuals specific notice. S T A I R S T E P HAWLEY MOVED THAT THE AREA SOUTH OF SLATER ROAD AND NORTH OF THE AIRPORT OPERATIONS CENTER BE ZONED HC (HIGHWAY COMMERCIAL). JOHNSON MOVED TO SEND TO THE PROPERTY OWNERS WHO LIVE ON THE WALDRON ROAD, SOUTH TO THE SLATER ROAD A NOTICE OF CHANGE OF ZONING. Cole suggested to go to a public hearing on the whole area of the stair step, and give notice that the Council is- considering applying such zoning designations as LII and HC and perhaps others. COLE MOVED THAT THE STAIR STEP AREA, WHICH IS ON THE EASTERN SIDE OF I -5, BE REMOVED FROM THE TEXT OF COMPREHENSIVE PLAN AND ZONING MAP NOW UNDER CONSIDERATION AND THAT A SEPARATE PUBLIC HEAR- ING BE HELD ON THE APPROPRIATE LAND USE AND ZONING DESIGNATIONS FOR THAT AREA. (This would apply to all "three" sections of the stair step area; i.e., RR2 and R2A). Cm = Urban Inge April 3, 1694 Page 2 Hawley withdrew his original motion. Han'se:y spoke r- egarding keeping the RR2 area as changed -- feeling that it is " "str-.ong" enough to stand as is. Cole stated that he felt it should all be done "right." Cole's motion to remove the Stair.Step area from the Compre- hensive Plan and Zoning Map and proceed with a public hearing carried. S L A T E R R 0 A D - L I I Muenscher spoke regarding an area zoned LII (approximately five arts -) by the Slater Road. He felt that this constitutes "spot zoning" and feels that it is not proper. MUENSCHER MOVED TO TAKE THE DESIGNATION OF LII AWAY FROM THE SMALL PA- CEL OF LAND AND RE -ZONE IT R5A. Roehl stated his concern about the possible incursion into the more residential and rural areas to the south of III. Muenscher's motion to re -zone the LII to a R5A failed 5 -2 ( Roehl, Muenscher). G U I D E M E R I D I A N Chairman Roehl stated that this area was outside of the public hearing notice and that no changes could be made immediately but that proposals could be made for the future and go through the process once again. Hawley proposed notifying the property owners from the city limits to the Smith Road of a public hearing and proposed zone change. Cole spoke against the proposal in that to extend commercial development along that area would add to the already present trans- portation problem. Roehl stated his concerns regarding zoning this area GC and then adding to the problem of transportation along the Guide. Hawley spoke in support of his proposal in that he felt that the traffic is already there, the business: -s are already there, etc. COTW - Urb an ,. 1nge April 3, 1-984 Paige 3 HA LEY.Y.MOVED.TO EXTEND THE GC ZONE AREA ON THE GUIDE MERIDIAN TO THE HORTON ROAD. Roehl stated that he would not vote for the motion. Mens;cher stated that he would vote against the motion. C U R T I S R O A D HANSEY MOVED TO ADD THE FOLLOWING LANGUAGE TO THE COMPRE- HENSIVE.LAND USE PLAN: 1.04.1 Curtis Road LIGHT INDUSTRIAL PARK area: Industrial truck traffic shall be prohibited west of the railroad line on Rtial' Avenue. Motion carried. HANSEY MOVED TO ADD THE FOLLOWING LANGUAGE: Chapter 20.66. LIGHT IMPACT INDUSTRIAL DISTRICT 20.66.050 PERMITTED USES .058 Processing and packaging of drug and pharmaceuticals, perfumes and cosmetics. Motion carried to add "perfumes and cosmetics" to .058. HANSEY MOVED TO ADD THE FOLLOWING LANGUAGE: 20.66.050 PERMITTED USES .058 Rail, truck and freight terminals; ware- housing and storage; and parcel delivery service; freight forwarding, inspection weighing services and packing and crating. Motion carried to add "freight forwarding, inspection weighing services and packing and crating" to .062. Motion carried to delete "including general building, and special trade" and add "offices and yards." HANSEY MOVED TO ADD TO .067 THE FOLLOWING LANGUAGE: .067 Wholesale trade or storage.of durable and non - durable goods including automobile parts and supplies; tires and tubes; furniture and home furnishing; lumber and other construc- tion materials; sporting goods, toys and hobby goods; metal service centers and offices ;. electrical goods; hardware, plumbing and hearing equipment, machinery equipment and supplies; jewelry, watches and precious stones; other durable goods; paper and paper products; drugs, properties and sundries; apparel, piece goods and notions, groceries and related products; beer wine and distilled beverages; and miscellaneous non - durable goods provided, however, that trade, storage or pro- cessing of sulphur shall be prohibited. Motion carried to add the above language. HANSEY MOVED TO ADD BACK THE "OLD" .068 AMENDED TO READ AS FOLLOWS: .068 Other uses determined by the Hearing Examiner after a public hearing to be: 1) consistent with the purpose and intent of the district; 2) similar in environmental effect upon sur- rounding land uses; 3) able to fully comply with the performance standards of the dis- trict as well as any mitigating measures imposed by SEPA. Cole spoke against the motion in that he felt it should be dealt with in the "Interpretation of Conflict" section and that he intended to make a motion to that affect. Hansey withdrew his motion. Roehl spoke against the motion in that he felt this should deal only with fabrication and not the manufacturing and processing'.of metal product-s. Also, felt that the Performance Standards need to be in ., ".Plbce" prior to dealing with these changes. Motion carried 5 -1 -0 (Roehl, Becker abstaining). HANSEY MOVED TO DELETE, .072, AND ADD THE FOLLOWING LANGUAGE: .072 Manufacture ,processing, treatment and fabrication of lumber, millwork, mo le homes, travel trailers, campters, m'scel- lan.eous wood products and other uil ing, roo ina and .construction materials pro shall be conducted witnin an encloses structure equipped wlit ' any required scrubbing or filtering equ' ptrient . JOHNSON MOVED TO AMEND MOTION TO ADD THE WORDS "AND NOISE" AFTER THE WORD "ODOR." Motion carried. COLE MOVED TO AMEND .072, AS FOLLOWS: .072 ...provided that all odor and noise producing processes shall be conducted within an enclosed structure equipped with any-re -. qu-ired such scrubbing, filtering equip- ment, or noise reduction equipment as is necessary to mitigate the odor and /or noise produced. ' Motion to amend carried. The following language was before the Council: .151 Fabrication of rubber products and manufacture of miscellaneous plastic products only from purchased resins. MOVE THE FOLLOWING .(.underlined) LANGUAGE TO PERMITTED USE AND.LEAVE REMAINING LANGUAGE AS A CONDITIONAL USE: 20.66.150 CONDITIONAL USES .152 Manufacture of flat glass; pressed and blown glass and glassware; glass products from purchased glass; hydraulic cement; pottery and related products; concrete sypsum and plaster products; and abrasive, asbestos, and miscel- laneous non - metallic mineral products; and cutting and shaping of stone products. Roehl spoke against the motion in that the residents did not want this type of industry and feels that they should stay in "Condt:3.ona1 Uses." Muenscher supported Roehl's statement regarding these uses as a conditional use. Becker also supported Roehl's statements. Motion carried 4 -3 ( Roehl, Muenscher, Becker). HANSEY MOVED THAT A NEW SECTION BE ADDED UNDER CONDITIONAL USES, "MANUFACTURE OF PAINTS." Roehl stated that he opposes the manufacture of paint as a conditional use. Motion carried 4 -3 ( Roehl, Muenscher, Becker). HANSEY MOVED FOR ANOTHER CONDITIONAL USE AND NEW SECTION BE "BOTTLING PLANTS." COLE MOVED TO AMEND THE MOTION TO MAKE "BOTTLING PLANTS" A PER- MITTED USE INSTEAD OF A CONDITIONAL USE. Hansey accepted it as part of his motion. Cole referred to a letter from Ted Gacek, dated 3- 12 -84, which proposes 1ari-guage under section 20.66.050. COLE MOVED TO ADD AS A CONDITIONAL USE: 20.66.050 Coall.ection., transfer, re- packing, cutting, grading and similar non- processing activities for 'animal', dairy, fruit. veltetab e. seafood. S. Cole spoke regarding his motion in that this would allow food processing to occur of a kind which is not apparently well- provided for in other zones throughout the county. Muenscher... proposed the deletion of the word "seafood" from the above motion. The committee did not elect to support Muenscher pro- posal. Motion carried 5 -2 (Muenscher, Roehl). COLE MOVED TO AMEND 20.04.030 INTERPRETATION AND CONFLICT, AS FOLLOWS: (To delete the existing language and add the following) ut subsequent. chapters, which deal with al and industrial zones, land use activity are used to identify allowable commercial, al and business activities within various istricts. Commercial, industrial and usiness es that are similar in nature and impact capable of satisfying applicable performance lonment standards shall be treated as conditional uses. Motion carried 5 -2 ( Roehl, Muenscher) Chairman Roehl presented the committee draft II of the two ordinances dealing with re- zoning of the Urban Fringe area. Bill Trimm, Planning Department, noted the amendments to the ordinances as follows: AN ORDINANCE ADOPTING AND AMENDING TITLE 20, THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, FOR THE GEOGRAPHIC AREA KNOWN AS THE URBAN FRINGE SUBAREA OF WHATCOM COUNTY GOTW Urban Inge Ask April 3 , 1-6­4. Page 8 On page_1, lines 23 through 29 are additions, as follows: WHEREAS, the Whatcom County Council has reviewed the Planning Agency's Findings, Reasons and Motion and as a resu.l:t of such review has recommended changes to ti'6. --A iendments to Title 20 as recommended by the Planning Agency; and WHEREAS, the Whatcom County Council has conducted two public hearings in August 1983 and March 1984 for the purposes of receiving testimony on such recommended changes;" and:., AN .ORDINANCE AMENDING THE 1970 WHATCOM COUNTY OOMgREHENSIVE PLAN TEXT AND MAP FOR THE GEOGRAPHIC AREA KNOWN AS THE URBAN FRINGE SUBAREA OF WHATCOM COUNTY. On page 1, lines 22 through 30 are additions as follows: "WHEREAS, the Whatcom County Council has reviewed the Planning Agency's Findings, Reasons and Motion, and as a result of such review has recommended changes to the proposed Urban Fringe Subarea Comprehensive Plan, pursuant to the provisions of RCW 36.70.430 and .440; and WHEREAS, two additional public hearings were conducted in August, 1983 and March 1984 by the Whatcom County Council on said recommended change;" Cole stated that he felt the language in the Title 20 ordinance, page 2, lines 1 through 4, needs to be re -done. Mr. Trimm said that it will be done. It was the consensus of the committee to strike Section 3, on page 2 of the Title 20 ordinance. Chairman Roehl presented and referred to .a memorandum, dated April 3, from Bill Trimm, Planning Director, proposing changes to the LII and RR zone. Mr. Trimm requested Council approval on the Planning staff's revisions to the text, based upon revisions made by the Council to the map (document 3). Motion carried. Mr.. Trimm suggested adding new language to section 1.07.1, as follows: 1.07.1 RESIDENTIAL- RURAL: On -site domestic waste water disposal systems and individual wells, or one public utility; i.e., water . prOVided by Whatcom County Water Districts No. 2 and No. 7 and No. 16, volunteer fire protection from a Whatcom County Fire Pro- tection District; public service oriented law enforcement from the Whatcom County Sheriff's Department; and transportation provided by a collector arterial or ,general access street, malatainedi by.Whatcom County.
