SPECIAL COUNCIL MEETING
Minutes -- April 25, 1985
The Whatcom County Council Special Council meeting was called
to order at 7:10 p.m. by Chairman Roehl, with all members present
except Cole and Hansey. Hawley arrived at 7:15 p.m.
Chairman Roehl read into the record a statement by Craig
Cole, removing himself from participation at this Special Council
meeting (see copy attached).
Chairman Roehl turned the meeting over to Muenscher, Chair-
person of the Planning and Development Committee.
HEARING - REQUEST OF AN AMENDMENT TO THE AGRICULTURAL
ZONE TEXT OF THE INTERIM ZONING ORDINANCE
The hearing was declared open in the matter of the request
for an amendment to the Agricultural zone text of the Interim
Zoning Ordinance to allow for small -scale eating and drinking
establishments as conditional uses when directly associated with an
agricultural processing operation.
Bill Trimm, Planning Director, .read into the record a list
of exhibits.
Chairperson Muenscher brought to the Council's attention
a discrepancy between the published meeting time and the meeting
time as noted on the agenda. The meeting was recessed until 7:30
in order to coincide with the meeting time noted on the agenda.
At 7:30 p.m. the meeting was reconvened, and the hearing
was continued.
Bill Trimm, continued with his presentation. He explained
the background on the staff report and provided a summary of the
application.
Faruk Taysi, Director of Marketing for Trillium Corporation,
provided further background on the application.
David Syre, President of Trillium Corporation, spoke on the
history of farming in Whatcom County and explained his reasons
for requesting the amendment to the Agricultural zone text of the
interim Zoning Ordinance.
Faruk Taysi explained the Trillium Corporation's proposal
further.
Chairperson Muenscher stated that the Council was only
considering the amendment to the Agricultural zone text of the
Interim Zoning Ordinance at this meeting, and that the proposal

that the Trillium Corporation was explaining tonight was not being
considered at this time.

Being that no further testimony was received, the hearing
was closed at 8:00 p.m.
Following discussion on the proposed amendment to the Agri-
cultural Zone text, HAWLEY MOVED TO AMEND THE AGRICULTURAL TEXT
OF THE INTERIM ZONING ORDINANCE WITH TILE FOLLOWING NEW PROVISION:
".164 Restaurants, when located on the same property
and subordinate to a permanent facility for the
processing of agricultural products into food
or beverage for human consumption, provided that
the size, scale and character of the restaurant
facility are compatible with the agricultural/
rural character of the surrounding area and is
consistent with the general purpose of the zone
district."
BECKER MOVED TO AMEND THE MOTION BY CHANGING THE WORD
"is" TO "are ".
Becker's motion to amend carried.
IIawley spoke to the main motion as amended.
Johnson spoke against the motion.
The motion to amend the Agricultural Text of the Interim
Zoning Ordinance carried (4 -1, Johnson).
Chairman Roehl stated that the ordinance incorporating
this amendment would be prepared for introduction at the next
meeting.
The meeting was adjourned at 8:30 p.m.

RE: Request by Trillium Corporation for an amendment
to
the Agricultural zone text of the Interim Zoning;
Ordinance
I would appreciate your reading in the record this statement:
Because of potential business transactions with a party to
this matter, I am removing myself from participation in
order to avoid an "appearance of fairness" problem.
I must emphasize that in fact I have no conflict of interest
pertaining to this issue and would be able to judge this
matter fairly and impartially. The outcome of this pro-
ceeding would not affect me in either a beneficial or
negative manner. The State's "Appearance of Fairness" law
requires, however, that great caution be exercised.
Therefore, I will participate in this matter only if the
Council is unable to muster a majority to dispose of the
issue one way or another. In that event, I would review the
record of the proceedings and vote at a future meeting.
