PUBLIC SERVICES COMMITTEE
Minutes -- July 9, 1985
The Whatcom County Council"Public Services Committee was called to
order at 4:25 p.m. by Acting Chairperson Hawley. Also in attendance
were Committee member Bob Muenscher; Randy Watts, Civil Deputy Prose-
cuting Attorney, and Jim Kresge, Engineering Department.
ORDINANCE REGARDING THE MATTER_OF_PLACING A STOP SIGN AT THE INTERSEC-
TION OF 42ND CT. LgEtST -AND , LOOMIS TRAIL ROAD
Jim Kresge, Engineering Department, explained the ordinance
regarding the matter of placing a stop sign at the intersection of 42nd
Ct. West and Loomis Trail Road. There was 'discussion on the naming of
42nd Ct, W,est, which is pending on the Council's July 11th agenda.
MUENSCHER MOVED TO RECOMMEND TO THE COUNCIL "DO PASS" ON THE
ORDINANCE REGARDING THE MATTER OF PLACING A STOP SIGN AT THE INTERSEC-
TION OF 42ND CT. WEST AND LOOMIS TRAIL ROAD.
The motion carried.

ROAD RIGHT -OF -WAY
There was discussion on the resolution placing the name 42nd
Ct. West on a certain County road right -of -way.
MUENSCHER MOVED TO RECOMMEND TO THE COUNCIL "DO PASS" ON THE
RESOLUTION REGARDING THE MATTER OF PLACING A NAME ON A CERTAIN COUNTY
ROAD RIGHT -OF -WAY.
The motion carried.
RESOLUTION IN THE MATTER OF THE WHATCOM COUNTY COMPREHENSIVE SIX YEAR
ROAD PROGRAM FOR THE YEARS 1986 THROUGH 1991
Jim Kresge explained the comprehensive six year road program.
There was discussion on the Hemmi Road bridge project.
Following further discussion on the six year road program,
MUENSCHER MOVED TO RECOMMEND "DO PASS" TO THE FULL COUNCIL OF THE
RESOLUTION IN THE MATTER OF THE WHATCOM COUNTY COMPREHENSIVE SIX YEAR
ROAD PROGRAM FOR THE YEARS 1986 THROUGH 1991.
The motion carried.

ORDINANCE AMENDING WHATCOM COUNTY CODE SECTION 9_32 BY CREATING A NEW
SECTION PROHIBITING THE DISCHARGE OF FIREARMS ITT DIVISIONS 1 AND
2 OF BOYNTON SUNSET TRACTS
Hawley explained the background on the ordinance amending Whatcom
County Code Section 9.32 by creating a new section prohibiting the
discharge of firearms in divisions 1 and 2 of Boynton Sunset Tracts.
Muenscher spoke in support of working toward a County -wide
ordinance related to the control of firearms.
MUENSCHER MOVED TO RECOMMEND TO THE FULL COUNCIL "DO PASS" ON THE
ORDINANCE AMENDING WHATCOM COUNTY CODE SECTION 9.32 BY CREATING A NEW
SECTION PROHIBITING THE DISCHARGE OF FIREARMS IN DIVISIONS 1 AND 2 OF
BOYNTON SUNSET TRACTS.
Hawley spoke in support of amending the ordinance with the
following:
Page 1, line 30, change to read as follows: "...not less than
Eif_ty__Dollars_50�00�, or more than T�v4_�iuDg�]_'i ears
($250.00)..."
Randy Watts, Civil Deputy Prosecuting Attorney, stated that the
language in Section 9.32 was not consistent throughout when it comes to
penalties, and that the Counc�� should be careful that the penalty is
y not inordinately severe in one area in relationship to other areas
where penalties are established for the same thing. He read portions
of Section 9.32 as it relates to penalties in other areas.
MUENSCHER MOVED TO AMEND THE ORDINANCE WITH THE FOLLOWING:
Pa,gq „1, line 30, change to read as follows: "...not less than
Ten Dollars ($10.00) or more than Two Hundred Fifty Dollars
($250.00)...”
The motion to amend carried.
The main motion, as amended, was not voted on.
ORDINANCE REPEALING WHATCOM COUNTY CODE 2.40.080
Randy Watts explained the ordinance repealing Whatcom County Code
2.40.080.
MUENSCHER MOVED TO RECOMMEND TO THE COUNCIL "DO PASS ",ON THE
ORDINANCE REPEALING WHATCOM COUNTY CODE 2.40.080.

The motion recommending "do pass" to-the full Council on the
ordinance repealing Whatcom County Code 2.40.080 carried.
The meeting was adjourned at 4:55 p.m.
