HomeMy WebLinkAboutLaw and Justice Committee January 15 1985WHATCOM COUNTY COUNCIL LAW AND JUSTICE COMMITTEE Minutes -- January 15, 1985 The Whatcom County Council Law and Justice Committee was called to order at 1:06 p.m. by Chairperson Johnson with Committee member Hawley present. Also in attendance was Councilmember Cole. PETITION RECEIVED FROM CYNTHIA TUCK Johnson reported that this petition had motivated the Committee to draft the ordinances on today's agenda. ORDINANCE PROHIBITING NUDITY IN PLACES WHERE LIQUOR IS SOLD OR CONSUMED ORDINANCE REGARDING EROTIC DANCE STUDIOS Cole spoke on the research that had gone into the two final drafts of these ordinances and on the legal issues involved. Following discussion on these two ordinances, it was noted that there was an omission in the ordinance prohibiting nudity in places where liquor is sold or consumed, and that in Section 1, titled "Definitions ", the subsection (c) Person should have added at the end of it "excluding non - profit corporations." Frank Travis, Point Roberts, urged the Committee to be careful of loopholes. HAWLEY MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE PROHIBITING NUDITY IN PLACES WHERE LIQUOR IS SOLD OR CONSUMED PENDING THE OUTCOME OF THE PUBLIC HEARING ON FEBRUARY 7, 1985, WITH THE ADDITION ON PAGE 1, LINE 20, OF THE WORDS "EXCLUDING NON- PROFIT ORGANIZATIONS ". The motion carried. HAWLEY MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE REGARDING EROTIC DANCE STUDIOS. The motion carried. DISCUSSION REGARDING SCHOOL ZONE Chairperson Johnson read a regarding the reduction of speed miles per hour between the hours specific reference to the school Meridian Middle School and Irene SPEED LIMITS letter from William H. McCormick limits in school zones to 20 of 7 a.m. and 5 p.m., with zone on the Hannegan Road near Reither Elementary School. Law and Justice Committee January 15, 1985 Page 2 s Ed Henken, County Engineer, reported that the County's school zones have all been looked at within the past few years. Doug Gill, Sheriff's Department, reported that the 35 m.p.h. speed limit is appropriate on the Hannegan Road due to the visibility and that there are no problems with the way things are now. Jeff Monsen, Engineering Department, will provide Johnson with a copy of the ordinance setting the speed limits in the County's school zones in order for Johnson to draft a letter to Mr. McCormick informing him of the outcome -of this meeting.
