HomeMy WebLinkAboutPlanning and Development September 12 1985WHATCOM COUNTY COUNCIL Planning and Development Committee Minutes -- September 12, 1985 The Whatcom County Council Planning and Development Commit- tee was called to order at 3:15 p.m. by Chairperson Muenscher. Committee member Roehl will. be in attendance later in the meeting, and Committee member Johnson was not present. Also in attendance were Campbell Kintz, Hearing Examiner; Bill Trimm, Planning Director; Jerry Mixon, Bureau of Building and Codes Administration; Randy Watts, Civil Deputy Prosecuting Attorney; Carolyn Casey, Bellingham Herald; Mr. and Mrs. George Courville; Ernie Bentley, attorney; and Dick Little, attorney. Due to the lack of a quorum, Chairperson Muenscher stated that staff reports and recommendations would be taken, but that no formal Committee action or recommendations would take place until Committee member Roehl was present. Jerry Mixon, Bureau of Building and Codes Administration, explained that they had reviewed the petition for lot line vacation between lots 47 and 48, Division 12, Plat of Sudden 'alley, filed by George and Jacqueline Courville, and that they ,gad no objections to the proposed vacation. Ali Wlykl Jerry Mixon stated that the Bureau of Building and Codes Administration had reviewed the petition for lot line vacation between lots 345 and 346, Division 22, Plat of Sudden Valley, filed by Orville and Ferne Chapman, and recommended approval of the petition. Campbell Kintz, Hearing Examiner, explained the background on the remand of the appeal filed by Scholten & Eshuis Roofing in the matter of Conditional Use application C.U. 3 -85. There were no further questions or discussion on the Hearing Examiner's decision on remand. PLANNING COMMISSION RECOMMENDATIONS ON APPLICATIONS FOR OPEN SPACE Bill Trimm explained the background on the applications for Open Space filed by the following: D. Smith, S. Johnson, A. Osborne, P. Campbell, R. Van Egdom and E. Johnson. Whatcom County Council Planning and Development Committee Minutes, September 12, 1985 Page 2 Ernie Bentley, attorney for Alva Osborne, whose application for open space includes property with an eagle's nest on it, provided information on the eagle's nest. Committee member. Roehl arrived at the meeting, and a quorum was present. Bill Trimm asked that the application of E. Johnson be added to the Council's September 19th agenda for consideration. Chairperson Muenscher explained the background on the' applications to Committee member Roehl. ROEHL MOVED TO RECOMMEND TO FULL COUNCIL APPROVAL OF THE PLANNING COMMISSION RECOMMENDATIONS IN THE MATTER OF THE OPEN SPACE APPLICATIONS OF D. SMITH, S. JOHNSON, A. OSBORNE, P. CAMP- BELL, R. VAN EGDOM AND E. JOHNSON. The motion carried. HEARING EXAMINER'S FINDINGS, CONCLUSIONS AND pECISION ON REMAND, FIRST SPIRITUALIST CHURCH, C.U. 13 -85 Campbell Kintz commented that it appeared that the appel- lants had not been notified of the Planning and Development Committee meeting. The appellants will be notified of the Council meeting on September 19th. Campbell Kintz summarized the hearing that was held on the remand. There was discussion on the remand hearing and the revised conditions. Chairperson Muenscher requested that the Hearing Examiner meet with Council's attorney and work out the specific language for the revised conditions. ROEHL MOVED TO FORWARD THIS AGENDA ITEM TO THE FULL COUNCIL WITHOUT A RECOMMENDATION FROM THE COMMITTEE. The motion carried. ORDINANCE AMENDING BUILDING HEIGHT DEFINITIONS AND REGULATIONS Jerry Mixon provided a brief history of the ordinance amending building height definitions and regulations of Title 20, the Official Whatcom County Zoning Ordinance, and Whatcom County '' -Ide 2.24, the Interim Zoning Ordinance. He stated that a new ction .162 defining "grade" needed to be added as part of Whatcom County Council `lanning and Development Committee Ainutes, September 12, 1985 Page 3 exhibit "A" of the ordinance for the September 19th Council meeting. ROEHL MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF' THE ORDINANCE AMENDING BUILDING HEIGHT DEFINITIONS AND REGULATIONS OF TITLE 20, THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, AND WHATCOM COUNTY CODE 2.24, THE INTERIM ZONING ORDINANCE, WITH THE ADDITION OF THE NEW SECTION .162 DEFINING "GRADE ".
