Minutes -- November 21, 1985
The Whatcom County Council Planning and Development Committee
was called to order at 7:00 p.m. by Acting Chairperson Roehl. Also in
attendance were Committee member Johnson; Randy Watts, Civil Deputy
Prosecuting Attorney, and Bill Trimm, Planning Director.
Roehl explained the background on the request received from Roy
Pearson regarding clarification of the location of the boundary
between the AG and GP zones for the Dodson Mobile Home Park.
Donovan Kehrer, Building and Codes Administration, explained the
situation further.
There was discussion on the boundary location.
JOHNSON MOVED TO RECOMMEND TO THE FULL COUNCIL THAT THE COUNTY
COUNCIL AMEND THE COUNCIL'S FINDINGS OF FACT, CONCLUSIONS OF LAW AND
DECISION IN THE MATTER OF THE APPLICATION OF W.L. DODSON TO CREATE
ODSON MOBILE HOME PARK, TO RECOGNIZE THAT THE BOUNDARY BETWEEN THE AG
AND GP ZONES BE DEFINED AS THE 100 YEAR FLOOD PLAIN BOUNDARY, AS
DESIGNATED BY FEMA MAPS.
Johnson stated that this would not change his feelings about the
project itself.
The motion carried.
ORDER ON REMAND FROM SHORELINES HEARING,? BOARD, RE: PAP TTI
Randy Watts,.Civil Deputy Prosecuting Attorney, explained the
background on the order on remand received from the Shorelines Hearing
Board regarding Mr. Papetti's application to build a dock.
There was discussion on the order on remand.
Roehl read the Council's previous findings, conclusion and
decision regarding this matter.
This item will be continued until later in the meeting.
PETITION FOR LOT LINE VACATION, LOTS 62 AND 63, PLAT OF PEACEFUL
VALLEY, FILED BY MR. AND MRS. JOHN PEIPMAN
Roehl explained the background on the petition for lot line
acation between lots 62 and 63, Plat of Peaceful Valley, filed by
Mr. and Mrs. John Peipman.

JOHNSON MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL ON THE
PETITION FOR LOT LINE VACATION BETWEEN LOTS 62 AND 63, PLAT OF
PEACEFUL VALLEY, FILED BY MR. AND MRS. JOHN PEIPMAN, SUBJECT TO THE
OUTCOME OF THE PUBLIC HEARING.
The motion carried.
QRDINANCE TEMPORARILY CREATING NEW SECTIONS TO BOTH THE WHATCOM •,i;;

WHATCOM COUNTY ZONING ORDINANCE. TITLE 20, TO ALLOW TEMPORARY
RECREATIONAL VEHICLE PARKS AND CAMPGROUNDS IN SPECIFIED ZONE
DISTRICTS
Bill Trimm, Planning Director, explained the background on the
proposed ordinance and on some recommended housekeeping amendments, as
contained in Carl Batchelor's memo dated November 7, 1985 (see
attached).
There was discussion on the ordinance and on the recommended
housekeeping amendments.
JOHNSON MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF THE
ORDINANCE TEMPORARILY CREATING NEW SECTIONS TO BOTH THE WHATCOM COUNTY
INTERIM ZONING ORDINANCE, TITLE 2.24, AND THE OFFICIAL WHATCOM COUNTY
ZONING ORDINANCE, TITLE 20, TO BE KNOWN AS SECTION 2.24B AND 20B
RESPECTIVELY, TO ALLOW TEMPORARY RECREATIONAL VEHICLE PARKS AND
CAMPGROUNDS IN SPECIFIED ZONE DISTRICTS AS PERMITTED USES SUBJECT TO
ADMINISTRATIVE APPROVAL ONLY DURING THE PERIOD FROM APRIL 1, 1986
THROUGH NOVEMBER 30, 1986, WITH THE AMENDMENTS AS NOTED IN CARL
BATCHELOR'S MEMO DATED NOVEMBER 7, 1985.
The motion carried.
There was discussion on the resolution relinquishing a lease of
easement for rights -of -way for wharf site over and across certain Lake
Whatcom shorelands.
Randy Watts explained the resolution.
There was further discussion on the resolution.
This resolution will be held in committee for two weeks.
The discussion was continued on the order on remand regarding
Mr. Papetti's application to build a dock.

Mr. Papetti explained his situation regarding the application to
build the dock on his property.
There was discussion on the procedure that should be followed on
the order on remand.
Roehl spoke in support of upholding the Hearing Examiner's
decision in the matter of Mr. Papetti's application to build a dock.
JOHNSON MOVED TO RECOMMEND TO THE COUNCIL THAT THEY RESCIND THEIR
FINDINGS, CONCLUSIONS OF LAW, AND REVERSE THEIR DECISION IN THE MATTER
OF MR. PAPETTI'S APPLICATION TO BUILD A DOCK AND THAT THE HEARING
EXAMINER BE UPHELD.
There was discussion on the motion.
The motion carried.
There was discussion between Committee members and Mr. Papetti as
to when it would be convenient for Mr. Papetti's schedule to bring
this matter before the Council for consideration. Mr. Papetti will
cot: ct the Council office to advise them of a convenient date.
The meeting was adjourned at 7:50 p.m.
