PLANNING AND DEVELOPMENT COMMITTEE
Minutes -- May 7, 1985
The Planning and Development Committee was called to order
at 3:00 p.m. by Chairperson Muenscher with all members present.
Also in attendance were Donovan Kehrer, Bureau of Building and
Codes Administration; Bill Trimm, Planning Department; Campbell
Kintz, Hearing Examiner; Faruk Taysi, Trillium Corporation; Ray
Weden,'Weden and Associates; Larry Willman, Mt. Bank Bank; Robert
Kloc, and Marjan Eicher.
ORDINANCE AMENDING SETBACK REQUIREMENTS, WHATCOM COUNTY CODE 20.80
Bill Trimm explained the background on the ordinance amending
the setback requirements of the General Manufacturing zone found
in Whatcom County Code 20.80.
JOHNSON MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE AMENDING
THE SETBACK REQUIREMENTS OF THE GENERAL MANUFACTURING ZONE FOUND
IN WHATCOM COUNTY CODE 20.80.
The motion carried.
ORDINANCE AMENDING TITLE 20.40 OF INTERIM ZONING ORDINANCE
Bill Trimm explained the background on the ordinance amending
Title 20.40 of the Interim Zoning Ordinance.
ROEHL MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE AMENDING
TITLE 20.40 OF THE INTERIM ZONING ORDINANCE.
The motion carried.
PETITION FOR LOT LINE VACATION. FILED BY ROBERT KLOC
Donovan Kehrer presented his staff report and stated that he
recommended approval of the petition.
ROEHL MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF
THE PETITION FOR LOT LINE VACATION BETWEEN LOTS 16, 17 AND 18
DIVISION 6, PLAT OF LUMMI ISLAND SCENIC ESTATES, FILED BY ROBERT
KLOC, SUBJECT TO THE OUTCOME OF THE PUBLIC HEARING ON JUNE 6, 1985.
The motion carried.

PETITION TO CHANGE PLAT OF SANDY POINT SHORES. FILED BY MARJAN EICHER
Donovan Kehrer explained the background on the petition filed
by Marjan Eicher. He stated that his report covers Marjan Eicher's
two lots (24 and 25, Division 1) although her petition originally
stated that she was applying on behalf of all the lot owners for
lots 22 -32.
Marjan Eicher explained the petition request further.
Following further discussion, JOHNSON MOVED TO RECOMMEND APPROVAL
OF THE PETITION TO CHANGE THE PLAT OF SANDY POINT SHORES, LOTS 24
AND 25, DIVISION 1, FILED BY MARJAN EICHER, AND REQUEST DONOVAN
KEHRER TO RESEARCH THE PROPER PROCEDURE FOR ERASING THE SETBACK
LINE ON THE OTHER LOTS.
The motion carried. The public hearing will be held June 6th.
JOHNSON MOVED TO AMEND MARJAN EICHER'S PETITION BY EXCLUDING
ALL THE LOTS EXCEPT THE TWO SHE OWNS, LOTS 24 AND 25.
The motion carried.
HEARING EXAMINER RECOMMENDATIONS, SUDDEN VALLEY DIV. 37 AND 38
Campbell,Kintz, Hearing Examiner, explained the background on
his recommendations regarding the findings and conclusions of the
application of Mt. Baker Bank to create a residential subdivision
known as "Sudden Valley Division 37 and 38, Areas R & P".
Ray Weden, Weden & Associates, stated that the applicant had
read and accepted the Hearing Examiners recommendations.
JOHNSON MOVED TO RECOMMEND APPROVAL OF THE HEARING EXAMINER'S
RECOMMENDATIONS REGARDING THE FINDINGS AND CONCLUSIONS OF THE APPLI-
CATION OF MT. BAKER BANK TO CREATE A RESIDE14TIAL SUBDIVISION KNOWN
AS "SUDDEN VALLEY DIVISION 37 AND 38, AREAS R & P ".
The motion carried.
OPEN SPACE APPLICATION .FILED BY BILL ROBINS
Following discussion on the open space application, ROEHL
MOVED TO RECOMMEND APPROVAL OF THE OPEN SPACE APPLICATION FILED BY
BILL ROBINS, SUBJECT TO A REVIEW OF CONDITIONS PLACED ON SIMILAR
OPEN SPACE APPLICATIONS IN TIIE PAST; IF IN FACT CONDITIONS WERE
PLACED ON THOSE, THEN THIS ONE SHOULD BE CONSIDERED IN LIGHT OF THOSE.
Johnson spoke in support of the motion.
Muenscher spoke in support of the motion.

RESOLUTION - REQUEST PLANNING COMMISSION TO REVIEW WHATCOM COUNTY
COMPREHENSIVE PLAN TO CONFORM WITH RES. 85 -17
ROEHL MOVED TO RECOMMEND DENIAL OF THE RESOLUTION TO REQUEST
THE PLANNING COMMISSION TO REVIEW THE WHATCOM COUNTY COMPREHENSIVE
PLAN IN ORDER TO BRING IT "INTO CONFORMITY WITH RESOLUTION 85 -17.
Roehl spoke to the motion.
Bill Trimm, Planning Director, spoke in support of the motion.
The motion carried.
PETITION FOR VACATION OF A PORTION OF L,OWE AVENUE FILED BY D. GRIFFIN
Roehl explained the background on the petition for vacation
of a portion of Lowe Avenue filed by Donald Griffin.
The Committee requested that Council staff contact Mr. Griffin
and Mr. Rosellini to determine which Council meeting would be
convenient for them to attend and schedule this item for that meeting's
agenda. The Parks Department and Planning- Department will also be
notified of the meeting.
REQUEST FOR APPROVAL FOR AN AMENDMENT TO THE POINT ROBERTS WATER
DISTRICT #4 COMPREHENSIVE PLAN
Following discussion, JOHNSON MOVED TO REQUEST THAT A RESOLU-
TION BE DRAFTED BY THE DEPUTY PROSECUTING ATTORNEY TO APPROVE THE
AMENDMENT TO THE POINT ROBERTS WATER DISTRICT #4 COMPREHENSIVE
PLAN AS REQUESTED IN THEIR RESOLUTION #427.
The motion carried.
OTHER BUSINESS
Campbell Kintz, Hearing Examiner, explained that there is no
requirement in the zoning ordinance that notices be .published,
although it had been done historically. After further discussion,
Roehl stated that this item would be added to the Council agenda
for discussion purposes, but that it appeared to be up to Campbell's
discretion as to whether or not to publish notices regarding
conditional uses, variances, or anything that comes exclusively
under the zoning ordinance.
Mr. Kintz also discussed the fees imposed on applications
with regard to the notification of property owners and the discre-
pancy in costs between applications requiring large mailings and
those requiring a small number of mailings. Currently all applica-
tions are being charged the same fee, and Mr. Kintz spoke in support
of an amendment to the zoning ordinance which would change the
fee from just a straight fee to a fee plus notifications costs.

Roehl spoke in support of having an ordinance drafted that
would incorporate Mr. Kintz' suggestions regarding fees and that
the Council hold its own public hearing, instead of the Planning
Commission holding one.
Mr. Lintz also stated that Councilmember Becker had suggested
that the Planning and Development Committee meet with him to discuss
an interim policy for the General Protection zone.
Roehl spoke in support of discussing an interim policy for the
General Protection zone at a future Planning and Development
Committee meeting.
ROEHL MOVED TO REQUEST THE HEARING EXAMINER DEVELOP AN ORDINANCE
AMENDING THE ZONING ORDINANCE WHICH WOULD CHANGE THE FEE CHARGES
FROM JUST A STRAIGHT FEE TO A FEE PLUS NOTIFICATION COSTS.
The motion carried.
