Minutes -- May 28, 1985
The Whatcom County Council Planning and Development Committee
was called to order at 3:00 p.m. by Chairman Muensche r, with
Committee member Roehl in attendance. Johnson was absent.
Also in attendance were Donovan Kehrer, Building and Codes Admin-
istration; Bill Trimm, Planning Department; Vernon Umetsu, Planning
Department; Campbell Kintz, Hearing Examiner; and Ray Weden,
Weden and Associates.
PETITION TO VACATE LOT LINE. FILED BY KJELL -JON RYE
ROEHL MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF
THE PETITION TO VACATE THE LOT LINE BETWEEN LOTS 13 AND 14, DIVISION,
#4 IN THE PLAT OF LUMMI ISLAND SCENIC ESTATES, FILED BY KJELL -JON
RYE.
The motion carried.
PETITION TO VACATE LOT LINE. FILED BY L. DEMARC0
ROEHL MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF
THE PETITION TO VACATE THE LOT LINE BETWEEN LOTS 28 AND 29, DIVISION
#3 IN THE PLAT OF SUDDEN VALLEY, FILED BY L. DEMARCO.
The motion carried.
RESOLUTION REQUESTING PLANNING COMMISSION TO REVIEW COMP. PLAN
TO BRING IT INTO CONFORMITY WITH RES. 85 -17
Following discussion between Committee members, ROEHL MOVED
TO AFFIRM THE PLANNING AND DEVELOPMENT COMMITTEE'S PREVIOUS
RECOMMENDATION OF DENIAL OF TIIE RESOLUTION REQUESTING THE PLANNING
COMMISSION TO REVIEW THE WIiATCOM COUNTY COMPREHENSIVE PLAN IN ORDER
TO BRING IT INTO CONFORMITY WITH RESOLUTION NO. 85 -17.
The motion carried.
ORDINANCE AMENDING INTERIM ZONING ORDINANCE, FEES CHARGED FOR
NOTICES
Campbell Kintz, Hearing Examiner, explained the background
on the ordinance. Donovan Kehrer, Building and Codes Administration,
spoke in support of including a threshold level for fees charged.
ROEHL MOVED TO RECOMMEND "DO PASS" ON THE ORDINANCE AMENDING
THE INTERIM ZONING ORDINANCE, AS WELL AS TIIE OFFICIAL ZONING ORDIN-
ANCE, WITH REGARDS TO FEES CHARGED FOR VARIANCE, CONDITIONAL USE
OR SIMULTANEOUS VARIANCE AND CONDITIONAL USE APPLICATION WITH
REGARDS TO FEES CHARGED FOR APPLICATION OF NOTICES, AND THAT THE

HEARING EXAMINER DRAFT AN AMENDMENT THAT WOULD INCLUDE A THRESHOLD
LEVEL FOR THE FEES CHARGED AND FORWARD THAT DRAFT TO THE COUNCIL
OFFICE FOR INTRODUCTION AT THE JUNE 6 COUNCIL MEETING.
The motion carried.
ORDINANCE ADOPTING NEW TITLE 21
Bill Trimm explained the background on the Ordinance adopting
a new Title 21 which will revise the Subdivision regulations to
provide for binding site plans, consistent with State law and County
plans and zoning standards; and to modify various sections reflective
of current subdivision administration and practices.
Following discussion between Committee members and Mr. Weden,
Mr. Kehrer and Mr. Trimm, Roehl stated that he would send a memo
to Council members and ask them to review the language of the
proposed new Title 21 prior to the June 6th Council meeting so
that the Council could act on the ordinance at that meeting if it
chooses to do so. Mr. Trimm, Mr. Kehrer and Mr. Weden will be
in attendance at the June 6th Council meeting in order to answer
any quest,ions.
ROEHL MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE ADOPTING
A NEW TITLE 21 WHICH WILL REVISE THE SUBDIVISION REGULATIONS TO PROVIDE
FOR BINDING SITE PLANS, CONSISTENT WITH STATE LAW AND COUNTY PLANS
AND ZONING STANDARDS; AND TO MODIFY VARIOUS SECTIONS REFLECTIVE
OF CURRENT SUBDIVISION ADMINISTRATION AND PRACTICES.
The motion carried.
ORDINANCE AMENDING SECTION 2.24.770 OF INTERIM ZONING ORDINANCE
AND ORDINANCE AMENDING SECTION 20.92 OF THE W.C. ZONING ORDINANCE
Bill Trimm explained the background on the following two ordin-
ances:
1. Ordinance in the matter of amending Section 2.24.770 of
the Whatcom County Interim Zoning Ordinance providing for
the Hearing Examiner to make final decisions on prelim-
inary plats
2. Ordinance in the matter of amending Section 20.92 of the
Official Whatcom County Zoning Ordinance providing for
the Hearing Examiner to make final decisions on preliminary
plats.
ROEHL MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF THE
TWO ORDINANCES REFERENCED ABOVE.

ORDINANCES RELATED TO THE GUIDE MERIDIAN IMPROVEMENT PLAN
Bill Trimm explained the background on the following ordin-
ances related to the Guide Meridian Improvement Plan:
1. Ordinance creating new title to Whatcom County Code
entitled guide Meridian Improvement Plan Controls
entitled Whatcom County Code 22.
2. Ordinance amending Whatcom County Code 12.08, the
Development Standards for Whatcom County
3. Ordinance amending Whatcom County Code Section 20.62
to amend the Genera]. Commercial district to take
into consideration the Guide Meridian Improvement Plan
4. Ordinance amending Whatcom County Code Chapter 20.66
regarding property within the Guide Meridian Improve-
ment Plan.
5. Ordinance amending Whatcom County Code Chapter 20.80
regarding property located in the Guide Meridian
Improvement Plan
6. Ordinance amending the Urban fringe Subarea as estab-
lished in Ordinance No. 84 -37.
Following discussion on the above ordinances, ROEHL MOVED
TO RECOMMEND APPROVAL OF THE ORDINANCES LISTED ABOVE, SUBJECT
TO THE OUTCOME OF THE PUBLIC HEARING.

EXECUTIVE ITEM
DISCUSSION OF PROPOSED TEMPORARY HOUSING AND RV PARK
REGULATIONS FOR EXPO '86.
Executive Van Zanten explained the potential need for
bed and breakfast places due to Expo '86. Copies of a proposed
ordinance temporarily allowing bed and breakfast sites in
Whatcom County in certain zones were distributed to Committee
members
Following discussion, ROEHL MOVED TO REQUEST THE ADMIN-
ISTRATION TO SET UP TH, PROPER PROCEDURAL COURSE FOR THE
ORDINANCE.
The motion carried.
