Minutes -- Tuesday, March 12, 1985
The Whatcom County Council Planning and Development
Committee was called to order on Tuesday, March 12, 1985, by
Chairperson Muenscher with all members present. Also in
attendance were Bill Trimm, Planning; Director; John Holan,
Planning Department, Campbell H.D. Kintz, Hearing Examiner;
Donovan Kehrer, Buildings and Code Administration; Andy
Fernando, Bellingham Herald, and other concerned citizens
as noted on the attached attendance list.
ORDINANCE - AMENDING RECREATION POLICIES. "SANDY POINT HEIGHTS"
Bill Trimm, Planning Director, provided background
information on the proposed ordinance and distributed a memo
dated 3/12/85 proposing revisions to help clarify the admin-
istration of the "Seasonal Recreation Residential" (SRR) district.
(See attached memo.) Jon Holan explained the proposed amendments
further.
Chairman Muenscher opened the meeting up for public
comment on this proposed ordinance.

ROEHL MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE
AMENDING THE RECREATIONAL POLICIES OF THE WHATCOM COUNTY
1970 COMPREHENSIVE LAND USE PLAN TO THE INTERIM ZONING ORDIN-
ANCE TEXT CREATING THE SEASONAL RECREATION RESIDENTIAL DISTRICT
(SRR); AND TO THE 1970 COMPREHENSIVE PLAN AND INTERIM ZONING
MAPS CHANGING THE PLAN DESIGNATION FROM "SUBURBAN" TO "RECREA-
TIONAL" AND THE ZONE DISTRICT FROM "SUBURBAN RESIDENTIAL
DISTRICT" (S 9.6) TO THE "SRR" DISTRICT FOR AN AREA COMMONLY
KNOWN AS "SANDY POINT HEIGHTS ", WITH THE PROPOSED AMENDMENTS
AS OUTLINED IN BILL TRIMM'S MEMO DATED MARCH 12, 1985.
The motion carried.
CORRESPONDENCE FROM BILL TRIMM REGARDING A ZONE CHANGE
Bill Trimm summarized the action taken by the Planning
Commission regarding the Trillium Corporation's amendment
request ZT 7 -84. The request involved an amendment to the
Agricultural text of the Interim Zoning Ordinance to allow
restaurants as conditional uses when directly related to the
processing of agricultural products.
John Vanderhage, Planning Commission, spoke against
the proposed amendment.
Following further discussion, JOHNSON MOVED TO REFER
TRILLIUM CORPORATION'S REQUEST BACK TO THE PLANNING COMMISSION.
Roehl spoke against the motion.
Johnson withdrew his motion.
ROEHL MOVED TO RECOMMEND TO COUNCIL THAT THEY HOLD THEIR
OWN PUBLIC HEARING ACCORDING TO STATE STATUTE IN THE MATTER
OF THE TRILLIUM CORPORATION'S AMENDMENT REQUEST ZT 7 -84.
The motion carried.
CORRESPONDENCE FROM FARUK TAYSI, TRILLIUM CORPORATION
Mr. Taysi stated that he had no comments at this time
but would be in attendance when the Council considers the
Trillium Corporation's request at a public hearing.
HEARING EXAMINER RECOP.QMENDATIONS - "ORCHARD PLACE" PRELIMINARY
PLAT APPLICATION FILED BY MAE STANDEL
Campbell Kintz, Hearing Examiner, reported on the background
of the application of Mae Standel for preliminary plat approval
to create and develop a residential subdivision known as "Orchard
Place ".

Johnson asked about the 60 -foot right -of -way requirement
being reduced to 30 feet west of Gerard Drive. Campbell Kintz
stated that condition #8 of the Hearing Examiner recommendations
covered this question.
ROEHL MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF
THE HEARING EXAMINER RECOMMENDATIONS REGARDING THE APPLICATION
OF MAE STANDEL FOR PRELIMINARY PLAT APPROVAL TO CREATE AND
DEVELOP A RESIDENTIAL SUBDIVISION KNOWN AS "ORCHARD PLACE ".
The motion carried.
ORDINANCE - WHATCOM COUNTY CODE 20.36.157(1), CONDITIONALLY
PERMITTED USES IN RURAL DISTRICT
Bill Trimm provided background information on the proposed
ordinance.
ROEHL MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE AMENDING
WHATCOM COUNTY CODE 20.36.157(1) DEALING WITH CONDITIONALLY
PERMITTED USES IN THE RURAL DISTRICT AS WELL AS ADDING A NEW
SECTION TO 20.36.
The motion carried.
ORDINANCE - AMENDING BOUNDARIES OF NEIGHBORHOOD COMMERCIAL
DISTRICT ON TRACT "S" IN SUDDEN VALLEY
Bill Trimm provided background information on the proposed
ordinance.
JOHNSON MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE AMENDING
THE BOUNDARIES OF THE NEIGHBORHOOD COMMERCIAL DISTRICT ON TRACT
"S" IN SUDDEN VALLEY.
The motion carried.
DISCUSSION REGARDING A PROBLEM WITH PROPERTY IN THE LAKE WHATCOM
AREA (RITA FOLEY)
Rita Foley introduced her son Michael and explained the
problem they were having with property he owns in the Lake
Whatcom area.
Mike Meyers, Ticor Title Insurance Company, explained
the problem further.
Will Roehl explained that this issue would not be able
to be resolved in Committee today, and that it may be the
type of problem that would have to be decided in court in
order to clarify the title to the property.

Chairman Muenscher stated that after having talked to
Council's attorney it appears that there may be more people
involved with similar circumstances, and the picture is
perhaps bigger than what Mrs. Foley presented to the Committee.
OTHER BUSINESS
DISCUSSION WITH MEMBERS OF THE WHATCOM COUNTY MOBILE
H031E PARK OWNERS ASSOCIATION
Rob Brown addressed the Committee about two problems
with the Mobile Home Ordinance which add unnecessary costs
to mobile home owners in the Whatcom County area: heighth
requirements for the skirting of mobile homes and tie -down
requirements.
Delesta Albee Spoke in support of changing
3246 Laurelwood Ave. the requirements in the
Mobile Home Ordinance with
regard to skirting heighth
and tie - downs.
Donovan Kehrer stated that on new mobile homes, the
installation requirements are approved by the Housing and
Urban Development department of the U.S. government (HUD).
He stated that the County's ordinance is consistent with the
HUD installation requirements for mobile homes.
Mr. Kehrer stated that there are three ways to comply
with the County's ordinance:
1. Install by the manufacturer's installation
instructions
2. Have an architect or engineer provide installation
requirements
3. Use the installation requirements of the ordinance.
He further stated that he would like to look into the
heighth requirements on the skirting issue.
There was further discussion on the HUD requirements on
tie -downs and installation instructions.
ROEHL MOVED TO REQUEST THAT MR. I:EHRER TO ANALYZE AND
INVESTIGATE THESE TWO REQUESTS REGARDING THE REQUIREMENTS FOR
SKIRTING LENGTHS OF MOBILE HOMES AND THE TIE -DOWN REQUIREMENTS
TO SEE HOW MUCH LATITUDE THE COUNTY HAS ON THESE TWO ISSUES,
AND TO REPORT BACK TO THE COMMITTEE.
