Development Committee was called to order at 3:15 p.m. by Chairman Aluenscher, with all members present. Also in attendance was Randy Watts, Deputy Prosecuting Attorney; Vernon Umetsu, Planning Department; Bob Tull, attorney; Phil Rosellini, attorney; Donald Griffin; Earl Milne; Doug Smith; Margaret Brandsrud and Maralee Smith. PETITION FOR VACATION OF A PORTION OF LOWE AVENUE, FILED BY DONALD GRIFFIN Phil Rosellini provided background information on the petition for vacation of a portion of Lowe Avenue and historical information on the development of the area. Ile spoke in support of the road vacation. Vern Umetsu, Planning Department, explained the Planning; staff's recommendation of "denial" of the petition and the reasons for the recommendation. Donald Griffin explained his reasons for requesting the road vacation. Roehl spoke in support of the road vacation. Following further discussion, ROEHL MOVED TO RECOMMEND TO THE FULL COUNCIL "APPROVAL" OF TILE PETITION FOR THE VACATION OF A PORTION OF LOWE AVENUE FILED BY DONALD GRIFFIN, SUBJECT TO THE RESERVATION OF THE UTILITIES EASEMENT AND THE DETERMINATION OF THE FAIR MARKET VALUE. Roehl spoke to the motion. The motion carried. This item will be scheduled for the .first Council meeting in May. REVIEW OF PLANNING COMMISSION RECOIDIENDATIONS AND FINDINGS REGARDING 1985 OPEN SPACE TAXATION APPLICATIONS Roehl stated that he would not participate in the discussions regarding the Baumgart, Tilley and Brandsrud applications, as he had been involved in preparation of the applications. Planning and Development Committee Minutes April 9, 1985 Page 2 Randy Watts, Deputy Prosecuting Attorney, briefed the Committee on the procedures to be followed when reviewing the - Open Space applications at the Committee level. He stated that the Committee members could ask specific questions regarding the applications, however, additional testimony could not be received. Chairman Muenscher asked that Randy prepare a written document outlining the procedures for future reference. The Committee reviewed each of the timberland applications. JOHNSON MOVED TO RECOMMEND APPROVAL TO THE COUNCIL OF THE OPEN SPACE /TIMBERLAND APPLICATIONS: SMALLWOOD, BAUMGART AND SMITH; AND RECOMMEND DENIAL TO THE COUNCIL OF THE BRANDSRUD TIMBER APPLICATION, AND TIIAT THE PLANNING COLRI I S S I ON CONTINUE TO WORK ON THE JOHNSON TIP,'IBERLAND APPLICATION. The motion carried. The Committee reviewed each of the open space /open space applications individually. JOHNSON MOVED TO RECOMMEND APPROVAL TO THE COUNCIL OF THE OPEN SPACE /OPEN SPACE APPLICATIONS AS FOLLOWS: POINT ROBERTS ESTATES LTD., AND MEIKLE. The motion carried. The Committee discussed the open space /open space applica- tions which had been forwarded with a recommendation of "denial" from the Planning Commission. JOHNSON MOVED TO RECOMMEND TO THE COUNCIL THAT THEY CONCUR WITH THE PLANNING COMMISSION RECOMMENDATION OF DENIAL FOR THE ILLMAN, TILLEY AND MILNE APPLICATIONS AND TIIAT THE PLANNING STAFF INFORM THE THREE APPLICANTS OF THEIR RIGHTS TO APPEAL. Mr. Milne was present at the meeting and requested an appeal of his application. Chairman Muenscher requested that the Planning staff inform the applicants whose applications are being forwarded with a recommendation of "denial" of their rights to appeal the decision of the Planning Commission. A written letter of appeal should be forwarded to the County Council if any of the applicants are interested in appealing. The motion carried. Planning and Development Committee Minutes April 9, 1985 Page 3 REVIEW OF GUIDE MERIDIAN IMPROVEMENT PLAN Roehl spoke on the procedure that should be followed regarding the Guide Meridian Improvement Plan. Ile spoke in support of the Council holding its own public hearing on this matter. JOHNSON MOVED THAT THE GUIDE MERIDIAN IMPROVEMENT PLAN BE FORWARDED TO THE COUNCIL WITII THE RECOMMENDATION THAT THEY HOLD THEIR OWN PUBLIC HEARING, AND THAT IT ALSO BE REFERRED TO THE PLANNING COMMISSION, WITH A NOTATION THAT THE COUNCIL WOULD LIKE TO HOLD THEIR OWN PUBLIC HEARING. The motion carried. ORDINANCE AMENDING THE LUMMI ISLAND COMPREHENSIVE PLAN Roehl explained the background of the ordinance. ROEHL MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE AMENDING THE LUMMI ISLAND COMPREHENSIVE PLAN, SUBJECT TO THE OUTCOME OF THE PUBLIC HEARING, AND THAT RANDY WATTS BE REQUESTED TO LOOK INTO WHETHER OR NOT THERE ARE ANY LEGAL PROBLEMS WITH SINGLING OUT AN AREA OF THE COUNTY WHERE THERE WILL BE NO SPRAYING.
