Tuesday, August 20, 1985
The Whatcom County Council Finance Committee was called to order
at 2 :10 p.m. by Chairperson Becker with all members present except
Hansey, who arrived at 2:50 p.m.
ORDINANCE REPEALING SECTION 5.36 OF THE WHATCOM COUNTY CODE
Sheriff Mount explained the background on the ordinance repealing
Section 5.36 of the Whatcom County Code and requested that certain
portions of the ordinance be amended.
There was discussion on the Sheriff's proposed amendments.
COLE MOVED TO RECOMMEND APPROVAL OF THE ORDINANCE REPEALING
SECTION 5.36 OF THE WHATCOM COUNTY CODE.
COLE MOVED TO AMEND THE ORDINANCE AS FOLLOWS:
-- CHANGE THE TITLE TO READ "AN ORDINANCE AMENDING CHAPTER 5.36 OF
THE WHATCOM COUNTY CODE;
-- DELETE THE THIRD "WHEREAS" PARAGRAPH, AND CHANGE THE PUNCTUA-
TION ON LINE 16 ACCORDINGLY;
-- REWORD LINES 20 AND 21 TO READ: "NOW, THEREFORE, BE IT
ORDAINED THAT CHAPTER 5.36 OF THE WHATCOM COUNTY IS AMENDED AS
FOLLOWS"
,STRIKE LINES 22, 23, 24 AND 25.
The motion to amend carried.
The motion to recommend approval of a substitute draft ordinance,
as amended above, carried.
Sheriff Mount spoke in support of the County instituting business
licenses for businesses operating in the unincorporated areas of
Whatcom County.
COLE MOVED TO REQUEST THE SHERIFF TO DRAFT AN ORDINANCE REQUIRING
THE LICENSING OF BUSINESSES IN THE UNINCORPORATED AREAS OF WHATCOM
COUNTY, AND THAT SUCH ORDINANCE SHOULD ESPECIALLY ADDRESS FRAUDULENT.,
DISHONEST AND ILLEGAL PRACTICES.
Tom Sutberry, Budget Director, spoke in support of Sheriff
Mount's idea of instituting business licenses.

ORDINANCE AMENDING ORD. 79 -42, NEW PROCEDURES FOR PROCESSING CLAIMS
This ordinance will be held in committee.
ORDINANCE ADOPTING A REVISED 1985 BUDGETS SEWER CONSTRUCTION FUND,
WASTEWATER TREATMENT PLANT ENGINEERING
Executive Van Zanten explained the background on the ordinance
adopting a revised 1985 budget for the Sewer Construction Fund for the
purpose of providing for wastewater treatment plant engineering. Sara
Johnston, Public Works Accounting, explained further.
COLE MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF THE
ORDINANCE ADOPTING A REVISED 1985 BUDGET FOR THE SEWER CONSTRUCTION
FUND FOR THE PURPOSE OF PROVIDING FOR WASTEWATER TREATMENT PLANT
ENGINEERING.
The motion carried.
REQUEST FOR OVERLIMIT TRANSFER, $9,000, NOR -BELL NURSING HOME FUND
Executive Van Zanten explained the background on the request for
overlimit transfer in the amount of $9,000.00 in the Nor -Bell Nursing
Home Fund.
There was discussion on the overlimit transfer.
COLE MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF THE
OVERLIMIT TRANSFER IN THE AMOUNT OF $9,000.00 IN THE NOR -BELL NURSING
HOME FUND.
The motion carried.
AUTHORIZATION TO AWARD BID FOR BRITTON ROAD IMPROVEMENT CONTRACT
Jim Kresge, Engineering Department, explained the background on
the request for authorization to award the bid for the Britton Road
Improvement contract. Executive Van Zanten distributed the documenta-
tion on the bid award.
COLE MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF THE
INITIATING RESOLUTION AND THE BID FOR BRITTON ROAD IMPROVEMENT
CONTRACT.

AUTHORIZATION FOR BID AWARD FOR FLAIL BRUSH MOWER, TO BRIM TRACTOR
CO., INC., FOR $14.423.00, INCLUDING TAX
Executive Van Zanten explained the background on the request for
authorization to award the bid for a Bomford B588 flail brush mower to
the lowest responsive bidder, Brim Tractor Co., Inc., for $14,423.00,
including tax.
COLE MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF THE BID
AWARD FOR A BOMFORD B588 FLAIL BRUSH MOWER TO THE LOWEST RESPONSIVE
BIDDER, BRIM TRACTOR CO., INC., FOR $14,423.00, INCLUDING TAX.
The motion carried.
Executive Van Zanten explained the background on the resolution
amending the agreement with the City of Ferndale for construction,
ownership, operation and maintenance of the sewage treatment and
disposal facilities in the Nor -Bell area.
Paul Rushing, Director of Public Works, explained further.
There was discussion on the resolution.
COLE MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF THE
RESOLUTION AMENDING THE AGREEMENT WITH THE CITY OF FERNDALE FOR
CONSTRUCTION, OWNERSHIP, OPERATION AND MAINTENANCE OF THE SEWAGE
TREATMENT AND DISPOSAL FACILITIES IN THE NOR -BELL AREA.
The motion carried.
RESOLUTIONSS - SETTING PUBLIC HEARING DATES, SURPLUS PROPERTY
COLE MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF THE
FOLLOWING RESOLUTIONS:
1) RESOLUTION IN THE MATTER OF SETTING A DATE FOR PUBLIC HEARING
FOR DECLARING CERTAIN COUNTY -OWNED EQUIPMENT SURPLUS PROPERTY PURSUANT
TO RCW CHAPTER 36.34
'12) RESOLUTION IN THE MATTER OF SETTING A DATE FOR PUBLIC HEARING
FOR DECLARING CERTAIN COUNTY -OWNED VEHICLES SURPLUS PROPERTY PURSUANT
TO RCW 36.34.020
3) RESOLUTION IN THE MATTER OF SETTING A DATE FOR PUBLIC HEARING
FOR DECLARING CERTAIN COUNTY -OWNED PROPERTY SURPLUS PROPERTY PURSUANT
TO RCW 36.34.020

Nat Dickinson explained the resolution setting a date for public
hearing for declaring certain County -owned equipment surplus property.
11 There was discussion on the procedure for declaring office
equipment surplus property.
The motion to recommend approval of the three resolutions setting
public hearing dates carried.
OTHER BUSINESS
Executive Van Zanten explained the background on a request for
approval of a grant for the Parks Department. Roger DeSpain, Parks
Director, explained the grant further.
COLE MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF THE GRANT
AND CONTRACT FOR THE PARKS DEPARTMENT.
The motion carried.
CORRESPONDENCE RECEIVED FROM HOMEBUILDERS ASSOCIATION
Executive Van Zanten explained the background on the correspon-
dence received from the Homebuilders Association.
Chairperson Becker stated that this would be scheduled for the
next Finance Committee for discussion.
OVERLIMIT TRANSFER REQUEST, TORT CLAIMS FUND
Executive Van Zanten explained a request from the Prosecuting
Attorney for an overlimit transfer in the amount of $10,000.00 in the
Tort Claims Fund.
HANSEY MOVED TO RECOMMEND APPROVAL TO THE FULL COUNCIL OF AN
OVERLIMIT TRANSFER IN THE AMOUNT OF $10,000.00 IN THE TORT.CLAIMS
FUND.
Cole spoke to the motion and requested that the paperwork on the
overlimit transfer be submitted to Council before its meeting on
Thursday night.
The motion carried.
There was discussion on the possibility of signs being used for
identifying land use projects and proposals.
