Minutes -- Thursday, October 3, 1985
The Whatcom County Council meeting was called to order by Chairman
Roehl with all members present except Becker, who arrived at 8:00 p.m.,
and Hansey.

Muenscher read a proclamation declaring the week of October
6 -12 to be 4 -H week in Whatcom County. 4 -H members representing
Whatcom County 4 -H clubs presented Councilmembers and the Executive
with 4 -H pins. Melanie Baller, 8th grader and recent state winner in
Public Speaking, spoke briefly on 4 -H.
The minutes of the Council meetings of September 5 and September
19, 1985 were approved as written.
EXECUTIVE ITEMS
REQUEST FOR APPROVAL OF BID AWARD, FOUR 3/4 -TON PICKUP
TRUCKS, BELLINGHAM CHRYSLER CENTER. $39.853.06
Executive Van Zanten explained the background on the request
for approval of the bid award for four 3/4 -ton pickup trucks to
the low bidder, Bellingham Chrysler Center, for four Dodge D21,62
trucks at $9,992.36 each, for a total bid of $39,853.06, includ-
ing sales tax.
Cole reported that the Finance Committee had reviewed the request
and recommended approval of the bid award to Bellingham Chrysler
Center.
COLE MOVED TO APPROVE THE BID AWARD FOR FOUR 3/4 -TON PICKUP
TRUCKS TO THE LOW BIDDER, BELLINGHAM CHRYSLER CENTER, FOR FOUR DODGE
D2L62 TRUCKS AT $9,992.36 EACH, FOR A TOTAL BID OF $39,853.06, INCLUD-
ING SALES TAX.
The motion carried.
REQUEST FOR OVERLIMIT TRANSFER, PARK OFF -ROAD VEHICLES FUND
Executive Van Zanten stated that this request for an overlimit
transfer in the Park Off -Road Vehicles Fund in the amount of $13,950.00
had been withdrawn at the Finance Committee.

REQUEST FOR OVERLIMIT TRANSFERS: COUNTY PARK FUND, $6,332.00
INVOLUNTARY TREATMENT ACT FUND, MENTAL HEALTH DEPARTMENT,
$8,205.00, AND DRUG ABUSE FUND, MENTAL HEALTH DEPARTMENT,
58,423.00
Executive Van Zanten explained the background on the following
requests for overlimit transfers:
1) In the County Park Fund, Park and Recreation Board, in the
amount of $6,332.00
2) In the Involuntary Treatment Act Fund, Mental Health Depart-
ment, in the amount of $8,205.00
3) In the Drug Abuse Fund, Mental Health Department, in the
amount of $8,423.00
Cole reported that the Finance Committee recommended approval of
all three requests for overlimit transfers.

REPORT OF THE EXECUTIVE
Executive Van Zanten reported that Gary Wood, Administrator of
Juvenile Court Probation, had recently been appointed by the Governor
to serve on the state Juvenile Justice Advisory Committee.
ORDINANCE AMENDING WHATCOM COUNTY CODE 2.68, PARKING FEES
The public hearing was declared open in the matter of the ordin-
ance amending Whatcom County Code 2.68, the ordinance establishing
policy and regulations governing the administration of County -owned
parking areas by establishing fees for public parking on County -owned
parking areas. There was no one present to speak, and the public
hearing was closed.
COLE MOVED TO ADOPT DRAFT 2 OF THE ORDINANCE AMENDING WHATCOM
COUNTY CODE 2.68, THE ORDINANCE ESTABLISHING POLICY AND REGULATIONS
GOVERNING THE ADMINISTRATION OF COUNTY -OWNED PARKING AREAS BY ESTAB-
LISHING FEES FOR PUBLIC PARKING ON COUNTY -OWNED PARKING AREAS.

Cole reported that a joint Finance /Public Services Committee had
reviewed the ordinance.
HAWLEY MOVED TO AMEND THE ORDINANCE WITH THE FOLLOWING:
Page 1, between lines 20 and 21, after the words "as follows:"
insert the following: "Further shall it be ordained that all
spaces will not be exempt from fees established by Section
2.68.060."
Hawley spoke to the motion.
Cole spoke in support of hearing all of Hawley's proposed amend-
ments at once in order to consider them as a whole, or postponing
consideration of the amendments until a later time.
There was discussion on passing the ordinance and referring the
amendments to committee for more work on the language.
JOHNSON MOVED TO REFER THE AMENDMENTS BACK TO THE PUBLIC SERVICES
COMMITTEE.
There was discussion on occupancy of the parking lot.
Johnson spoke in support of referring the amendments back to the
Public Services Committee.
Hawley spoke against the motion to refer just the amendments, and
spoke in support of referring the ordinance and the amendments back to
committee.
The motion to refer the amendments back to the Public Services
Committee carried.
MUENSCHER MOVED FOR FINAL ADOPTION OF DRAFT 2 OF THE ORDINANCE
AMENDING WHATCOM COUNTY CODE 2.68, THE ORDINANCE ESTABLISHING POLICY
AND REGULATIONS GOVERNING THE ADMINISTRATION OF COUNTY -OWNED PARKING
AREAS BY ESTABLISHING FEES FOR PUBLIC PARKING ON COUNTY -OWNED PARKING
AREAS.
There was discussion on the effective date to be inserted on page
1 of the ordinance. Chairman Roehl stated that the effective date
would be the 14th day of October, ten days after the adoption of the
ordinance.

HAWLEY MOVED TO AMEND THE ORDINANCE WITH THE FOLLOWING;
page 1, line 23.5 to read as follows "monthly.,L and hourly and
yearly..."
Exhibit A, add "Yearly"
Chairman Roehl spoke in support of dealing with the amendment in
committee.
There was discussion on the revenues that will be generated by the
fees collected from the new parking lot.
Hawley withdrew his amendments.
The motion to adopt the ordinance amending Whatcom County Code
2.68, the ordinance establishing policy and regulations governing the
administration of County -owned parking areas by establishing fees for
public parking on County -owned parking areas, carried.
PETITION FOR ROAD VACATION. PORTION OF COUNTY ROAD NO, 99,
FILED BY BILL LEISEN
The public hearing was declared open in the matter of the petition
for road vacation of a portion of County Road No. 99, Auditor's File
No. 172924, filed by Bill Leisen. There was no one present to speak,
and the public hearing was closed.
Muenscher reported that the Planning and Development Committee had
reviewed the petition for road vacation filed by Bill Leisen and
recommended approval, pursuant to the Engineer's report that no costs
other than the filing and processing fees be charged the petitioner.
MUENSCHER MOVED TO APPROVE THE PETITION FOR ROAD VACATION OF A
PORTION OF COUNTY ROAD NO. 99, AUDITOR'S FILE NO. 172924, FILED BY BILL
LEISEN, WITH THE CONDITION THAT NO COSTS OTHER THAN THE FILING AND
PROCESSING FEES BE CHARGED THE PETITIONER.
The motion carried.

ORDINANCE AMENDING AUDITOR'S BOND
Becker reported that the Finance Committee recommended approval of
the ordinance amending the Auditor's bond.
BECKER MOVED FOR FINAL ADOPTION OF THE ORDINANCE AMENDING THE
AUDITOR'S BOND, AND THAT THE EXECUTIVE BE REQUESTED TO REVIEW THE OTHER
BONDS AND REPORT BACK TO THE COUNCIL.
The motion carried.
ORDINANCE TO REVISE 1985 CURRENT EXPENSE FUND, JAIL BUDGET
Becker reported that the Finance Committee recommended approval of
the ordinance to revise the 1985 Current Expense Fund, Jail Budget
therein, in the amount of $15,000.00.
BECKER MOVED FOR FINAL ADOPTION OF THE ORDINANCE TO REVISE THE
1985 CURRENT EXPENSE FUND, JAIL BUDGET THEREIN, IN THE AMOUNT OF
$15,000.00.
The motion carried.
ORDINANCE ADOPTING A REVISED 1985 BUDGET FOR COMMUNITY ECONOMIC
REVITALIZATION BOARD (C.E.R.B.) FUND
Becker reported that the Finance Committee recommended approval of
the ordinance adopting a revised 1985 budget for the Community Economic
Revitalization Board (C.E.R.B.) fund.
BECKER MOVED FOR FINAL ADOPTION OF THE ORDINANCE ADOPTING A
REVISED 1985 BUDGET FOR THE COMMUNITY ECONOMIC REVITALIZATION BOARD
(C.E.R.B.) FUND.
The motion carried.
OTHER BUSINESS
OPEN SPACE APPLICATION FILED BY RAYMOND E. BARNHOLT
The open space application filed by Raymond E. Barnholt was
received and referred to the Planning Commission.

Chairman Roehl added the following items to the agenda under
"Other Business ":
2) Discussion on Delta Cablevision (Guinness Communications)
3) Discussion on an herbicide ordinance
4) Discussion and request to authorize the County Executive
to sign the agreement between the City of Bellingham,
Whatcom County, and the Trillium Corporation, regarding
Cordata utilities
DISCUSSION ON DELTA CABLE (GUINNESS COMMUNICATIONS)
Chairman Roehl explained the background on his request to bring
this up at tonight's meeting. He asked that the Public Services
Committee review the communications that have gone on between himself,
Randy Watts, and Delta Cablevision. Chairman Roehl has asked Randy
Watts to set up a meeting with Delta Cablevision in order to try and
iron out some of the differences that have arisen regarding their
recent rate increase.
COLE MOVED THAT THE MATTER OF THE RATES CHARGED BY DELTA CABLEVI-
SION BE REFERRED TO THE PUBLIC SERVICES COMMITTEE, AND THAT THE
PROSECUTING ATTORNEY'S OFFICE AND THE DEPARTMENTS OF COUNTY GOVERNMENT
BE REQUESTED TO ASSIST THE PUBLIC SERVICES COMMITTEE IN ITS INQUIRY.
The motion carried.
DISCUSSION ON THE HERBICIDE RESOLUTION AND A PROPOSAL -M
HAVE IT ADOPTED IN ORDINANCE FORM
Chairman Roehl explained that he had received calls requesting
that the herbicide resolution no. 85 -17 be adopted by the Council in
ordinance form.
There was discussion on the County's roadside vegetation manage-
ment and spraying program, as well as the citizens committee which was
formed to work on this issue.
Cole stated that he would have an ordinance to introduce later on
tonight.
DISCUSSION AND REQUEST FOR COUNTY EXECUTIVE TO SIGN THE AGREEMENT
BETWEEN CITY OF BELLINGHAM, WHATCOM COUNTY AND TRILLIUM
CORPQB&TION REGARDING CQRDATA UTILITIES
Chairman Roehl explained the background on the agreement which had
already been signed by the City of Bellingham regarding the provision

of utilities for the Cordata site. Cole left the room and abstained
from discussion or voting on this issue.
There was discussion on the new agreement.
JOHNSON MOVED TO AUTHORIZE THE EXECUTIVE TO SIGN THE AGREEMENT
BETWEEN THE CITY OF BELLINGHAM, WHATCOM COUNTY AND THE TRILLIUM
CORPORATION REGARDING UTILITIES FOR THE CORDATA SITE.
The motion carried.
RESOLUTION - REASSESSMENT OF PROPERTY, RID #1 (BIRCH BAY LIGHTING)
RESOLUTION - REASSESSMENT OF PROPERTY, RID #2 (MARINELAND LIGHT-
ING
COLE MOVED TO INTRODUCE AND ADOPT THE RESOLUTION FOR REASSESSMENT
OF PROPERTY WITHIN THE BOUNDARIES OF WHATCOM COUNTY ROAD IMPROVEMENT
DISTRICT #1 (BIRCH BAY LIGHTING DISTRICT) AND THE RESOLUTION FOR
REASSESSMENT OF PROPERTY WITHIN THE BOUNDARIES OF WHATCOM COUNTY ROAD
IMPROVEMENT DISTRICT #2 (MARINELAND LIGHTING DISTRICT), AND THAT THE
CHAIR BE REQUESTED TO INSERT THE PROPER PUBLIC HEARING DATE ON EACH OF
THE RESOLUTIONS.
Cole stated that the Public Services Committee had reviewed both
resolutions and recommended approval of both.
The motion to adopt the resolution for reassessment of property
within the boundaries of Whatcom County Road Improvement District #1
(Birch Bay Lighting District) carried.
The motion to adopt the resolution for reassessment of property
within the boundaries of Whatcom County Road Improvement District #2
(Marineland Lighting District) carried.
EMERGENCY ORDINANCE, MENTAL HEALTH FUND BUDGET
BECKER MOVED TO INTRODUCE AND ADOPT THE EMERGENCY ORDINANCE TO
REVISE THE 1985 MENTAL HEALTH FUND BUDGET.
Becker explained the background on the emergency ordinance.
The motion to adopt the emergency. ordinance to revise the 1985
Mental Health Fund budget carried.

The ordinance to revise the 1985 Mental Health Fund budget was
introduced by consent and referred to the Finance Committee.
ORDINANCE - TEENAGE PREGNANCY PREVENTION
BECKER MOVED TO INTRODUCE AN ORDINANCE ON TEENAGE PREGNANCY
PREVENTION AND MAKING AN APPROPRIATION FROM THE CURRENT EXPENSE FUND
FOR SUCH PURPOSE.
Becker explained the ordinance briefly and requested that the
ordinance be referred to the Finance Committee.
The ordinance was introduced and referred to Finance Committee.
ORDINANCE - ANNUAL INTEGRATED ROADSIDE VEGETATION MANAGEMENT
PROGRAM
COLE MOVED TO INTRODUCE AN ORDINANCE PROVIDING FOR AN ANNUAL
INTEGRATED ROADSIDE VEGETATION MANAGEMENT PROGRAM, WHICH MINIMIZES THE
USE OF HERBICIDES AND PROHIBITS THE USE OF HERBICIDES IN CERTAIN AREAS
OF THE COUNTY AND REFER THE ORDINANCE TO THE PUBLIC SERVICES COMMITTEE.
The ordinance was introduced and referred to the Public Services
Committee.
Chairman Roehl announced that the next Council meeting would be
held at the Lummi Island Grange Hall.
The meeting was adjourned at 9 :05 p.m.
