Minutes -- November 21, 1985
The Whatcom County Council was called to order at 7:55 p.m. by
Chairman Roehl, with all members present except Muenscher.
The minutes of the following meetings were approved as written:

CONSIDERATION OF AN AGREE14ENT BETWEEN WHATCOM COUNTY ANP
AND SHERIFF'S BUPRORT MEE
Tom Sutberry, Budget Director, explained the background on the
agreement by and between Whatcom County, Washington and General
Teamsters Local Union No. 231 "Corrections Officers and Sheriff's
Support Staff" bargaining unit.
Becker reported that the Finance Committee recommended approval
of the agreement.
BECKER MOVED TO APPROVE THE AGREEMENT BY AND BETWEEN WHATCOM
COUNTY, WASHINGTON AND GENERAL TEAMSTERS LOCAL UNION NO. 231 "CORREC-
TIONS OFFICERS AND SHERIFF'S SUPPORT STAFF" BARGAINING UNIT.
The motion carried.
BEQUEST FOR OVERLIMIT TRANSFER. EQUIPMENT RENTAL AND REVQLVING
FUND IN THE AMOUNT OF $135,820.00
Tom Sutberry explained the background on the request for an
overlimit transfer in the Equipment Rental and Revolving Fund in the
amount of $135,820.00.
Becker reported that the Finance Committee recommended approval
of the overlimit transfer.
There was discussion on the overlimit transfer.
JOHNSON MOVED TO DELETE LINE ITEM 50102 - 503 -02, FIXED ASSET
PURCHASES /FACILITIES IN THE AMOUNT OF $20,000.00 AND REDUCE LINE ITEM
50102- 503 -01, FIXED ASSET PURCHASES /EQUIPMENT, TO $115,820.00, FOR A
mOTAL OVERLIMIT TRANSFER AMOUNT OF $115,820.00.

The motion to amend the overlimit transfer as noted above
carried.

Tom Sutberry explained the background on the request for approval
of the bidders' lists for the supply of concrete culvert and for the
supply of aluminum and steel culvert pipe.
Becker reported that the Finance Committee recommended approval
of both bidders lists.
BECKER MOVED TO APPROVE THE BIDDERS' LISTS FOR THE SUPPLY OF
CONCRETE CULVERT AND FOR THE SUPPLY OF ALUMINUM AND STEEL CULVERT
PIPE.
There was discussion on the motion.
The motion carried.
Tom Sutberry presented the overlimit transfer of $5,500.00 from
the Tort Claims Fund, 13600.514.36.46.0300, Settlements /Major to the
Professional Services, Account number 13601.514.37.41.0100.
Becker reported that this overlimit transfer had been prepared at
the request of the Finance Committee, and the Committee recommended
approval of the overlimit transfer.
BECKER MOVED TO APPROVE THE OVERLIMIT TRANSFER IN THE AMOUNT OF
$5,500.00 FROM THE TORT CLAIMS FUND, 13600.514.36.46.0300, SETTLE-
MENTS /MAJOR TO THE PROFESSIONAL SERVICES LINE ITEM, ACCOUNT NUMBER
13601.514.37.41.0100.
Tom Sutberry explained the transfer further.
The motion carried.
The public hearing was declared open in the matter of the
'ietition for lot line vacation between lots 62 and 63, Plat of
leaceful Valley, filed by Mr. and Mrs. John Peipman. There was no one
present to speak, and the public hearing was closed.

Chairman Roehl reported that the Planning and Development
Committee recommended approval of the petition.
COLE MOVED TO APPROVE THE PETITION FOR LOT LINE VACATION BETWEEN
LOTS 62 AND 63, PLAT OF PEACEFUL VALLEY, FILED BY MR. AND MRS. JOHN
PEIPMAN.
The motion to approve the lot line vacation filed by Mr. and
Mrs. John Peipman carried.
The public hearing was declared open in the matter of the
reassessment of property within the boundaries of Whatcom County Road
Improvement District No. 1 (Birch Bay Lighting District). There was
no one present to speak, and the public hearing was closed.
REASSESSMENT OF PROPERTY, ROAD IMPROVEMENT DISTRICT #2
(MARINELAND LIGHTING DISTRICT)
The public hearing was declared open in the matter of the
_eassessment of property within the boundaries of Whatcom County Road
Improvement District No. 2 (Marineland Lighting District). There was
no one present to speak, and the public hearing was closed.
Jeff Monsen, Engineering Department, distributed copies of a memo
dated November 21, 1985, summarizing objections and responses that
had been received to date from property owners within the two lighting
districts (see attached).
There was discussion on the memo and the objections received.
Cole reported that the Public Services Committee recommended
approval of both resolutions confirming the assessment rolls for
R.I.D. # 1 and # 2, with the correction as noted on page 1, #3 of Jeff
Monsen's November 21st memo.
COLE MOVED TO INTRODUCE AND ADOPT THE FOLLOWING RESOLUTIONS:
RESOLUTION CONFIRMING THE ASSESSMENT ROLL OF PROPERTY WITHIN THE
BOUNDARIES OF WHATCOM COUNTY ROAD IMPROVEMENT DISTRICT NO. 1 (BIRCH
BAY LIGHTING DISTRICT) AND REMANDING ROLL TO THE COUNTY TREASURER FOR
COLLECTION
AND
RESOLUTION CONFIRMING THE ASSESSMENT ROLL OF PROPERTY WITHIN THE
BOUNDARIES OF WHATCOM COUNTY ROAD IMPROVEMENT DISTRICT NO. 2 (MARINE-
LAND LIGHTING DISTRICT) AND REMANDING ROLL TO THE COUNTY TREASURER FOR
COLLECTION.

Cole spoke to the motion.
There was discussion on the resolutions.
Cole spoke in support of the motion.
The motion to introduce and adopt the resolutions confirming the
assessment rolls for RID #1 and RID #2 carried.
The public hearing was declared open in the matter of the County
Executive's proposal to declare certain County -owned property surplus
(a 1969 Chevrolet 29- passenger bus owned by the Whatcom County Parks
Department). There was no one present to speak, and the public
hearing was closed.
Becker reported that the Finance Committee recommended approval
of the Executive's proposal to declare the bus surplus.
BECKER MOVED TO DECLARE THE 1969 CHEVROLET 29- PASSENGER BUS OWNED
BY THE WHATCOM COUNTY PARKS DEPARTMENT SURPLUS, SUBJECT TO THE CLERK
VERIFYING A MINIMUM BID FOR THE BUS OF $500.00, AS SET OUT IN THE
RESOLUTION SETTING THE PUBLIC HEARING DATE.
The motion carried.
Wally Markwood Explained a situation with certain
5206 Guide Meridian property he owns on the Guide
Meridian; requested information as
to how he could obtain a zoning
change so he could sell some of
his property.
There was discussion between Councilmembers and Bill Trimm,
Planning Director, on Mr. Markwood's request.
JOHNSON MOVED TO REFER THIS MATTER TO THE PLANNING AND DEVELOP-
MENT COMMITTEE FOR FURTHER REVIEW.
The motion to refer this matter to committee carried.
Peter Rasmussen Provided information on public
opinion regarding funding for
an Environmental Impact State-
ment for a proposed ORV park
on Sumas Mountain.

FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES
Vice Chairman Hansey chaired the meeting at this point while
Chairman Roehl was out of the room.
Becker reported that the Finance Committee recommended approval
of the resolution in the matter of transfers affecting the 1985
budget.
BECKER MOVED FOR FINAL ADOPTION OF THE RESOLUTION IN THE MATTER
OF TRANSFERS AFFECTING THE 1985 BUDGET.
Becker spoke to the motion.
The motion to adopt the resolution carried.
Chairman Roehl returned to the room and chaired the meeting again
at this point.
ORDINANCE TEMPORARILY CREATING NEW SECTIONS TO BOTH THE WHATCQ,j�I
COUNTY INTERIM ZONING ORDINANCE, TITLE 2.24, AND THE OFFICIAL
WHATCOM COUNTY ZONING ORDINANCE, TITLE 20, TO ALLOW TEMPORARY
RECREATIONAL VEHICLE PARKS AND CAMPGROUNDS FROM APRIL 1. 1986
UGH NOVEMBER 30,1986
Chairman Roehl reported that the Planning and Development
Committee had reviewed the ordinance and recommended approval of the
ordinance, with the changes recommended in the Planning Department's
memo from Carl Batchelor dated November 7, 1985.
JOHNSON MOVED TO AMEND THE ORDINANCE WITH THE CHANGES AS OUTLINED
IN THE PLANNING DEPARTMENT'S MEMO FROM CARL BATCHELOR DATED NOVEMBER 7
1985.
The motion to amend the ordinance carried (Hansey abstained).
There was further discussion on the ordinance.
The ordinance was adopted unanimously (Hansey abstained).

3. Ordinance to revise the 1985 Current Expense Fund, Boundary
Review Board Budget therein
4. Ordinance to revise the 1985 Current Expense Fund, County
Executive's budget therein
5. Ordinance to revise the 1985 Current Expense Fund, various
departments' personal services budgets
6. Ordinance to revise the 1985 Current Expense Fund, County
Council budget therein
7. Ordinance to revise the 1985 Current Expense Fund, Jail's
budget therein
8. Ordinance to revise the 1985 Current Expense Fund, LEOFF
Board budget therein
9. Ordinance to revise the 1985 Whatcom County Current Expense
Fund, Public Defender's budget therein
10. Ordinance amending the Building Maintenance Fund 1985

Becker reported that the Finance Committee had reviewed and
recommended approval of all of the above ordinances.
Becker spoke in support of handling them en masse.
COLE MOVED TO ACCEPT SUBSTITUTE ORDINANCES FOR THE FOLLOWING
ORDINANCES LISTED ABOVE:
5. Ordinance to revise the 1985 Current Expense Fund, various
departments' personal services budgets
9. Ordinance to revise the 1985 Whatcom County Current Expense
Fund, Public Defender's budget therein
11. Ordinance to revise the 1985 Mental Health Fund budget
Hawley stated that he wanted to go on record at this meeting to
et everyone know that he would be voting on the 1986 budget in its
entirety, without excluding the Treasurer's Department because his
wife works there.

Cole's motion to accept substitute drafts for ordinances #5, 9
and 11 carried.
The motion to adopt ordinances 3 -12 as listed above carried.
Chairman Roehl stated that the ordinance relating to solid waste
management, establishing a solid waste advisory committee, would be
handled later in the meeting.
OTHER BUSINESS
The correspondence received from the Nooksack Valley Public
Schools dated 11/4/85 regarding a stop sign at the junction at Minaker
Road and North Pass Road was received by consent.and referred to the
Public Services Committee.
Chairman Roehl added the following to the agenda under "Other
Business ":
2. Correspondence from G. Roy Pearson dated October 10, 1985
regarding Dodson Mobile Home Park, boundary between the
AG and GP zone (see attached)
Chairman Roehl explained that the Planning and Development
Committee had reviewed the correspondence and recommended that the
boundary between the AG and GP zone as the 100 year flood plain
boundary, as designated by FEMA maps, and that the Council's findings
and decision be amended accordingly.
JOHNSON MOVED TO AMEND THE COUNTY COUNCIL FINDINGS OF FACT,
CONCLUSIONS OF LAW AND DECISION IN THE MATTER OF THE APPLICATION OF
W.L. DODSON TO CREATE DODSON MOBILE HOME PARK, TO CLARIFY THAT THE
BOUNDARY BETWEEN THE AG & GP ZONE BE DEFINED AS THE 100 YEAR FLOOD
PLAIN BOUNDARY, AS DESIGNATED BY FEMA MAPS.
There was discussion on the motion.
Johnson stated that this did not change his overall feelings ..:
about the project itself.
Chairman Roehl also stated that this did not affect his overall
feelings about the mobile home park itself.
The motion carried.
ORDINANCE RELATING TO SOLID WASTE MANAG L E ESTABLISHING

Cole reported that the Public Services Committee had reviewed the
ordinance relating to solid waste management and establishing a solid

waste advisory committee, and that the Committee recommended some
proposed amendments.
COLE MOVED TO AMEND THE ORDINANCE WITH THE FOLLOWING:
Page 1, lines 7 and 12, "RCW 70.90" should read "RCW 70.95 ".
Page 1, line 28.5, after the word "Executive" add the words
"and Council"
Page 2, line 9, change to read as follows: "The County Executive
may recommend appointments, with appointments being made
by County Council motion."
The motion to amend the ordinance carried.
Cole stated that the Public Services Committee also recommends
that the Chairman announce the vacancies on the solid waste advisory
committee at either this meeting or the December 5th meeting.
Johnson nominated Hawley to be the Councilmember representative
on the solid waste advisory committee.
The ordinance, as amended, was adopted.
COLE MOVED TO INTRODUCE AND ADOPT THE RESOLUTION AMENDING SEWER
CONNECTION AGREEMENT NORTH BELLINGHAM SERVICE AREA.
Cole spoke to the motion.
There was discussion on the motion.
Chairman Roehl spoke in support of continuing this resolution
over for two weeks until the December 5th Council meeting.
JOHNSON MOVED TO TABLE THE RESOLUTION AMENDING THE SEWER CONNEC-
TION AGREEMENT NORTH BELLINGHAM SERVICE AREA FOR TWO WEEKS UNTIL THE
DECEMBER 5TH COUNCIL MEETING.
Cole read into the record a memo from Councilmember Muenscher
regarding the resolution.
The motion to hold the resolution until the December 5th meeting
irried.

The resolution relinquishing a lease of easement for rights -
of -way for wharf site over and across certain Lake Whatcom shorelands
was held in the Planning and Development Committee.
The following ordinances were introduced by consent and referred
as noted below:
3. Ordinance amending the Interim Zoning Ordinance 2.24 and the
Official Whatcom County Zoning Ordinance Title 20 by transferring the
Lummi Island subareas from the Interim Zoning Ordinance to the
Official Whatcom County Zoning Ordinance (referred to Planning and
Development Committee)
4. Ordinance creating the solid waste reserve fund, a special
revenue fund, to provide monies for closure and post - closure costs
related to solid waste disposal facilities (referred to Finance)
The meeting was adjourned at 9:25 p.m.
