Minutes -- July 11, 1985
The Whatcom County Council meeting was called to order at 7:40
p.m. by Chairman Roehl with all members present except Becker, who
arrived at 7:42 p.m.
The minutes of the June 20, 1985, Council meeting were approved
as written.
EXECUTIVE ITEMS
AUTHORIZATION FOR EXCUTIVE_TO ENTER INTO �.QxRA�TS FQR

Executive Van Zanten explained the background on the following
two bid awards:
a) Civic Center Parking Lot to Whatcom Builders, Inc., in the
amount of $58,084.90, including tax
b) Reconstruction of West Hemmi Road Bridge to Impero Construc-
tion Company in the amount of $185,053.00, including tax
Becker reported that there was no quorum at the last Finance
Committee, so there is no Finance Committee report.
BECKER MOVED TO AUTHORIZE THE COUNTY EXECUTIVE TO ENTER INTO A
CONTRACT AND AWARD THE BID FOR THE CIVIC CENTER PARKING LOT TO WHATCOM
BUILDERS, INC., IN THE AMOUNT OF $58,084.90, INCLUDING TAX, AND TO
AUTHORIZE THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACT AND AWARD THE
BID FOR THE WEST HEMMI ROAD BRIDGE PROJECT TO IMPERO CONSTRUCTION
COMPANY IN THE AMOUNT OF $185,053.00, INCLUDING TAX.
Chairman Roehl stated that the motion would be split, and the two
bid awards would be voted on separately.
The motion to authorize the bid for the Civic Center Parking Lot
carried.
Becker stated that an initiating resolution accompanied the
request for authorization for the Executive to enter into a contract
for reconstruction of the West Hemmi Road Bridge.
BECKER MOVED TO INTRODUCE AND ADOPT THE INITIATING RESOLUTION
REGARDING THE WEST HEMMI ROAD BRIDGE PROJECT.

Chairman Roehl restated the motion to award the bid for the West
Hemmi Road Bridge project.
The motion to authorize the Executive to enter into a contract
for the West Hemmi Road Bridge project with Impero Construction
Company carried.
BOARD APPOINTMENTS /REAPPOINTMENT TO THE NORTHWEST SENIOR
SERVICES ADVISORY BOARD
Executive Van Zanten explained the background on the board
appointments and reappointment to the Northwest Senior Services
Advisory Board.
HAWLEY MOVED TO APPROVE THE FOLLOWING APPOINTMENTS,/REAPPOINTMENT
TO THE NORTHWEST SERVICES BOARD;
A) JOE VAN RY FOR REAPPOINTMENT TO A THREE -YEAR TERM FROM
JULY 1, 1985 TO JUNE 30, 1988.
B) YVONNE DONELSON FOR APPOINTMENT TO A THREE -YEAR TERM FROM
JULY 1, 1985 TO JUNE 30, 1988.
C) JOHN KLUDT FOR APPOINTMENT TO A THREE -YEAR TERM FROM
JULY 1, 1985 TO JUNE 30, 1988.
The motion carried.
Executive Van Zanten reported on the following items:
a) Certificate of good practice received from the state for Ed
Henken; Executive Van Zanten presented the certificate to
Mr. Henken.
b) Gas tax monies will be received from the state in the amount
of $375,000.00 ($225,000 will be used for Pt. Roberts;
$150,000 for Haynie Road). These are both urban arterial
projects.
c) Updated the Council on a recycling study program for the
County; paper recycling in the Courthouse; the County's
herbicide program, and a petition received from Emerald
Lake homeowners regarding herbicide spraying in their -area.
There was some discussion on the County's herbicide program.
Councilmembers asked if a report could be put together which would
provide them with an update on the herbicide program. Executive Van

Zanten stated that she could put a report together.
HEARINGS
The public hearing was declared open in the matter of the
resolution regarding the matter of placing a name on a certain county
road right -of -way. There was no one present to speak at the hearing,
and the public hearing was closed.
Hawley reported that the Public Services Committee recommended
approval of the resolution.
HAWLEY MOVED FOR FINAL ADOPTION OF THE RESOLUTION REGARDING THE
MATTER OF PLACING A NAME ON A CERTAIN COUNTY ROAD RIGHT -OF -WAY.
The motion carried.
ORDINANCE REGARDING THE MATTER OF PLACING A STOP SIGN AT THE
INTERSECTION OF 42ND CT. WEST AND LOOMIS TRAIL ROAD
The public hearing was declared open in the matter of the
ordinance regarding the matter of placing a stop sign at the intersec-
tion of 42nd Ct. West and Loomis Trail Road. There was no one present
to speak at the hearing, and the public hearing was closed.
Hawley reported that the Public Services Committee recommended
approval of the ordinance.
HAWLEY MOVED FOR FINAL ADOPTION OF THE ORDINANCE REGARDING THE
MATTER OF PLACING A STOP SIGN AT THE INTERSECTION OF 42ND CT. WEST AND
LOOMIS TRAIL ROAD.
The motion carried.
PETITION FOR LOT LINE VACATION BETWEEN LOTS 53 AND 54, DIVISION
10, PLAT OF SUDDEN VALLEY, FILED BY JOHN AND GERRY SLEETH
The public hearing was declared open in the matter of the
petition for lot line vacation between lots 53 and 54, division 10,
Plat of Sudden Valley, filed by John and Gerry Sleeth. There was no
one present to speak at the hearing, and the hearing was closed.
Muenscher reported that the Planning and Development Committee
recommended approval of the petition for lot line vacation.

HAWLEY MOVED FOR FINAL ADOPTION OF AN ORDINANCE AMENDING WHATCOM
COUNTY CODE SECTION 9.32 BY CREATING A NEW SECTION PROHIBITING THE
DISCHARGE OF FIREARMS IN DIVISIONS 1 AND 2 OF BOYNTON SUNSET TRACTS.
Hawley reported that the Public Services Committee recommended
approval of the ordinance, and that they had amended the ordinance as
noted on draft 2.
HAWLEY MOVED TO SUBSTITUTE DRAFT 2 OF THE ORDINANCE AMENDING
WHATCOM COUNTY CODE SECTION 9.32 BY CREATING A NEW SECTION PROHIBITING
THE DISCHARGE OF FIREARMS IN DIVISIONS 1 AND 2 OF BOYNTON SUNSET
TRACTS FOR FINAL ADOPTION.
There was discussion on making some conformity between the
different zones where the discharge of firearms are prohibited.
The motion to adopt draft 2 of the ordinance carried.
RESOLUTION IN THE MATTER QF THE WHATCOM COUNTY COMPREHENSIVE
SIX YEAR ROAD PROGRAM FOR THE YEARS 1986 THROUGH 1991
The public hearing was declared open in the matter of the
resolution in the matter of the Whatcom County Comprehensive Six Year
Road Program for the years 1986 through 1991. There was no one
present to speak, and the hearing was closed.
HAWLEY MOVED FOR FINAL ADOPTION OF THE RESOLUTION IN THE MATTER
OF THE WHATCOM COUNTY COMPREHENSIVE SIX YEAR ROAD PROGRAM FOR THE
YEARS 1986 THROUGH 1991.
Hawley reported that the Public Services Committee recommended
approval of the resolution.

TO ALLOW TEMPORARY AND REAKFA-5-MTESTAB ISHMENTS IN
SPECIFIED ZONE DISTRICTS AS A PERMITTED USE SUBJECT TO
ADMINISTRATIVE APPROVAL ONLY DURING THE PERIOD FROM APRIL 1,
1986 THROUGH NOVEMB0 30, 1986
The public hearing was declared open in the matter of the
ordinance temporarily amending the Whatcom County Interim Zoning
Ordinance, Chapter 2.24 of the Whatcom County Code and the Official
Whatcom County Zoning Ordinance, Title 20 W.C.C., to allow temporary
bed and breakfast establishments in specified zone districts as a
permitted use subject to administrative approval only during the
period from April 1, 1986 through November 30, 1986.
Bill Trimm explained the ordinance and which zones would be
affected.
There was no one else present to speak at the public hearing, and"
the hearing was closed.
There was discussion on the permit process that would be utilized
if this ordinance were passed and on the necessity of an ordinance of
this nature.
Muenscher reported that the Planning and Development Committee
had recommended approval of the ordinance.
Muenscher spoke in support of the ordinance.
MUENSCHER MOVED FOR FINAL ADOPTION OF THE ORDINANCE TEMPORARILY
AMENDING THE WHATCOM COUNTY INTERIM ZONING ORDINANCE, CHAPTER 2.24 OF
THE WHATCOM COUNTY CODE AND THE OFFICIAL WHATCOM COUNTY ZONING
ORDINANCE, TITLE 20 W.C.C., TO ALLOW TEMPORARY BED AND BREAKFAST
ESTABLISHMENTS IN SPECIFIED ZONE DISTRICTS AS A PERMITTED USE SUBJECT
TO ADMINISTRATIVE APPROVAL ONLY DURING THE PERIOD FROM APRIL 1, 1986
THROUGH NOVEMBER 30, 1986.
COLE MOVED TO AMEND THE ORDINANCE AS FOLLOWS:
page 61 of the packet, last paragraph (2.24A.055) to read as
follows: "Administrative approval for temporary bed and breakfast
establishments shall be considered by the Deputy Administrator of the
Bureau of Buildings and Code Administration, with the advice of the
Planning Director, and the Deputy Administrator shall approve such use
if it is determined that the proposed bed and breakfast establishment
meets the following requirements."

COLE MOVED TO AMEND THE ORDINANCE AS FOLLOWS:
page 67 of the packet, section 20.A.0551 and at the top of the
page: similar amendment to the previous one.
Chairman Roehl spoke in support of sending the ordinance back to
Committee for revisions.
COLE MOVED TO RE -REFER THE ORDINANCE BACK TO THE PLANNING AND
DEVELOPMENT COMMITTEE. k.
The motion to refer the ordinance back to Planning and Develop-
ment Committee carried.
Becker suggested that copies of the ordinance could also be sent
to the local Expo 186 Committee and the Convention Bureau.
Chairman Roehl stated that the Planning and Development Committee
would take her recommendation under advice.
Chairman Roehl announced that if anyone was interested in
speaking on the topics of any of the appeals the Council would be
considering later on, that he could not allow discussion on those
appeals at this time due to the quasi - judicial nature of the appeals.
Hawley announced that he had a new grandson.
There was no one else present to speak at Open Session.
ORDINANCE REPEALING WHATCOM COUNTY CODE 2.40.080
Hawley reported that the Public Services Committee recommended
approval of the ordinance repealing Whatcom County Code 2.40.080.

agricultural district.

INTERIM ZONING ORDINANCE TO ALLOW FOR SAND OR GRAVEL EXTRACTION WITHIN

Muenscher asked Bill Trimm, Planning Director, to explain the
background on the ordinance. Mr. Trimm explained the background on
the ordinance amending ordinance No. 85 -32 changing the section
amended from Whatcom County Code 20.40 to the Interim Zoning Ordinance
2.24.270.

HAWLEY MOVED TO AFFIRM THE HEARING EXAMINER'S DECISION REGARDING
THE ZONING CONDITIONAL USE PERMIT APPLICATION OF THE FIRST SPIRITUAL-
IST CHURCH OF BELLINGHAM AND DENY THE APPEAL.
Following discussion on the application, Chairman Roehl restated
the motion.
Following further discussion, Chairman Roehl stated that the
matter could be remanded back to the Hearing Examiner for further
clarification on such things as the hours of operation or future
expansion.
COLE MOVED TO REMAND THE APPEAL OF THE HEARING EXAMINER'S
DECISION REGARDING THE ZONING CONDITIONAL USE PERMIT APPLICATION OF
THE FIRST SPIRITUALIST CHURCH OF BELLINGHAM BACK TO THE HEARING
EXAMINER WITH INSTRUCTIONS TO THE HEARING EXAMINER TO ATTACH CONDI-
TIONS RESTRICTING FUTURE EXPANSION OF THE IMPROVEMENTS OR USES ON THE
SITE WHICH WOULD EXACERBATE THE OFFSITE EFFECTS OF THE DEVELOPMENT
BEING PROPOSED BY THIS APPLICATION.

Randall Watts, Civil Deputy Prosecuting Attorney, explained the
remand process.
Cole spoke again to the motion.
Hawley withdrew his motion.
The motion to remand this matter back to the Hearing Examiner
carried.
Chairman Roehl stated that he would like to handle the Delta
Cablevision matter at this time of the meeting.
DISCUSSION REGARDING DELTA CABLE TELEVISION /GUINESS COMM. RATES
Chairman Roehl provided background information on the rate

CONSIDERATION OF THE ALCOHOL CONTRACTS
COLE MOVED THAT THE SERVICE CONTRACT FOR ALCOHOLISM SERVICES WITH
THE WHATCOM COUNTY COUNCIL ON ALCOHOLISM RECOMMENDED BY THE COUNTY
EXECUTIVE BE APPROVED, AND FURTHER, THAT THE PROPOSED CONTRACT WITH
HUMAN SERVICES ASSOCIATES, INC. FOR INTENSIVE OUTPATIENT SERVICES BE
DISALLOWED, AND FURTHER, THAT THE ADMINISTRATION BE REQUESTED TO
SOLICIT NEW PROPOSALS FOR INTENSIVE OUTPATIENT TREATMENT SERVICES
WHICH ADDRESS THE FINANCIAL AND FACILITY CAPABILITIES OF THE PROPOSED
VENDORS.
Cole spoke to the motion.
Hawley questioned the procedure and whether or not this matter
should be held in Executive Session.
Chairman Roehl stated that Mr. Cole could proceed.
Hawley spoke against the motion.
Chairman Roehl restated the motion.
Hansey spoke in support of the motion.
Hawley requested to add a friendly amendment to Mr. Cole's motion
that would separate the two contracts into two separate motions.
Cole did not accept the friendly amendment.
Hawley spoke against the motion.
Muenscher asked that the Council recess into Executive Session
briefly in order to have some questions answered. The Council went
into Executive Session at 11 :00 p.m. and reconvened at 11:03 p.m.
HAWLEY MOVED TO TABLE THIS ISSUE UNTIL TOMORROW NIGHT OR UNTIL
NEXT WEEK.

INTERIM EMERGENCY BASIS TO AWARD A CONTRACT FOR INTENSIVE OUTPATIENT
TREATMENT.

Chairman Roehl explained the background on the request for the
appointment of Mr. Robert Kirkman to serve as a commissioner of
Cemetery District No. 11, with his term to expire on November 20th.
JOHNSON MOVED TO APPROVE THE APPOINTMENT OF ROBERT KIRKMAN AS A
COMMISSIONER OF CEMETERY DISTRICT NO. 11, WITH HIS TERM TO EXPIRE ON
NOVEMBER 20TH.
