Minutes -- December 5, 1985
The Whatcom County Council was called to order at 7:30
p.m. on Thursday, December 5, 1985, by Chairman Roehl with all
members present except Cole.
Chairman Roehl added the following emergency ordinance to
the agenda under "Introduction of Resolutions and Ordinances ":
An Emergency Ordinance to revise the 1985 Veterans
Relief Fund
RROPOSED INTERLOCAL AGREEMEBT, ENFORCEMENT SERVICESt
WITH EVERSON AND NQOKSACK
Executive Van Zanten stated that this item had been with-
drawn by the cities of Everson and Nooksack.
REQUESTS FOR OVERLIMIT TRANSFERS: PROSECUTING ATTORIN Y
BUDGET AND JAIL BUDGET
Executive Van Zanten explained the background on the
.ollowing requests for overlimit transfers:
a) In the Current Expense Fund, Prosecuting Attorney
budget in the amount of $8,107.21
b) In the Current Expense Fund, Jail budget, in the
amount of $10,000.00 (Corrections officer /cooks)
c) In the Current Expense Fund, Jail budget, in the
amount of $10,000.00 (Office and Operating Supplies)
Becker reported that the Finance Committee recommended
approval of all three overlimit transfers.
BECKER MOVED TO APPROVE THE FOLLOWING OVERLIMIT TRANSFERS:
A) IN THE CURRENT EXPENSE FUND, PROSECUTING ATTORNEY
BUDGET IN THE AMOUNT OF $8,107.21
B) IN THE CURRENT EXPENSE FUND, JAIL BUDGET, IN THE
AMOUNT OF $10,000.00 (CORRECTIONS OFFICER /COOKS)
C) IN THE CURRENT EXPENSE FUND, JAIL BUDGET, IN THE
AMOUNT OF $10,000.00 (OFFICE AND OPERATING SUPPLIES)

Executive Van Zanten explained the background on the request
for an underlimit transfer in the Current Expense Fund, Juvenile
Court budget, in the amount of $4,623.00.
Becker reported that the Finance Committee recommended
approval of the underlimit transfer.
BECKER MOVED TO APPROVE THE UNDERLIMIT TRANSFER IN THE
CURRENT EXPENSE FUND, JUVENILE COURT BUDGET, IN THE AMOUNT OF
$4,623.00.
The motion carried.
BID AWARD RECOMMENDATION. LANDSCAPING OF PARKINC,1. LOT, CIVIC
CENTER AREA, TO DEWILDE'S NURSERIES
Executive Van Zanten explained the background on the bid
award recommendation for the landscaping of the parking lot,
civic center area, to the lowest responsive bidder, DeWilde's
-'Nurseries, in the amount of $11,462.05.
Becker reported that the Finance Committee recommended
approval of the bid award to DeWilde's Nurseries.
BECKER MOVED TO APPROVE THE BID AWARD FOR THE LANDSCAPING OF
THE PARKING LOT, CIVIC CENTER AREA, TO THE LOWEST RESPONSIVE
BIDDER, DEWILDE'S NURSERIES, IN THE AMOUNT OF $11,462.05.
Johnson spoke against the motion.
The motion carried.
BECKER MOVED TO APPROVE THE BIDDERS' LIST FOR THE SUPPLY OF
HOT AND COLD ASPHALTIC MIXES.
Becker reported that the Finance Committee recommended
approval of the bidders' list for the supply of hot and cold
asphaltic mixes.
There was discussion on the motion.
The motion carried.

CONSIDERATION OF A PROFESSIONAL SERVICES CONTRACT BETWEEN
THE WHATCOM COUNTY PARK AND RECREATION BOARD AND TED S. GACEK AND
ASSOCIATES FOR THE SUMAS MOUNTAIN ORV PARK ENVIRONMENTAL IMPACT
STATEMENT
This item will be held over for two weeks at the request of
the Parks Department and Executive Van Zanten.
EXECUTIVE'S REPORT
Executive Van Zanten stated that Whatcom County would be
hosting the 1987 Convention of the Washington State Association
of Counties.
Executive Van Zanten commended the road crews and adminis-
tration for their performance during the recent adverse weather
conditions.
OPEN SESSION
Johnson addressed the large group of students from Sehome
High School; one of the students spoke to the Council.

Hawley spoke of his appreciation of Stacy and presented a
Resolution Bidding Stacy Mhyre Goodbye and Wishing Her Good Luck
In Her New Career as a Mom.
FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES
RESOLUTION AMENDING THE SEWER CONNECTION AGREEMENT_
NORTH BELLINGHAM SERVICE AREA.
Bansey excused himself from the meeting at this time.
Chairman Roehl explained the background on this resolution.
Randy Watts explained it further. This resolution will be
scheduled for final consideration at the December 19 Council
meeting.

Muenscher reported that the Planning and Development
Committee recommended approval of the resolution.
There was discussion on the resolution.
HAWLEY MOVED THAT THE RESOLUTION RELINQUISHING A LEASE OF
EASEMENT FOR RIGHTS -OF -WAY FOR WHARF SITE OVER AND ACROSS CERTAIN
LAKE WHATCOM SHORELANDS BE REFERRED BACK TO THE PLANNING AND
DEVELOPMENT COMMITTEE.
The motion carried.
ORDINANCE AMENDING THE INTERIM ZONING ORDINANCE 2.24 AN
THE OFFICIAL WHATCOM COUNTY-ZONING, ORDINANCE TITLE 20
BY TRANSFERRING THE LUMMI ISLAND SUBAREAS FRQ14 THE INTERIM
ZONING ORDINANCE TO THE OFFICIAL WHATCOM COUNTY ZONING
ORDINANCE.
Muenscher reported that the Planning and Development
.ommittee recommended approval of the ordinance.
There was discussion on the ordinance.
MUENSCHER MOVED FOR FINAL ADOPTION OF THE ORDINANCE AMENDING
THE INTERIM ZONING ORDINANCE 2.24 AND THE OFFICIAL WHATCOM COUNTY
ZONING ORDINANCE TITLE 20 BY TRANSFERRING THE LUMMI ISLAND
SUBAREAS FROM THE INTERIM ZONING ORDINANCE TO THE OFFICIAL
WHATCOM COUNTY ZONING ORDINANCE.
The motion carried.
ORDINANCE CREATIB9 T�_�OLID WASTE RESERVE FUND, A SPECIAL
REVENUE FUND, TO PROVIDE MONIES -FOR CLOSURE AND POST- CLOSURE
COSTS RELATED TO SOLID WASTE DISPOSAL FACILITIES_
Becker reported that the Finance Committee had reviewed and
recommended approval of a substitute draft of this ordinance.
BECKER MOVED FOR FINAL ADOPTION OF THE SUBSTITUTE DRAFT OF
THE ORDINANCE CREATING THE SOLID WASTE RESERVE FUND, A SPECIAL
REVENUE FUND, TO PROVIDE MONIES FOR CLOSURE AND POST - CLOSURE
COSTS RELATED TO SOLID WASTE DISPOSAL FACILITIES.
HAWLEY MOVED TO AMEND THE SUBSTITUTE DRAFT ON LINE B FROM
50,000 TO $500,000.

There was discussion on the motion to amend.
HAWLEY MOVED TO AMEND HIS MOTION OF THE SUBSTITUTE DRAFT
FROM $500,000 TO $150,000.
HANSEY MOVED TO REFER THIS SUBSTITUTE ORDINANCE BACK TO THE
FINANCE COMMITTEE.
Chairman Roehl stated that the motion to refer took prece-
dence over the motion to amend.
The motion to refer back to committee carried.

The petition for franchise filed by Sandy Point Improvement
Company was received by consent and referred to the Public
Services Committee. It will be scheduled for public hearing.

Chairman Roehl nominated Muenscher; Johnson had already
nominated Hawley at the 11/21 meeting.
JOHNSON MOVED THAT THE NOMINATIONS BE CLOSED.
The motion carried.
The final vote will be taken at the December 19th Council
meeting.
RESOLUTION AMENDING RESOLUTION NO. 85 -30 TO SELL PROPERTY
ACQUIRED BY COUNTY ON TAX FORECLOSURE
Becker reported that the Finance Committee had recommended
approval of this resolution.
There was discussion on the resolution. Hansey explained
the resolution further.
BECKER MOVED TO INTRODUCE AND ADOPT THE RESOLUTION AMENDING
RESOLUTION NO. 85 -38 TO SELL PROPERTY ACQUIRED BY COUNTY ON TAX
FORECLOSURE.
The motion carried.

This resolution was introduced by consent and was referred
to the Finance Committee.
EMERGENCY ORDINANCE TO EEVISE THE 1985 VETERAN'S RELIEF FUND
BUDGET
The emergency ordinance was introduced by consent.
There was discussion on the emergency ordinance.
JOHNSON MOVED TO AMEND THE EMERGENCY ORDINANCE FROM $4,000
TO $1,000 AND THAT AN ACCOMPANYING LETTER FROM THE CHAIRMAN OF
THE COUNCIL BE SENT TO THE VARIOUS VETERANS ORGANIZATIONS
EXPLAINING THE COUNCIL'S POSITION ON THE EMERGENCY ORDINANCE.
The motion to amend carried.
There was further discussion on the emergency ordinance.
The Emergency Ordinance failed (4 -2, Hansey, Muenscher)
HANSEY MOVED TO RECONSIDER THE VOTE ON THE EMERGENCY
ORDINANCE.
The motion to reconsider carried.
A second roll -call vote was taken and the emergency ordi-
nance passed. (5 -1, Muenscher)
The meeting was adjourned at 8:58 p.m.
