COMMITTEE OF THE WHOLE
Minutes -- July 9, 1985
The Whatcom County Council Committee of the Whole was called to
order at 7:22 p.m. by Chairperson Roehl, with all members present
except Becker and Cole. Also in attendance were Executive Van Zanten;
Randall J. Watts, Civil Deputy Prosecuting Attorney; Paul Rushing,
Director of Public Works, and other interested citizens.
DISCUSSION ON THE BIRCH BAY DRIVE RIGHT -OF -WAY
Johnson stated that he had received a call from a gentleman from
Birch Bay who requested that the record show that he objects to the
meeting due to the lack of notification. At the June 20th Council
meeting in Birch Bay, people had been told that they would be notified
regarding this meeting, and there appears to have been a lack of
notification.
Chairperson Roehl stated that no decisions would be made tonight,
and any information generated at this meeting would be available to
anyone interested.
Hawley also stated that Mr. Jerns had called him and stated the
same thing regarding the notification of the meeting.
Hansey restated what he said at the Birch Bay meeting regarding
the notification of future meetings on this issue.
Executive Van Zanten asked Randy Watts to explain the background
on the Birch Bay Drive right -of -way issue, whether it was a 60 -foot or
a 30 -foot right -of -way. Executive Van Zanten explained the dispute
further. Randy Watts also explained why the County should petition
the court for a decision as to whether the right -of -way is 60 -feet or
30 -feet wide.
There was discussion on the disputed right -of -way and future
development along Birch Bay Drive.
Hawley questioned whether there was any other avenue, besides
going to court, that the Council could pursue with regard to this
disputed right -of -way.
There was further discussion on the disputed right -of -way.
Hansey asked about the costs to the County in getting this
dispute settled in court. Randy Watts explained the costs that would
be incurred.
There was further discussion on the Birch Bay Drive right -of -way.

HAWLEY MOVED TO FORWARD THIS MATTER TO THE FULL COUNCIL FOR
CONSIDERATION ON THURSDAY, JULY 11TH.
Hansey spoke in support of setting up a time for public input on
this issue.
Chairman Roehl stated that this item will be scheduled for the
Committee of the Whole meeting on Thursday, July 18th, for public
input. People who have left their names and addresses for notifica-
tion on this issue will be notified of the meeting date, as well as
the Bellingham Herald, Westside Record Journal, Lynden Tribune, the
radio stations and others on the media mailout list.
DISCUSSION ON THE NOR -BELIE FACILITY
Executive Van Zanten explained that Stan Jones, Administrator of
Nor -Bell Nursing Home, had resigned effective July 31, 1985. She also
explained the history on the operation and financing of the Nor -Bell
Nursing Home, and that the facility has not been "carrying its own
weight" the last couple of years. Executive Van Zanten asked the
Council Committee of the Whole to consider the management and the
County's operation of the facility.
There was discussion on the per -bed rates paid out by the
Department of Social and Health Services for municipally -owned
facilities as opposed to privately -owned facilities.
Executive Van Zanten discussed possibilities for the Nor -Bell
Nursing Home facility.
Roehl spoke in support of the formation of some kind of committee
to pursue the discussion on the Nor -Bell facility.
There was discussion on forming a committee and the time period
that may be involved, as well as evaluation of the management of the
facility in the future.
Chairman Roehl stated that he would get together with Executive
Van Zanten to discuss the direction to proceed. The meeting was
adjourned.
