HomeMy WebLinkAboutSpecial Council March 13 1986WHATCOM COUNTY COUNCIL SPECIAL COUNCIL MEETING MINUTES - MARCH 13, 1986 The Whatcom County Council was called to order at 7:05 p.m. by Chairman Hansey, with all members present except Muenscher. Chairman Hansey explained that the Council would be trying for the first time during Special Council meetings to recess into Committee of the Whole meetings which are for informal dis- cussion, and then reconvene into Council meeting to determine if any action would be taken on any items that were on the agenda. Chairman Hansey also explained that there would not be any public input in Special Council meetings with regard to any items on the agenda; these meetings are primarily work sessions at which time the County Council will discuss the items on the agenda with the staff. The Committee of the Whole meeting reconvened at 7:25 p.m. ROEHL MOVED THAT THE COUNCIL RECONVENE THE SPECIAL COUNCIL MEETING TO CONSIDER THE ITEMS BEFORE THE COUNCIL. The motion carried. JOHNSON MOVED THAT WE REJECT THE APPEAL BY MICHAEL NUMRICH AND UPHOLD THE HEARING EXAMINER'S DECISION. Roehl spoke for the motion. Johnson spoke to his motion. The motion carried. She also distributed a memo from herself to the councilmembers pertaining to the Cedarville landfill site. Executive Van Zanten informed the Councilmembers that the following people were in attendance at the meeting and would be willing to respond to any questions asked of them: John Glynn, Department of Ecology; Dr. Phillip Jones, Health District; Bert Brainard, Health District; Terry Nyman, Air Pollution Authority; Robert Tull, attorney representing Thermal Reduction Corporation; and Corky Smith, from the Olivine Corporation. Executive Van Zanten also referred to the letter from Robert Tull, who is representing Thermal Reduction Corporation, in which he states that Thermal Reduction Corporation would now seriously consider providing alternatives to Cedarville. Executive Van Zanten summarized her point of view of some of the issues before the Council related to their decision on the Cedarville Landfill site. Chairman.Hansey reiterated the fact that what was before the Council at this time is the matter of reviewing the leachate agreement. Warner addressed the issue of whether or not the Cedarville landfill site will be closed. Warner directed his question to Mr. John Glynn: "What is the probability of needing a leachate collection system if we close the dump down ?" John Glynn, He stated that the neither the Health D.O.E. Dept. nor the Department of Ecology could specify then whether a leachate system would be necessary if the landfill site was closed. c) Special Council Meeting Minutes - March 13, 1986 Page 3 There were many questions addressed to Mr. Glynn from the Councilmembers. There was some discussion on the need to change the Compre- hensive Plan if the Cedarville site was closed; also discussed were the availability of funds for closure. Warner questioned Mr. Paul Rushing about the prognosis for Cedarville in the future and would it have to be closed down _ anyway? Chairman Hansey turned the gavel over to Councilmember Roehl. Paul Rushing He stated that the maximum time to keep Dept. of Public Works the Cedarville site open would be five years. Between now and the end of that five years, plans would be developed for a new site, through an amendment to the Comprehensive Plan. Roehl questioned Mr. Terry Nyman about tonnage levels that TRC and Olivine Corp. are presently permitted to handle. Terry Nyman He informed the Council that TRC is per - Director mitted 100 tons per day and Olivine is Northwest Air Pollution permitted 50 tons per day, 7 days per week. Chairman Hansey returned to the meeting. There was lengthy discussion between Mr. Terry Nyman and Councilmembers regarding solid waste. Councilmember Johnson questioned Mr. Jim Anderson about the new burners that were being installed at T.R.C. Jim Anderson President Thermal Reduction Corp. Johnson was questioning the length of time that would be required to get this permit. Mr. Glynn deferred the questions to Terry Nyman, Northwest Air Pollution. Mr. Terry Nyman stated that if a federal permit was required it might take six to nine months, but he believes this permit is not required. If this permit is not required, it shouldn't take more than ninety days. Councilmember Hawley asked about Olivine's permit; Mr. Nyman stated that Olivine's permit might take longer. The meeting recessed at 9:00 p.m. The meeting reconvened at 9:20 p.m. Councilmember Roehl questioned Mr. Jack Anderson about a commitment from the County if Cedarville landfill site was closed down. Mr. Jack Anderson stated that they would need some kind of commitment for operational and economical reasons. Councilmember Johnson asked about recycling; Mr. Anderson stated that he feels this issue could be examined and dealt with by Thermal Reduction Corporation. There was lengthy discussion about the problems of solid waste. Councilmember Hawley questioned Mr. Corky Smith, Chairman, Olivine Corporation, about permits for demolition and non -burn- ables. Mr. Corky Smith informed the Council that he has a permit that covers twenty acres for non - burnables and will be requesting a permit from Northwest Air Pollution to put in a demolition burner to work in conjunction with the burner that he now has. There was further discussion between the councilmembers and Mr. Corky Smith. Mr. Robert Jurica, Engineering Department, explained to the Council what work has been done in siting another landfill in the County. The Committee of the Whole meeting recessed at 10:03 p.m. The Special Council Meeting reconvened at 10:03 P.M. ROEHL MOVED TO AMEND THE RESOLUTION BY DELETING SECTION 3. The motion to amend carried. WARNER MOVED TO AMEND THE RESOLUTION BY ADDING THAT THE ADMINISTRATION BE DIRECTED TO COMMENCE INVESTIGATION TO LOCATE A NEW LANDFILL SITE IN THE COUNTY. Warner withdrew his motion to amend. JOHNSON MOVED TO AMEND BY STRIKING SEPTEMBER 30, 1986, ON LINE 30 -1/2 AND ADDING JANUARY 1, 1987. Roehl spoke for the motion to amend. The motion to amend carried. Executive Van Zanten informed the Council that the adminis- tration has no site identified for another landfill in the county. Bob Jurica spoke about the preliminary report done on the search for another possible landfill in the county. There was further discussion on the matter. Chairman Hansey restated Muenscher's motion: T'MUENSCHER MOVED TO RECOMMEND THAT AUTHORIZATION BE GIVEN TO THE ADMINISTRATION TO SIGN THE PROPOSED CONTRACT BETWEEN THE CITY OF FERNDALE AND WHATCOM COUNTY FOR CONSTRUCTION, OPERATION AND MAINTENANCE OF PRE - TREATMENT FACILITIES FOR PRE - TREATMENT AND DISPOSAL OF LEACHATE AT THE FERNDALE WASTEWATER TREATMENT PLANT." The motion to bring Muenscher's motion back to the floor carried. Paul Rushing, Director of Public Works, questioned whether or not it would be appropriate to notify the administration to inform the Department of Ecology to cease and desist the approval of the plans on the leachate, and.also to notify Harper -Owes of the termination of the leachate contract. Chairman,Hansey suggested that the Council hold Muenscher�s motion over until the Council meeting of March 20, 1986. Marty Harper, Harper -Owes, informed the Council of the status of their contract with Whatcom County. Paul Rushing informed the Council the monies paid to date and additional billing will be forthcoming from the Department of Ecology. ROEHL MOVED THAT MUENSCHER'S MOTION BE TABLED UNTIL THE NEXT COUNCIL MEETING.
