September 18, 1986
The meeting was called to order at 7:35 p.m. by Chairman
Hansey, with all Council members present.
APPROVAL OF MINUTES
The minutes of the meetings of September 4, 1986 and
September 11, 1986 were approved.
EXECUTIVE ITEMS
OVERLIMIT TRANSFER IN THE PUBLIC WORKS ADMINISTRATION, BUILDING
MAINTENANCE FUND, IN THE AMOUNT OF $9944.00
Shirley Van Zanten explained the transfer.
Roehl reported that the Finance Committee recommended
approval.
ROEHL MOVED TO AUTHORIZE THE TRANSFER.
The motion carried.
Shirley Van Zanten.explained the request.
Roehl reported that the Finance Committee recommended
authorizing the administration to arrange financing.
ROEHL MOVED TO AUTHORIZE THE ADMINISTRATION TO PURSUE
FINANCING FOR THE BOILER WITH THE GOAL OF HAVING THE WORK
COMPLETED BEFORE WINTER, AND TO RECOMMEND THAT A BOND
ANTICIPATION RESOLUTION BE DRAFTED.
There was discussion on the motion.
The motion carried.
Shirley Van Zanten requested that the Council reject the one
bid which had been received from Wedco Construction, as it was
34.5% over estimate.
Roehl reported that the Finance Committee recommended
rejection of the bid.

FINAL CONSIDERATION OF RESQLUTI NS AND ORDINANCES
ROEHL MOVED THAT THE FIRST ITEM UNDER FINAL CONSIDERATION BE
CONSIDERED IMMEDIATELY.
The motion carried.
RESOLUTION EXPRESSING THE CONCERN F THE COUNTY OF WHATCOM IN
REGARD TO DURNIaG OF HAZARDOUS MATERIALS BY THE COLUMBIA CEMENT
CORPORATION AND REQUESTING FORBEARANCE OF SUCH BURNING
Johnson reported that the Public Services Committee
recommended approval of a substitute resolution.
JOHNSON MOVED TO INTRODUCE THE SUBSTITUTE RESOLUTION.
The motion carried.
Warner explained the resolution, which he had written.
JOHNSON MOVED TO APPROVE THE SUBSTITUTE RESOLUTION.
The motion carried.
OPEN SESSION
Jim Maricle
Cedarville Road
Suggested that Cedarville Dump be closed and the beginnings of
the leachate system installed, in order to determine whether
treatment facilities were needed.
Jeff Brown
Solid Waste Advisory Committee
Suggested that, since the Committee would be done with its study
in two weeks, the Council table action on the leachate system
until after it had received and studied the report.
Rita Foley
Lake Whatcom Watershed Advisory Committee
Spoke about lack of enforcement of Environmental Health
Department regulations. She was advised that the Board of Health
was the best agency to deal with this concern.

HEARINGS
IN THE MATTER OF A PETITION REQUESTING THAT A PORTION OF
DICKINSON STREET BE VACATED, FILED BY BURTON BOYER
The public hearing on the petition was opened; no testimony
was received and the hearing was closed.
Muenscher reported that the Planning and Development
Committee recommended approval of the petition.
MUENSCHER MOVED TO APPROVE THE PETITION.
The motion carried.

MUENSCHER MOVED THAT THE HEARING BE CONTINUED UNTIL THE NEXT
COUNCIL MEETING, IN ACCORDANCE WITH THE REQUEST OF THE PUBLIC
WORKS DEPARTMENT AND THE APPLICANT.
The motion carried.
Muenscher left the meeting.
Roehl explained the ordinance and reported that the Finnce
Committee recommended adoption.

The motion carried 5 -1 (Hansey).

There was discussion on the motion, with Sheriff Mount
responding to questions from the Council.
The motion carried 4 -3 (Hansey, Hawley, Roehl).
The following motion was continued from the meeting of June
19, 1986: MUENSCHER MOVED TO RECOMMEND THAT AUTHORIZATION BE
GIVEN TO THE CITY OF FERNDALE AND WHATCOM COUNTY FOR
CONSTRUCTION, OPERATION AND MAINTENANCE OF PRE- TREATMENT
FACILITIES FOR PRE - TREATMENT AND DISPOSAL OF LEACHATE AT THE
FERNDALE WASTE -WATER TREATMENT PLANT.
Shirley Van Zanten requested that action on the motion again
be delayed in order to leave open the option of transferring the
treatment funds to a closure account if treatment facilities were
not approved.
HAWLEY MOVED TO CONTINUE TO MOTION TO THE FIRST COUNCIL
MEETING IN DECEMBER.
The motion carried.
There was discussion about whether the amendments should be
referred immediately to the Planning Commission for action or
whether the Council should work on them first.

HAWLEY MOVED TO RECONSIDER THE COUNCIL'S MOTION OF SEPTEMBER
11, 1986, AND SEND THE PROPOSED AMENDMENTS TO THE PLANNING
COMMISSION.
There was extensive debate on the motion.
The motion carried.
Mike Brennan of the Chamber of Commerce encouraged the
Council to consider hiring a specialist in economic development.
WARNER MOVED TO AUTHORIZE THE EXECUTIVE TO HIRE A DIRECTOR
OF PLANNING AND ECONOMIC DEVELOPMENT, AND TO RETAIN THE PLANNING
DEPARTMENT'S CURRENT STRUCTURE.
There was extensive debate on the motion.
ROEHL MOVED TO VOTE ON THE MOTION.
The motion failed.
There was further discussion.
HAWLEY MOVED TO TABLE THE MOTION UNTIL FURTHER INFORMATION
WAS RECEIVED.
The motion failed.
Warner's motion carried 4 -3 (Hansey, Hawley, Johnson) on a
roll call vote.
ROEHL MOVED TO INTRODUCE THE ORDINANCE AND TO AMEND THE DATE
ON LINE 12 112 TO JANUARY 1, 1987, AND THE DATE ON LINE 14 112 TO
DECEMBER 31, 1986.
The motion carried.
ROEHL MOVED TO ADOPT THE ORDINANCE.
The motion carried unanimously.

The above two ordinances were introduced and referred to the
Finance Committee.
HEPQRTS AND 01HER ITEMS FROM COUNCIL MEMBERS
'WARNER MOVED THAT THE COUNCIL REQUEST THE ADMINISTRATION TO
LOOK INTO THE POSSIBILITY AND USEFULNESS OF COMBINING SOME OF THE
INTRA- COURTHOUSE FUNCTIONS WHICH ARE NOW BEING PERFORMED BY
PURCHASING, PERSONNEL, COMPUTER SERVICES, BUDGETING, AND RISK
MANAGEMENT, WITH A REPORT DATE OF FEBRUARY 28.
The motion carried.
Johnson referred to the Executive a letter from an applicant
for appointment to the Whatcom County Parks Board.
The meeting was adjourned at 9:45 p.m.
