MINUTES - MARCH 61 1986
The Whatcom County Council was called to order at 7:35
p.m. by Chairman Hansey, with all members present.
The minutes of the Whatcom County Council, held on February
20, 1986, were approved as written.

Executive Van Zanten explained the background on the bid
award recommendation for the office copy machines; one for the
County Clerk's office, one for the Park's Department, and the
other one for the Juvenile Court office.
Councilmember Roehl reported that the Finance Committee
had reviewed the bid award recommendation and had recommended
approval to Office Systems Northwest.
ROEHL MOVED TO APPROVE THE BID AWARD RECOMMENDATION FOR THE
PURCHASE OF OFFICE COPY MACHINES TO OFFICE SYSTEMS NORTHWEST, IN
THE TOTAL AMOUNT OF $17,371.00, INCLUDING SALES TAX AND TRADE -IN
ALLOWANCE.
The motion carried.
Executive Van Zanten reported the following information from
the meeting of the State Association of Counties Legislative
Committee in Olympia:
1. Tort Reform Bill -- This Bill had just passed the Senate
and was scheduled to begin debate in the House at noon;
the staff was cautiously optimistic that a Bill would
get passed which included some of the things that the
Coalition was trying to get in.
2. Court Reform -- Nothing passed in regard to the numerous
Bills relating to Court Reform. A Bill pertaining to
double bunking in county jails has just passed the
House.
3. Supplemental Budget -- Probably would be passed. There
is an amount of $100,000 proposed in the supplemental
budget for Expo impact; it would be available for law

enforcement impact and social services impact. Execu-
tive Van Zanten was not aware of what the terms would be
for access to this money.
4. Federal Shared Revenue -- For 1986 there will be a 12.7%
reduction in the allocation that the County was antici-
pating. There was a feeling that there is some support
to reauthorize Federal Shared Revenue.
Executive Van Zanten spoke on animal control, reiterating
the fact that there is no contract in effect at the present
time; stating also that the ordinance as it now stands says the
enforcer of that ordinance is the Sheriff or someone else so
designated by the County Council.
The Sheriff is receiving many calls and is limited in his
manpower and other equipment necessary for the handling of animal
control. Executive Van Zanten's recommendation to the Sheriff
will be minimal, or no enforcement of that ordinance unless she
is authorized by the Council to do something else or until such
time that a contract is in effect.
There was some discussion on the matter of animal control.
Randy Watts, Civil Deputy Prosecuting Attorney, explained
the terms of the five -year contract with the Humane Society.
Chairman Hansey invited anyone from the audience who
wished to speak on County government.
There was no one wishing to speak.
Councilmember Roehl reported that the Finance Committee
held this ordinance over for two weeks.

Councilmember Roehl reported that the Finance Committee had
reviewed and recommended adoption of the ordinance.

ROEHL MOVED TO ADOPT THE ORDINANCE INCREASING THE WHATCOM
COUNTY PARK AND RECREATION BOARD'S SMALL CHANGE FUND.
The motion carried.
ROEHL MOVED TO ADOPT THE ORDINANCE AMENDING ORDINANCE
NO. 85 -97, AN ORDINANCE IN THE MATTER OF THE ADOPTION OF THE
FINAL BUDGET OF WHATCOM COUNTY FOR THE YEAR 1986 AND RESTRICTING
THE EXPENDITURE OF CERTAIN FUNDS THEREIN, AND MOVED TO SUBSTITUTE
THE ORDINANCE.
Councilmember Roehl reported that the Finance Committee had
reviewed the ordinance and had proposed that a substitute
ordinance be drafted which would extend the funding from March 1,
1986 until October 1, 1986 for the two jailers.
Johnson spoke to the issue.
Roehl spoke to the issue.
Larry Mount spoke to the issue.
Warner spoke to the issue.
Hawley spoke to the motion to substitute.
The motion to substitute the ordinance carried.
Roehl reported that the Finance Committee had recommended
approval of the funding for the two corrections officers until
October 1, 1986.
There was further discussion on the matter.
Tom Sutberry addressed the issue of ending fund balances.
There was lengthy discussion on the matter of the budget.
HANSEY MOVED THAT THE ENDING FUND BALANCE FOR 1986 BE
REDUCED BY THE AMOUNT OF $150,000 AND THE LINE ITEM FOR FEDERAL
PRISONER REVENUES BE REDUCED BY $150,000.

The motion carried.
Chairman Hansey restated the motion of the substitute
ordinance as amended.
Hawley spoke for the ordinance.

Johnson spoke for the ordinance.

ORDINANCE REVISING THE 1986 CURRENT EXPENSE FUND, PROSE -
CUTING ATTORNEY'S BUDGET THEREIN
ROEHL MOVED TO ADOPT THE ORDINANCE REVISING THE 1986 CURRENT
EXPENSE FUND, PROSECUTING ATTORNEY'S BUDGET THEREIN.
ROEHL MOVED TO SUBSTITUTE THE ORDINANCE BY EXTENDING THE
CHIEF CIVIL DEPUTY POSITION THROUGH THE END OF 1986.
Roehl reported that the Finance Committee had reviewed and
recommended that a substitute ordinance be drafted, which would
extend the Chief Civil Deputy position through the end of 1986,
reducing the ending fund balance by $41,689 in lieu of $13,977-
Hansey spoke against the motion.
Hawley read his memo addressed to the councilmembers
pertaining to the management of tort claims fund.
Muenscher left the meeting.
Warner spoke against the substitute ordinance.
Roehl spoke against the substitute ordinance.
Muenscher returned to the meeting.

ROEHL MOVED TO ADOPT THE ORDINANCE TO REVISE THE 1986
CURRENT EXPENSE FUND, NON- DEPARTMENTAL BUDGET THEREIN.
Roehl reported that the Finance Committee had reviewed and
recommended approval of allocating $1,100 to work for the
continued General Revenue Sharing Program.
Hansey spoke against the ordinance.

Muenscher reported that the Planning and Development
Committee had reviewed the ordinance and recommended approval.
Muenscher stated also that the Planning Department approved this
ordinance. Bill Trimm of the Planning Department explained the
ordinance in more detail.
MUENSCHER MOVED TO ADOPT THE ORDINANCE AMENDING WHATCOM
COUNTY CODE 20.83 CONCERNING CHANGING OF NONCONFORMING USES.
The motion carried unanimously.
Muenscher reported that the Planning and Development
Committee had reviewed the ordinance and recommended approval.
MUENSCHER MOVED TO ADOPT THE ORDINANCE EXEMPTING A PLANNED
UNIT DEVELOPMENT FROM THE REQUIREMENT OF OBTAINING A MAJOR
DEVELOPMENT PERMIT.

Muenscher reported that the Planning and Development has
requested that this ordinance be held over.
APPOINTMENT TO THE BELLINGHAM /WHATCOM COUNTY HEALTH DISTRICT
BOARD.
Chairman Hansey stated that at the last Council meeting
there were three people nominated. They are: Robert Moore,
John Ebert, and Robert Imhof.
A rollcall vote was taken with six votes for Robert Moore,
and one vote for Robert Imhof.
Mr. Robert Moore was appointed to the Bellingham / Whatcom
County Health District Board and Mr. Moore expressed his thanks
to the Council.
The meeting recessed at 8:50 p.m.
The meeting reconvened at 9:00 p.m.
CONSIDERATION OF THE APPEAL FILED BY ALVIN AND JOAN KOETJE
REGARDING SHORELINE VARIANCE AND CONDITIONAL USE PERMITS.

Chairman Hansey reported that the Committee of the Whole had
discussed this matter at their meeting earlier in the evening.
ROEHL MOVED THAT THE HEARING EXAMINER'S DECISION BE OVER-
TURNED.

PLANNING COMMISSION'S RECOMMENDATIONS ON OPEN SPACE AND
TIMBER LAND APPLICATIONS -- Dahl, Krause, Owens, DeBoer, Brown
and Carruthers, King, Van de Wol Inc., Gossage, Hendrickson,
Stockton, Luck and Hanson, Janeway, Vineyard, and Romfh.

dations on the Open Space and Timber Land applications to the
Planning and Development Committee.
Chairman Hansey added three ordinances to the agenda.
This resolution was introduced by consent and will be
considered at the March 13th meeting of the Committee of the
Whole.

ROEHL MOVED TO INTRODUCE AND ADOPT THE RESOLUTION IN THE
MATTER OF SETTING A DATE FOR PUBLIC HEARING FOR DECLARING 259000
CUBIC YARDS OF SCREENINGS OWNED BY WHATCOM COUNTY SURPLUS
PURSUANT TO R.C.W. 35.34.020.
Marlen Hansen, Public Works Maintenance and Operations
Superintendent, explained the meaning of the word "screenings"
to the Council.
The motion carried.
This ordinance was introduced by consent and was referred to
the Finance Committee.

The following ordinance were added to the agenda and were
introduced by consent and referred to the Finance Committee
Councilmember Warner questioned Executive Van Zanten about
the subject of animal control.
Executive Van Zanten stated that she needed authority from
the Council in order for her to even attempt to enter into an
emergency interim contract.
WARNER MOVED TO AUTHORIZE THE EXECUTIVE TO ENTER INTO A
CONTRACT FOR THE INTERIM PROVISION OF ANIMAL CONTROL SERVICES
WITH THE OTHER PARTY WHO EXPRESSED AN INTEREST IN THIS IN AN
AMOUNT NOT TO EXCEED THE $39500 PER UNIT OF TIME.
