HomeMy WebLinkAboutCounty Council January 16 1986WHATCOM COUNTY COUNCIL MINUTES - January 16, 1986 The Whatcom County council was called to order at 7:40 p.m. by Chairman Roehl, with all members present except Johnson. MINUTES The minutes of the Whatcom County Council, held on January 2, 1986, were approved as written. REORGANIZATION OF COUNCIL Hawley reported to the Council the results of the preference lists that were sent to all the Council members. Mr. Hawley was able to contact all the Council members except one. Chairperson: HAWLEY MOVED TO NOMINATE HANSEY FOR CHAIRMAN. There were no further nominations. A rollcall vote was taken and Hansey was elected Chairperson of the Whatcom County Council. Vice - Chairperson: Hawley reported from his tabulations that Roehl received five (5) votes and Johnson received one (1) vote. HAWLEY MOVED TO NOMINATE ROEHL FOR VICE - CHAIRPERSON. There were no further nominations. A rollcall vote was taken and Roehl was elected Chairperson of the Whatcom County Council. Executive Pro - tempore: Hawley reported that Muenscher received two (2) votes and Hawley received four (4) votes. HAWLEY MOVED TO NOMINATE MUENSCHER AND HAWLEY FOR EXECUTIVE PRO- TEMPORE. A rollcall vote was taken and the vote was tied (3 -3). It was the preference of the Council members to revote on the Pro - tempore position at the end of the committee and board selections. Finance Committee: Hawley reported that Roehl received four (4) votes; Muen- scher received four (4) votes; Hawley received two (2) votes; and Warner received three (3) votes. 2 Whatcom County Council Minutes - January 16, 1986 Page 2 HAWLEY MOVED TO NOMINATE.ROEHL, MUENSCHER AND WARNER AS MEMBERS OF THE FINANCE COMMITTEE. There were no further nominations. A rollcall vote was taken and Roehl, Muenscher and Warner were elected members of the Finance Committee. Planning and Development Committee: Hawley reported that Burton received four (4) votes; Muenscher received four (4) votes; Johnson received four (4) votes; and Warner received one (1) vote. HAWLEY MOVED TO NOMINATE BURTON, MUENSCHER, JOHNSON, AND WARNER AS MEMBERS OF THE PLANNING AND DEVELOPMENT .COMMITTEE. . There were no further nominations. A rollcall vote was taken and Burton, Muenscher and Johnson were elected members of the Planning and Development Committee. Public Services Committee: Hawley reported that Burton received four (4) votes; Johnson received four (4) votes; and Hawley received four (4) votes. HAWLEY MOVED TO NOMINATE BURTON, JOHNSON AND HAWLEY AS MEMBERS OF THE PUBLIC SERVICES COMMITTEE. There were taken and Burton, Public Services .0 Board of Hea (4) votes; Burton four (4) votes. no further nominations. A rollcall vote was Johnson and Hawley were elected members of the ommittee. lth: Hawley reported that Hansey received four received four (4) votes; and Warner received HAWLEY MOVED TO NOMINATE HANSEY, BURTON AND WARNER AS MEMBERS OF THE BOARD OF HEALTH. Burton nominated Muenscher for the Board of Health. Muenscher informed the Council members that he has served on the Health Board for several years and would prefer not to serve on this Board. Muenscher's name was withdrawn from nomination. There were no further nominations. The motion carried. Council of Governments: Hawley reported that Muenscher received four (4) votes and Hawley received four (4) votes. 2 Whatcom County Council Minutes - January 16, 1986 Page 3 HAWLEY MOVED TO NOMINATE MUENSCHER AND HAWLEY AS MEMBERS OF THE COUNCIL OF GOVERNMENTS. There were no further nominations. The motion carried. Council on Aging: Hawley reported that this is an "optional" position and did not receive any response from any Council member. Chairperson Roehl stated that he would discuss this with Councilmember Johnson since Johnson had served on the Council on Aging in the past; if Johnson is not interested in serving on this Council, Chairperson Roehl stated that he may be willing to serve on the Council on Aging. Law Enforcement and Firefighters Board: Hawley informed the Council members that Roehl has been on the LEOFF Board and that Roehl had indicated that it didn't make any difference to him if he was appointed to this Board. Hawley also stated that Warner had received four (4) votes; Chairperson.Roehl explained the function of this Board to the Council members. HAWLEY MOVED TO NOMINATE WARNER TO SERVE ON THE LAW ENFORCE- MENT AND FIREFIGHTERS BOARD. The motion carried. Northwest Air Pollution Board: Hawley reported that Muenscher received three (3) votes and Johnson received two (2) votes. HAWLEY MOVED TO NOMINATE MUENSCHER AND JOHNSON TO THE NORTHWEST AIR POLLUTION BOARD. A vote was taken; Muenscher was appointed to the Northwest Air Pollution Board. Northwest Regional Council: Hawley reported that Johnson is now serving on this Council and would like to continue serving on the Council. HAWLEY MOVED TO NOMINATE JOHNSON TO SERVE ON THE NORTHWEST REGIONAL COUNCIL. The motion carried. Joint City /County Open Space Taxation Committee: Hawley explained to the Councilmembers that last year the Planning Whatcom County Council Minutes - January 16, 1986 Page 4 and Development Committee served on the Joint City /County Open Space Taxation Committee. HAWLEY MOVED TO NOMINATE THE MEMBERS OF THE PLANNING AND DEVELOPMENT COMMITTEE (BURTON, MUENSCHER AND JOHNSON) TO THE JOINT CITY /COUNTY OPEN SPACE TAXATION COMMITTEE. The motion carried. Fourth Corner Development Group: Hawley reported that Councilmembers Roehl, Hansey and Warner had all expressed interest in serving on the Fourth Corner Development Group. Roehl received two (2) votes; Hansey received two (2) votes; and Warner received one (1) vote. HAWLEY MOVED TO NOMINATE ROEHL, HANSEY AND WARNER TO SERVE ON THE FOURTH CORNER DEVELOPMENT GROUP. Councilmembers Roehl and Warner informed the Council members that they did not have strong feelings about serving on this group. Hansey expressed his desire to serve on the Fourth Corner Development Group. Councilmembers Roehl and Warner withdrew their names from the list of nominees. The motion carried;.Hansey was appointed.to the Fourth Corner Development Group. Alcoholism Administrative Board: Hawley reported that he has served for approximately five years on the Alcoholism Administrative Board and wishes to continue serving on the Board. HAWLEY MOVED TO NOMINATE HAWLEY TO SERVE AS A MEMBER OF THE ALCOHOLISM ADMINISTRATIVE BOARD. The motion carried. Developmental Disabilities Committee: Hawley reported that this is an optional appointment and that Councilmember Roehl has served as the liaison on the Developmental Disabilities Commit -. tee. Roehl had expressed his preference in serving on this committee again; he also explained in more detail about these "optional" appointments. 2 Whatcom County Council Minutes - January 16, 1986 Page 5 HAWLEY MOVED TO NOMINATE ROEHL TO SERVE AS LIAISON ON THE DEVELOPMENTAL DISABILITIES COMMITTEE. The motion carried. Mental Health /Drug Council members that no year and feels that_the committee. Councilmemb, to serve as the liaison tee. Abuse Committee: Hawley reported to the one had served on this committee last Council should be represented on this ar Warner stated that he would be willing on the Mental Health /Drug Abuse Commit- HAWLEY MOVED TO NOMINATE WARNER TO SERVE AS LIAISON ON THE MENTAL HEALTH /DRUG ABUSE COMMITTEE. The motion carried. Northwest Senior Services Committee: Hawley reported to the Council members that no one had served on this committee last year. Warner stressed the importance of Council representation on this committee. Burton stated that he would act as liaison on the Northwest Senior Services Committee. HAWLEY MOVED TO NOMINATE BURTON. AS LIAISON ON THE NORTHWEST SENIOR SERVICES COMMITTEE. The motion carried. Public Defense Advisory Committee: Hawley reported that Councilmember Roehl has served on this Committee in the past. Warner expressed an interest in serving on the Public Defense Advisory Committee. Hawley also reported that Roehl has received three (3) votes and Warner has received two (2) votes. HAWLEY MOVED TO NOMINATE WARNER TO SERVE ON THE PUBLIC DEFENSE ADVISORY COMMITTEE. The motion carried. Whatcom Transportation Authority: Hawley reported that Roehl has received three (3) votes; Warner received two (2) votes, and Johnson received one (1) vote. Warner withdrew his name from the list of nominations. Hansey explained the function of the Whatcom.-Transportation Authority. . J Whatcom County Council Minutes - January 16, 1986 Page 6 Roehl stated that he would be willing to serve on this committee. Warner stated that he would serve if he was appointed. HAWLEY MOVED TO NOMINATE ROEHL, WARNER AND JOHNSON TO SERVE ON THE WHATCOM TRANSPORTATION AUTHORITY COMMITTEE. The vote was taken; Roehl and Warner were appointed to-the Whatcom Transportation Authority Committee. Mount Baker Theatre Management and Operating Board: Hawley reported that Councilmember Roehl has served on this Board and Councilmember Roehl explained the function of the Mount Baker Theatre Management and Operating Board. HAWLEY MOVED TO NOMINATE ROEHL TO SERVE ON THE MOUNT BAKER THEATRE MANAGEMENT AND OPERATING BOARD. The motion carried. The meeting recessed at 8:18 p.m. The meeting reconvened at 8:25 p.m. Councilmember Hawley left the meeting•reom at this time. Executive Pro - Tempore: A rollcall vote was retaken for the nominated candidates: Councilmembers Hawley and Muenscher. Muenscher was appointed Executive Pro - tempore. EXECUTIVE ITEMS AN AGREEMENT FOR CONSTRUCTION. OPERATION AND MAINTENANCE OF PRE - TREATMENT FACILITIES FOR PRE - TREATMENT AND DISPOSAL OF LEACHATE AT THE FERNDALE WASTEWATER TREATMENT PLANT Executive Shirley Van Zanten requested that the Council hold this over until the next Committee of the Whole meeting as more time is needed for this issue. She stated that this request had been made at the prior Committee of the Whole meeting and it was agreed to hold this item over until the next Committee of the Whole Meeting. RESOLUTION IN THE MATTER OF SETTING A DATE FOR PUBLIC HEARING FOR DECLARING CERTAIN COUNTY OWNED PROPERTY SURPLUS PROPERTY PURSUANT TO RCW 36.34.020 N Whatcom County Council Minutes - January 16, 1986 Page 7 the agenda and that the minimum bid be changed from $10,000.00 to $5,000.00 on the mobile home which was declared surplus by the Parks Department. There was discussion on the matter pertaining to the minimum bid on the mobile home. HANSEY MOVED THAT WE AUTHORIZE THE REDUCTION OF THE MINIMUM BID TO $5,000.00 IN THE MATTER OF SETTING THE SURPLUS PROPERTY UNDER RESOLUTION 85 -44. The motion carried. EXECUTIVE REPORT Executive Van Zanten reported on the following items: 1. Newsrelease -- Executive Van Zanten distributed a copy of a newsrelease regarding receipt of.$22,000.00 from the Department of Ecology, under a new state program entitled the Flood Control Assistance Program. The state monies will be administered by the County's Engineering Department, with $17,000.00 earmarked for channel cleaning in Fishtrap Drainage Improvement District I. The remainder of the monies will go to the Swift Creek Association, and will also be used for channel cleaning. Executive Van Zanten stated that there were 172 flood control maintenance project applications and that 16 of the 85 projects approved are in Whatcom County. The County is providing a 50% matching contribution for each project. 2. Liability Reform Act -- Executive Van Zanten distributed a discussion draft of the Liability Reform Act for the Council's information. 3. Standards for Juvenile Facilities -- Executive Van Zanten distributed a copy of a draft bill on standards for juvenile facilities which will be introduced in the 1986 legisla- tive session. This is for the Council's information. 4. Recommendations of the Ad Hoc Committee for Nor -Bell Nursing Home -- Executive Van Zanten distributed copies of the Recommendations of the Ad Hoc Committee for Nor -Bell Nursing Home for the Council's review and further action. Muenscher left the meeting at this time. 5. Animal Control Contract with the Bellingham /Whatcom County Humane Society -- Executive Van Zanten explained the background on the Animal Control Contract with the Belling- ham /Whatcom County Humane Society and is requesting that the r Whatcom County Council Minutes - January 16, 1986 Page 8 Council meet to discuss the proposed changes in the Animal Control Contract. OPEN SESSION Chairman Roehl invited anyone from the audience to speak on county government. There was no response from the audience. FINAL CONSIDERATION OF ORDINANCES AND RESOLUTIONS AN ORDINANCE GRANTING A TWENTY -FIVE YEAR NON- EXCLUSIVE FRANCHISE TO SANDY POINT IMPROVEMENT COMPANY TO INSTALL, OPERATE AND MAINTAIN POTABLE WATER MAINS AND WATER DISTRIBUTION LINES ALONG CERTAIN ROADS IN WHATCOM COUNTY, WASHINGTON. Chairman Roehl reported that this ordinance was introduced at the January 2nd meeting of the Whatcom County Council and a public hearing.was. held at that time and a favorable response was received on the franchise. Chairman Roehl reported also that the Planning and Develop- ment Committee recommended approval of the.non- exclusive fran- chise to the Sandy Point Improvement Company for a period of twenty -five years, provided that no new information came out of the public hearing. WARNER MOVED TO ADOPT THE ORDINANCE GRANTING A TWENTY -FIVE YEAR NON - EXCLUSIVE FRANCHISE TO SANDY POINT IMPROVEMENT COMPANY TO INSTALL OPERATE AND MAINTAIN POTABLE WATER MAINS AND WATER DISTRIBUTION LINES ALONG CERTAIN ROADS IN WHATCOM COUNTY, WASHINGTON. The motion carried unanimously. (Absent: Johnson /Hawley/ Muenscher) OTHER BUSINES CONSIDERATION OF THE APPEAL TO REVIEW A DECISION OF THE HEARING EXAMINER REGARDING VARIANCE,-V-18-85, FILED BY ROBERT KIEL. HANSEY MOVED TO HOLD THE CONSIDERATION OF THE APPEAL TO REVIEW A DECISION OF THE HEARING EXAMINER REGARDING VARIANCE, V- 18 -85, FILED BY ROBERT KIEL OVER UNTIL THE NEXT COUNCIL MEETING. Councilmember Hansey reported that the Committee of the Whatcom County Council Minutes - January 16, 1986 Page 9 Whole met in Executive Session earlier in the evening regarding the Kiel appeal. The motion carried. CONSIDERATION OF THE APPEAL TO REVIEW A DECISION OF THE HEARING EXAMINER REGARDING SHORELINE PERMIT, S- 15 -85, FILED BY MARJORIE DICKEY WARNER MOVED THAT WE DENY THE APPEAL AND UPHOLD THE HEARING EXAMINER'S DECISION REGARDING SHORELINE PERMIT, S- 15 -85, FILED BY MARJORIE DICKEY. The motion carried. CONSIDERATION OF PLANNING COMMISSION'S RECOMMENDATIONS ON 1985 -C OPEN SPACE APPLICATIONS Councilmember Muenscher reported that the Planning and Development Committee have not reviewed the Open Space applica- tions from D. & E. Easterbrook and N. Christensen or the Timber Land applications of R. Barnholt and T. & D. Johnson. MUENSCHER MOVED THAT THE MATTER OF THE PLANNING COMMISSION'S RECOMMENDATIONS ON 1985 -C OPEN SPACE APPLICATIONS BE HELD OVER UNTIL THE NEXT COUNCIL MEETING. The motion carried. APPEAL TO REVIEW A DECISION OF THE HEARING EXAMINER REGARDING CONDITIONAL USE PERMIT, CU- 58 -85, FILED BY MICHAEL P. NUMRICH Chairman Roehl stated that this appeal would be filed until the record is complete. Hansey explained that this emergency ordinance had been discussed at the Committee of the Whole meeting which met earlier in the evening. Executive Van Zanten explained the background on this emergency ordinance for road improvements. Muenscher spoke to the motion. Warner spoke to the motion. The motion carried unanimously. Chairman Roehl thanked the members of the Council for the courtesy they have extended to him over the last year and looks forvraxdf to working with Councilmember Hansey next year.
