Minutes -- April 3, 1986
The Whatcom County Council meeting was called to order at
7:30 p.m. by Chairman Hansey with all members present.
MINUTES
The minutes of the March 20 Council meeting were approved
as written.
EXECUTIVE ITEMS
REQUEST FOR AUTHORIZATION TO SIGN AGREEMENT BY AND BETWEEN
WHATCOM COUNTY NOR -BELL AND THE WASHINGTON STATE COUNCIL
OF COUNTY AND CITY EMPLOYEES, AFL -CIO, AFSCME LOCAL 1581 -I
Executive Van Zanten explained the background on the agree-
ment by and between Whatcom County Nor- lb11 and the Washington State
Council of County and City Employees, AFL -CIO, AFSCME Local 1581 -I.
Roehl reported that the Finance Committee reviewed the
agreement and recommended approval.
ROEHL MOVED TO AUTHORIZE THE EXECUTIVE TO SIGN THE AGREEMENT
BY AND BETWEEN WHATCOM COUNTY NOR -BELL AND THE WASHINGTON STATE
COUNCIL OF COUNTY AND CITY EMPLOYEES, AFL -CIO, AFSCME LOCAL 1581 -I.
The motion carried.
REQUEST TO REJECT ALL BIDS RECEIVED FOR FAIRGROUNDS POWER
SYSTEM RENOVATION FOR THE NORTHWEST WASHINGTON FAIR
Executive Van Zanten explained the background on the request
to reject all bids received for the fairground power system renovation
for the Northwest Washington Fair, based on the Fair Board's recom-
mendation.
ROEHL MOVED THAT THE COUNCIL REJECT ALL BIDS RECEIVED FOR
THE FAIRGROUNDS POWER SYSTEM RENOVATION FOR THE NORTHWEST WASHINGTON
FAIR.
Roehl reported that the Finance Committee concurred with the
recommendation of the Fair Board that the bids be rejected.
The motion carried.
Executive Van Zanten requested that the rejection of another
bid be added to the agenda.'
REQUEST TO REJECT BID -- BARE BOAT CHARTER
Executive Van Zanten explained the background on the request
to reject the bid for providing ferry passenger service during
the drydocking of the "Whatcom Chief" in September.

Johnson reported that the Public Services Committee reviewed
the request to reject all bids for providing ferry passenger
service during the drydocking of the "Whatcom Chief" in September.
JOHNSON MOVED THAT THE COUNCIL REJECT ALL BIDS FOR PROVIDING
FERRY PASSENGER SERVICE DURING THE DRYDOCKING OF THE "WHATCOM
CHIEF" IN SEPTEMBER.
The motion carried.

ORDINANCE DEFINING, REGULATING AND LICENSING PEDDLERS
AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF AND
ADDING A NEW CHAPTER 5.53 TO THE WHATCOM COUNTY CODE
The public hearing was declared open.in the matter of the
ordinance defining, regulating and licensing peddlers and providing
penalties for the violation thereof and adding a new Chapter 5.53
to the Whatcom County Code.

Chairman Hansey clarified the difference between this ordin-
ance and the ordinance regarding solicitors.
There was discussion on the ordinance.

The public hearing was closed in the matter of the ordinance
defining, regulating and licensing peddlers and providing
penalties for the violation thereof and adding a new Chapter 5.53
to the Whatcom County Code.
Chairman Hansey stated that the Council would hear testimony
on the ordinance repealing Chapter 5.52 of the Whatcom County
Code entitled Solicitors.and Canvassers and adding a new
Chapter 5.51 entitled Solicitors and that the Council would then
consider the two ordinances simultaneously.

ENTITLED SOLICITORS AND CANVASSERS AND ADDING A NEW CHAPTER
5.51 ENTITLED SOLICITORS.
The public hearing was declared open in the matter of the
ordinance repealing Chapter 5.52 of the Whatcom County Code
entitled solicitors and canvassers and adding a new Chapter 5.51
entitlted Solicitors.

There was discussion on the ordinance.

The public hearing was closed.
Roehl reported that the Finance Committee discussed both
ordinances but made no recommendations on the ordinances.
ROEHL MOVED FOR FINAL ADOPTION OF THE ORDINANCE DEFINING,
REGULATING AND LICENSING PEDDLERS AND PROVIDING PENALTIES FOR THE
VIOLATION THEREOF AND ADDING A NEW CHAPTER 5.53 TO THE WHATCOM
COUNTY CODE AND FOR FINAL ADOPTION OF THE ORDINANCE REPEALING
CHAPTER 5.52 OF THE WHATCOM COUNTY CODE ENTITLED SOLICITORS AND
CANVASSERS AND ADDING A NEW CHAPTER 5.51 ENTITLED SOLICITORS.
Roehl explained the ordinances further.
JOHNSON MOVED TO AMEND THE ORDINANCE DEFINING, REGULATING
AND LICENSING PEDDLERS AND PROVIDING PENALTIES FOR THE VIOLATION
THEREOF AND ADDING A NEW CHAPTER 5.53 TO THE WHATCOM COUNTY CODE
WITH THE FOLLOWING:
Change the monthly fee on page 28,. line 16 to $5.00 per
month, and the annual license fee.be changed to $50.00
Chairman Hansey restated the motion.

There was discussion on the peddlers ordinance.

Chairman Hansey restated Johnson's motionto amend.
HAWLEY MOVED TO AMEND JOHNSON'S AMENDMENT BY STRIKING THE
$50.00 FIGURE AND INSERTING $25.00 IN ITS PLACE.
Chairman Hansey restated Hawley's motion to amend.
Hawley's motion•to amend failed.
Johnson's motion to amend failed.
Muenscher spoke against the peddlers ordinance. He spoke in
support of tabling the ordinance until a future date.
Roehl spoke against the ordinance.
Warner spoke against the ordinance as written.
The motion to adopt the ordinance defining, regulating and
licensing peddlers and providing penalties for the violation
thereof and adding a new Chapter 5.53 to the Whatcom County Code
failed.
ROEHL MOVED TO VOTE IMMEDIATELY ON THE SOLICITORS ORDINANCE.
The motion carried.
There was discussion on the motion to vote immediately.
WARNER MOVED TO RECONSIDER THE VOTE ON THE MOTION TO VOTE
IMMEDIATELY.
The motion to reconsider carried.
Roehl explained the solicitors ordinance.
The motion to adopt the ordinance repealing Chapter 5.52 of
the Whatcom County Code entitled solicitors and canvassers and
adding a new Chapter 5.51 entitled solicitors failed.

ORDINANCE REPEALING THE PLACING OF STOP SIGNS AT THE
INTERSECTION OF NORTH PASS ROAD AND MINAKER ROAD
The public hearing was declared open in the matter of the
ordinance repealing the placing of stop signs at the intersection
of North Pass Road and Minaker Road. There was no one present
to testify, and the public hearing was closed.
Johnson reported that the Public Services Committee recom-
mended that the Council concur with the Engineering Department's
recommendation to remove the stop signs at the intersection of
North Pass Road and Minaker Road.
JOHNSON MOVED FOR FINAL ADOPTION OF THE ORDINANCE REPEALING
THE PLACING OF STOP SIGNS AT THE INTERSECTION OF NORTH PASS ROAD
AND MINAKER ROAD.
The motion carried.
ORDINANCE_ ESTABLISHING MINIMUM STANDARDS FOR REQUIRED
F T RE FLOW
The public hearing was declared open in the matter of the
ordinance establishing minimum standards for required fire flow
for fire protection under Section 10.301(C) of the 1982 Edition
of the Uniform Fire Code as adopted by Whatcom County and amending
W.C.C. Sections 15.16.040 and 15.16.060 and Ordinance No. 84 -40.

There was no one else present to testify, and the public
hearing was closed.
Muenscher reported that the Planning and Development Committee
recommends that further work be done on this ordinance, and that
a nine - member Committee, including the three members of the Planning
and Development Committee, will be meeting to work on this
ordinance further.
The Council concurred that the Planning and Development
Committee should proceed to work with the nine - member committee
on this ordinance and report back to the Council at a later date.

DECLARING SURPLUS 25,000 CUBIC YARDS OF SCREENINGS
LOCATED AT THE ABEL PIT ON LAUREL ROAD
The public hearing�,was declared open in the matter of
declaring surplus 25,000 cubic yards of screenings located at,
the Abel Pit on Laurel Road. There was no one present to
testify and the hearing was closed.
ROEHL MOVED TO DECLARE SURPLUS 25,000 CUBIC YARDS OF
SCREENINGS LOCATED AT THE ABEL PIT ON LAUREL ROAD.
There was discussion on the motion.
The motion carried.
The meeting was recessed at 8:50 p.m. The meeting reconvened
at 9:00 p.m.
FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES
RESOLUTION OPPOSING SECTION 145 OF THE TAX REFORM ACT
OF 1985
Roehl reported that the Finance Committee recommended
do pass on the resolution opposing Section 145 of the Tax Reform
Act of 1985.
ROEHL MOVED FOR FINAL ADOPTION OF THE RESOLUTION OPPOSING
SECTION 145 OF THE TAX REFORM ACT OF 1985.
The motion carried.
ORDINANCE AMENDING ORDINANCE NO. 85 -94, AN ORDINANCE
RELATING TO AMENDING THE FINANCING OF RIVER IMPROVEMENTS
ROEHL MOVED FOR FINAL ADOPTION OF THE ORDINANCE AMENDING ORD-
INANCE NO. 85 -94, AN ORDINANCE RELATING TO AMENDING THE FINANCING
OF RIVER IMPROVEMENTS AS ESTABLISHED IN ORDINANCE 84 -59.
Roehl spoke to the motion and explained the background on
the ordinance.
There was discussion on the ordinance.
The motion carried.
ORDINANCE TO REVISE THE 1986 CONVENTION CENTER FUND BUDGET
ROEHL MOVED FOR FINAL ADOPTION OF THE ORDINANCE TO REVISE
THE 1986 CONVENTION CENTER FUND BUDGET.
Roehl reported that the Finance Committee recommends do
pass on the ordinance.

ORDINANCE TO REVISE THE 1986 COUNTY SUPPLY FUND BUDGET
ROEHL MOVED FOR FINAL ADOPTION OF THE ORDINANCE TO REVISE THE
1986 COUNTY SUPPLY FUND BUDGET.
Roehl reported that the Finance Committee recommends do
pass on the ordinance.

ORDINANCE REPEALING WHATCOM COUNTY CODE SECTION 2.40_.100
WHICH ADOPTS THE STATE PERSONNEL BOARD AS THE CIVIL SERVICE
COMMISSION FOR THE EMERGENCY SERVICES DEPARTMENT
Johnson reported that the Public Services Committee recommends
do pass on the ordinance. Johnson explained the ordinance.
JOHNSON MOVED FOR FINAL ADOPTION OF THE ORDINANCE REPEALING
WHATCOM COUNTY CODE SECTION 2.40.100 WHICH ADOPTS THE STATE
PERSONNEL BOARD AS THE CIVIL SERVICE COMMISSION FOR THE EMERGENCY
SERVICES DEPARTMENT.
The motion to adopt the ordinance carried.
OTHER BUSINESS
CONSIDERATION OF OPEN SPACE APPLICATIONS
Muenscher reported that this would be held in the Planning
and De *elopment and would come before the Council at a future
meeting.
CONSIDERATION OF BID PROPOSALS FOR THE OFFICIAL COUNTY
NEWSPAPER FOR THE PERIOD OF JULY 1, 1986 THROUGH JUNE 30. 1987
ROEHL MOVED THAT THE CONTRACT FOR PUBLICATION OF LEGAL
NOTICES BE AWARDED TO THE BELLINGHAM HERALD FOR THE PERIOD OF
JULY 1, 1986 THROUGH JUNE 30, 1987.
Roehl reported that the Finance Committee recommended
that the contract be awarded to the Bellingham Herald, the low
bidder.

There was discussion on the bid proposals for the official
County newspaper.
The motion to award the bid for the official County newspaper
to the Bellingham Herald for the period of July 1, 1986 through
June 30, 1987 carried.
CONSIDERATION OF COMPREHENSIVE INSURANCE COVERAGE FOR
WHATCOM COUNTY
Chairman Hansey stated that this item was continued from
the March 20th Council meeting.
Chairman Hansey stated that the matter before the Council
was whether or not to accept the proposal as it was presented
at the previous Council meeting.
Executive Van Zanten stated that the entire insurance
package as presented was still available to the County.
There was discussion on;the proposal.and on the County
Executive's action of binding the policy.
ROEHL MOVED THAT THE COUNCIL CONCUR IN THE ACTION OF THE
COUNTY EXECUTIVE IN BINDING THE POLICY.
