MINUTES The minutes of the following meetings were approved as written: Special Council meeting, March 13, 1986 Special Council meeting, March 27, 1986 Regular Council meeting, April 3, 1986 SPECIAL ORDER OF BUSINESS - PROCLAMATION Craig Cole spoke in support of the Council proclaiming the week of April 19 -27 as Spring Rally Week in Whatcom County. With the consent of the Council., Chairman Hansey proclaimed the week of April 19 -27 as Spring Rally Week in Whatcom County. EXECUTIVE ITEMS OVERLIMIT TRANSFER - DEVELOPMENTAL DISABILITIES FUND Tom Sutberry, Budget Director, explained the background on the request for an overlimit transfer in the Developmental Disabilities Fund in the amount of $18,510.00. Roehl reported that the Finance Committee recommended approval of the overlimit transfer. ROEHL MOVED TO APPROVE THE OVERLIMIT TRANSFER IN THE DEVELOPMENTAL DISABILITIES FUND IN THE AMOUNT OF $18,510.00. The motion carried. OVERLIMIT TRANSFER - COUNTY PARK FUND (SENIORS) Tom Sutberry explained the background on the request for an overlimit transfer in the County Park Fund (Seniors) in the amount of $5,000.00. Roehl reported that the Finance Committee recommended approval of the overlimit transfer. Whatcom County Council Minutes April 17, 1986 Page 2 ROEHL MOVED TO APPROVE THE OVERLIMIT TRANSFER IN THE COUNTY PARK FUND (SENIORS) IN THE AMOUNT OF $5,000.00. The motion carried. OVERLIMIT TRANSFER - TORT CLAIMS FUND Tom Sutberry explained the background on the request for an overlimit transfer in the Tort Claims Fund in the amount of $80,340.00. Roehl reported that the Finance Committee recommended approval of overlimit transfer. ROEHL MOVED TO APPROVE THE OVERLIMIT TRANSFER IN THE TORT CLAIMS FUND IN THE AMOUNT OF $80,340.00. The motion carried. REQUEST FOR AUTHORIZATION FOR ADMINISTRATIVE SERVICES ONLY AGREEMENT WITH WHATCOM MEDICAL BUREAU Tom Sutberry explained the background on the request for authorization to enter into an administrative services only agreement with Whatcom Medical Bureau. Roehl reported that the Finance Committee recommended approval of the request to enter into an administrative services only agreement with Whatcom Medical Bureau. ROEHL MOVED TO APPROVE THE REQUEST FOR AUTHORIZATION TO ENTER INTO AN ADMINISTRATIVE SERVICES ONLY AGREEMENT WITH WHATCOM MEDICAL BUREAU. Roehl spoke to the motion. There was discussion on the motion. The motion carried. OPEN SESSION Neil Clement KGMI News Director Spoke against the Council holding Emergency Meetings regarding tort claims settlements; stated that the public needs to know what is going on with the taxpayers' money. T NGS PETITION FOR LOT LINE VACATION, LAWSON The public hearing was declared open in the matter of the petition for lot line vacation between lots 4 and 5, Division 19, in the Plat of Sudden Valley, filed by Mr. and Mrs. Orville Lawson. There was no one present to speak, and the public hearing was closed. Muenscher reported that the Planning and Development Committee recommended approval of the petition. MUENSCHER MOVED TO APPROVE THE PETITION FOR LOT LINE VACATION BETWEEN LOTS 4 AND 5, DIVISION 19, IN THE PLAT OF SUDDEN VALLEY FILED BY MR. AND MRS. ORVILLE LAWSON. The motion carried. FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES RESOLUTION - VACATIONS FOR COURT REPORTERS AND COURT COMMISSIONER OF SUPERIOR COURT The resolution in the matter of vacations for the court reporters and the court commissioner of the Superior Court for Whatcom County was held in the Finance Committee. ORDINANCE ADOPTING AND AMENDING TITLE 20, CHUCKANUT -LAKE SAMISH SUBAREA ORDINANCE AMENDING THE 1970 WHATCOM COUNTY COMPREHENSIVE PLAN TEXT AND MAP. CHU K NUT -LAKE SAMISH SUBAREA WARNER MOVED FOR FINAL ADOPTION OF THE FOLLOWING ORDINANCES: ORDINANCE ADOPTING AND AMENDING TITLE 20, THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, FOR THE GEOGRAPHIC AREA KNOWN AS THE CHUCKANUT -LAKE SAMISH SUBAREA OF WHATCOM COUNTY ORDINANCE AMENDING THE 1970 WHATCOM COUNTY COMPREHENSIVE PLAN TEXT AND MAP FOR THE GEOGRAPHIC AREA KNOWN AS THE CHUCKANUT- LAKE SAMISH SUBAREA OF WHATCOM COUNTY. WARNER MOVED TO AMEND THE ORDINANCES WITH THE FOLLOWING: AMEND THE LEGEND ON THE ATTACHED MAP BY LEAVING IN #1, (TOURIST COMMERCIAL AREA IN 1972 PLAN NOT IN PROPOSED PLAN) OMITTING #2, (TOURIST COMMERCIAL AREA PROPOSED- HASKELL), OMITTING #3, (TOURIST COMMERCIAL AREA PROPOSED - LANE), AND LEAVING IN #4, (NEIGHBORHOOD COMMERCIAL AREA PROPOSED -PIRA AND ROONEY). Whatcom County Council Minutes April 17, 1986 Page 4 Chairman Hansey restated Warner's motion to amend. There was discussion on Warner's motion to amend. Hawley spoke against the motion to amend. ROEHI, MOVED TO AMEND WARNER'S AMENDMENT WITH THE FOLLOWING: TO INCLUDE ONLY THE SOUTHERN PORTION, SOUTH OF THE COUNTY ROAD AS TOURIST COMMERCIAL, AND EXTEND THAT AREA DOWN TO THE INTERSECTION BETWEEN SAMISH WAY AND THE FREEWAY. ( #1) Roehl spoke to the motion. Chairman Hansey restated Roehl's amendment. There was discussion on Roehl's motion to amend. Roehl's motion to amend carried. Chairman Hansey restated Warner's motion to amend, as amended by Roehl's motion. Roehl spoke in support of Warner's motion, as amended. Chairman Hansey stated that with the consent of the Council, each portion of Warner's motion would be voted on individually. Johnson spoke against Warner's motion to amend. Hawley spoke against Warner's motion to amend. There was further discussion on Warner's motion to amend. The motion to reestablish a portion of legend item #1 into the ordinance carried. The motion to delete the establishment of a Tourist Commercial Area (legend item #2) carried. The motion to delete the establishment of a Tourist Commercial Area (legend item #3) failed. ROEHL MOVED TO AMEND THE ORDINANCES BY CHANGING ITEM #4 OF THE LEGEND TO THE SAME ZONE AS THE SURROUNDING AREA. Chairman Hansey restated Roehl's motion to amend. There was discussion on Roehl's motion to amend. The motion to amend failed. Whatcom County Council Minutes April 17, 1986 Page 5 The meeting was recessed at 8:50 p.m. The meeting reconvened at 9:00 p.m. Chairman Hansey stated that the motion before the Council was for final consideration of both ordinances as amended. Roehl spoke in support of waiting until a subsequent meeting to vote, when all Councilmembers could be present. The motion to adopt the ordinance adopting and amending Title 20, the Official Whatcom County Zoning Ordinance for the geographic area known as the Chuckanut -Lake Samish subarea of Whatcom County failed (3 -3, Muenscher, Warner, Roehl). The motion to adopt the ordinance amending the 1970 Whatcom County Comprehensive Plan Text and Map for the geographic area known as the Chuckanut -Lake Samish subarea of Whatcom County failed (3 -3, Muenscher, Warner, Roehl). ROEHL MOVED TO RECONSIDER THE VOTE ON THE ORDINANCE ADOPTING AND AMENDING TITLE 20, THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE FOR THE GEOGRAPHIC AREA KNOWN AS THE CHUCKANUT -LAKE SAMISH SUBAREA OF WHATCOM COUNTY. The motion to reconsider carried. ROEHL MOVED TO DEFER ACTION ON THIS ORDINANCE, AS AMENDED, TO THE MAY 1, 1986 COUNCIL MEETING. The motion carried. ROEHL MOVED TO RECONSIDER THE VOTE ON THE ORDINANCE AMENDING THE 1970 WHATCOM COUNTY COMPREHENSIVE PLAN TEXT AND MAP FOR THE GEOGRAPHIC AREA KNOWN AS THE CHUCKANUT -LAKE SAMISH SUBAREA OF WHATCOM COUNTY. The motion to reconsider carried. ROEHL MOVED TO DEFER ACTION ON THIS ORDINANCE, AS AMENDED, TO THE MAY 1, 1986 COUNCIL MEETING. The motion carried. OTHER BUSINESS APPEAL FILED BY RON KAALAND. V. 3 -86 The appeal filed by Ron Kaalandin the matter of the Hearing Examiner's decision of Variance 3 -86 was received by consent and placed on file until the transcript and record are filed in the Council office. DELBERT WOLF The application filed by Mr. and Mrs. Delbert Wolf for open space classification was received by consent and referred to the Planning Commission. INTRODUCTION OF RESOLUTIONS AND ORDINANCES RESOLUTION. CANCELLATION OF WARRANTS OVER ONE YEAR OLD ROEHL MOVED TO INTRODUCE AND ADOPT THE RESOLUTION IN THE MATTER OF CANCELLATION OF WARRANTS OVER ONE YEAR OLD IN ACCOR- DANCE WITH THE PROVISIONS OF R.C.W. 36.22.100. Roehl stated that the Finance Committee recommended approval of the resolution. The motion carried. RESOLUTION, AMENDING SALARY SCHEDULE FOR UNREPRESENTED EMPLOYEES. NOR -BELL NURSING HOME. FOR YEAR 1986 ROEHL MOVED TO INTRODUCE AND ADOPT THE RESOLUTION IN THE MATTER OF AMENDING THE SALARY SCHEDULE FOR THE UNREPRESENTED EMPLOYEES OF NOR -BELL NURSING HOME FOR THE YEAR 1986. Roehl stated that the Finance Committee recommended approval of the resolution. Roehl spoke to the motion. The motion carried. RESOLUTION CONTRACT FOR CONSULTING SERVICES G.H.R. & ASSOCIATES. STORM DRAINAGE PROJECT. CLI FSIDE SUBDIVISION MUENSCHER MOVED TO INTRODUCE AND ADOPT THE RESOLUTION AUTHORIZING THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACT FOR CONSULTING SERVICES WITH G.H.R. & ASSOCIATES FOR THE PURPOSE OF DESIGN AND SUPERVISION OF CONSTRUCTION OF STORM DRAINAGE PROJECT LOCATED AT CLIFFSIDE SUBDIVISION SOUTH OF MARINE DRIVE IN THE UNINCORPORATED AREA OF WHATCOM COUNTY, WITH THE INSERTION OF THE AMOUNT OF $26,000.00 ON LINE 28 OF THE RESOLUTION. There was discussion on the motion. The motion carried. Whatcom County Council Minutes April 17, 1986 Page 7 ORDINANCE AMENDING ORDINANCE NO. 82 -30 AND 83 -37 REESTABLISHING PRECINCT BOUNDARIE REAT N NEW 'PRECINCTS The ordinance amending Ordinance No. 82 -30 and 83 -37, reestablishing the boundaries of Geneva Precinct, Ten Mile 2 and Van Wyck 1 Precincts, Lynden Township 1, Lynden Township 4 Precincts and creating new precincts of Geneva 2, Ten Mile 5, Van Wyck 4 and combining Lynden Township 1 and Lynden Township 4 into Lynden Township 1 was introduced by consent and referred to the Public Services Committee. REPORTS FROM COUNCILMEMBERS Roehl reported on a motion from the Finance Committee regarding Budget Proviso (T) relating to the ferry rate study. He reported that the County had entered into a contract with the Council of Governments for the study. There was discussion on Budget Proviso (T). ROEHL MOVED THAT THE COUNCIL REQUEST THE COUNCIL OF GOVERNMENTS TO INTERPRET THE LANGUAGE OF BUDGET PROVISO (T) IN ITS BROADEST SENSE. There was further discussion on the motion. The motion carried. Warner spoke in support of the Councilmembers having a retreat on a Saturday in order to discuss issues and philosophies relating to County government. Johnson spoke in support of holding it on a Tuesday or Wednesday at the County Courthouse. Muenscher spoke in support of holding a retreat. ROEHL MOVED THAT WARNER AND MUENSCHER BE IN CHARGE OF PLANNING A RETREAT PROPOSAL FOR THE COUNCIL TO CONSIDER. The motion carried.
