HomeMy WebLinkAboutSpecial Council November 24 1987WHATCOM COUNTY COUNCIL SPECIAL MEETING November 24, 1987 The meeting was called to order at 7:05 p.m. by Council Chair Burton with Hansey, Hawley, Johnson, Muenscher, Roehl and Warner present. FINAL CONSIDERATION OF RESOLUJIONS AND ORDINANCES RESOLUTION ADOPTING THE SIX-YEAR PHYSICAL PLANT AND FACILITIES CAPITAL IMPROVEMENT PROGRAM RELATING TO BUILDINGS AND FACILITIES FOR WHATCOM CQUNTY, LdASHINGTQN Warner explained the resolution and reported that the Finance Committee recommended its approval. WARNER MOVED TO APPROVE THE RESOLUTION. The motion carried. RESOLUTION ADOPTING THE WHATCOM COUNTY 1988 ROAD CONSTRUCTION PROQRAM Johnson reported that the Public Services Committee recommended approval of the resolution, with one amendment concerning the Haynie Road project. JOHNSON MOVED TO APPROVE THE RESOLUTION WITH THE AMENDMENT THAT THE DOLLAR AMOUNT OF ITEM NUMBER 8 OF ALTERNATE PROJECTS, THE HAYNIE ROAD, BE AMENDED TO $10,000, TO BE DIVIDED EQUALLY INTO PRELIMINARY ENGINEERING AND RIGHT -OF -WAY, AND THAT THIS PROJECT BE ADDED TO THE FUNDED PORTION OF THE ONE -YEAR ROAD PROGRAM AS ITEM NUMBER 20, REDUCING ITEM NUMBER 17 BY $10,000 AND RENUMBERING ITEMS 9 THROUGH 15 OF THE ALTERNATE PROGRAM TO ONE LOWER NUMBER, ACCORDINGLY. There was discussion about the concerns of residents of the West Pole Road about the project proposed for that road. HANSEY MOVED TO AMEND THE RESOLUTION BY ADDING, AT LINE 20, "BE IT FURTHER RESOLVED THAT THE COUNTY SHALL CONSIDER THE EXPRESSED CONCERNS OF THE RESIDENTS OF THE POLE ROAD CONSTRUCTION PROJECT AREA IN PROCEEDING WITH THE PROJECT." The motion to amend carried. The main motion to approve the resolution as amended carried. November 24, 1987 Page 2 RESOLUTION IN THE MATTER OF ADOPTING A SALARY SCHEDULE FOR IH UNREPRESENTED WHATCOM COUNTY EMPLOYEES FOR THE YEAR J988 Warner reported that the Finance Committee recommended approval of the resolution with three recommended amendments, which were: a. That the Executive be given authority to offer an applicant for the Deputy Administrator, Buildings and Codes Administration up to $3200 /mo. b. That the Executive be given authority to offer an applicant for the Superior Court Clerk's position up to $2,942/mo. C. That the two unrepresented Sheriff's Deputies (the Undersheriff and Chief Criminal Deputy) have their pay keyed, like other exempt employees, to the Inside Employees' contract. WARNER MOVED TO APPROVE THE RESOLUTION WITH THE THREE AMENDMENTS. There was discussion on the motion. ROEHL MOVED TO AMEND THE MOTION TO SPECIFY THAT THE TWO SHERIFF'S DEPUTY POSITIONS BE TIED TO THE SHERIFF'S COLLECTIVE BARGAINING UNIT, RETROACTIVE TO THE FIRST OF THE YEAR. There was discussion on the motion to amend. The motion to amend failed. The main motion carried. RESOLUTION IN THE MATTER OF ADOPTING THE SALARY SCHEDULE FOR THE UNREPRESENTED EMPLOYEES OF NOR -BELL NURSING HOME FOR THE YEAR 1988 Warner reported that the Finance Committee recommended approval of the resolution. WARNER MOVED TO APPROVE THE RESOLUTION. The motion carried. Warner reported that the Finance Committee recommended approval of the resolution. November 24, 1987 Page 3 WARNER MOVED TO APPROVE THE RESOLUTION. There was discussion on the motion. The motion carried. SUBSTITUTE ORDINANCE IN THE MATTER OF ESTABLISHING A DEPARTMENT OF COMBINED TREATMENT SERVICES AND REPEALING WHATCOM COUNTY CODE 2.18 AND 2.46 Consideration of this ordinance had been continued from the Council meeting of November 19, 1987. WARNER MOVED TO ADOPT THE ORDINANCE. HANSEY MOVED TO AMEND THE ORDINANCE ON PAGE 3, LINE 13, BY INSERTING THE WORDS "NOT LESS THAN" AT THE BEGINNING OF THE SENTENCE WHICH STATED ItTWO PERCENT OF WHATCOM COUNTYtS SHARE OF LIQUOR PROFITS AND TAXES . 11 SO THAT THE SENTENCE WOULD READ "NOT LESS THAN TWO PERCENT OF WHATCOM COUNTY'S SHARE . ." The motion to amend carried. HANSEY MOVED TO AMEND THE ORDINANCE ON PAGE 1, LINE 28 112, BY SUBSTITUTING THE WORD "SUBSTANCE" FOR THE WORD "DRUG" ON THAT LINE, SO THAT THE SENTENCE WOULD READ "THE WHATCOM COUNTY ALCOHOLISM /SUBSTANCE ABUSE BOARD . . ." The motion to amend carried. Warner explained the issues surrounding the ordinance, and reported that the Finance Committee recommended its adoption. There was further discussion about the ordinance. The motion to adopt the ordinance as amended carried 6 -1 (Hawley). The meeting was recessed at 8 :25 p.m. and reconvened at 8 :35 p.m. ORDINANCE IN THE MATTER OF THE ADOPTION OF THE FINAL BUDGET OF WHATCOM COUNTY FOR THE YEAR 1988 AND RESTRICTING THE EXPENDITURE OF CERTAIN FUNDS THEREIN WARNER MOVED TO ADOPT THE ORDINANCE. WARNER MOVED TO AMEND THE ORDINANCE BY DELETING THE SENTENCE IN PROVISO F ON PAGE 4 WHICH READ "NO MONIES SHALL BE EXPENDED FOR REPLACEMENT PERSONNEL IN ELECTIONS UNTIL SUCH MANAGEMENT AUDIT HAS BEEN COMPLETED AND REVIEWED BY THE COUNCIL." November 24, 1987 Page 4 There was discussion on the amendment. MUENSCHER MOVED TO AMEND THE ORDINANCE BY STRIKING THE SENTENCE ON PAGE 4, SUB -ITEM F, REPLACING THE PERIOD WITH A COMMA, AND ADDING "AN AMOUNT EQUAL TO THE POSITION TO BE VACATED BE ADDED TO THE EXTRA HELP COLUMN UNTIL THE REVIEW IS COMPLETED." There was discussion on both motions to amend. Muenscher's motion to amend failed 3 -4 (Hawley, Johnson, Roehl, Warner). There was further discussion on Warner's motion to amend. Warner's motion to amend failed 3 -4 (Burton, Hansey, Muenscher, Roehl). WARNER MOVED TO AMEND THE ORDINANCE BY ADDING THE WORD "PERMANENT" IN FRONT OF THE WORD "REPLACEMENT" IN THE SENTENCE IN QUESTION, SO THAT IT WOULD READ, "NO MONIES SHALL BE EXPENDED FOR PERMANENT REPLACEMENT PERSONNEL IN ELECTIONS UNTIL SUCH MANAGEMENT AUDIT HAS BEEN COMPLETED AND REVIEWED BY THE COUNCIL." The motion to amend carried unanimously. HAWLEY MOVED TO AMEND THE ORDINANCE BY SPECIFYING THAT "THE AUDITOR" RATHER THAN "THE EXECUTIVE" SHALL UNDERTAKE A JOB AUDIT. ROEHL MOVED TO SUBSTITUTE AN AMENDMENT TO DELETE "EXECUTIVE" AND SUBSTITUTE "THE PERSONNEL DEPARTMENT IN COOPERATION WITH THE AUDITOR," SO THAT THE SENTENCE ON LINE SEVEN OF PAGE 4 WOULD READ "THE PERSONNEL DEPARTMENT, IN COOPERATION WITH THE AUDITOR, SHALL UNDERTAKE A JOB AUDIT . . . " The substitute motion to amend carried unanimously. HAWLEY MOVED TO STRIKE THE STATEMENT THAT "THE AUDITOR IS PROHIBITED FROM EXPENDING ANY SUMS THAT INCREASE THE SCOPE OF DISTRIBUTION OF VOTERS' PAMPHLETS BEYOND THAT LEVEL REQUIRED IN 1986." There was discussion on the amendment. The motion to amend failed 2 -5 ( Hansey, Johnson, Muenscher, Roehl, Warner). Hawley stated for the record that under the provisions of RCW 42.23.040 his wife's employment with the County did not create a conflict of interest and he would vote on the budget. November 24, 1987 Page 5 ROEHL MOVED TO AMEND THE ORDINANCE BY ADDING $22,488 PLUS BENEFITS TO THE PUBLIC DEFENDER'S BUDGET FOR ANOTHER STAFF ATTORNEY. There was discussion on the amendment. The motion to amend failed 3 -4 (Hansey, Johnson, Muenscher, Warner). HANSEY MOVED TO AMEND PAGE 4, PROVISION I OF THE ORDINANCE BY ADDING THE WORDS " , AND PROVIDED FURTHER THAT THE POSITION WILL NOT BE FILLED UNTIL A DECRIMINALIZATION ORDINANCE OF SELECTED MISDEMEANORS IS PRESENTED TO THE COUNCIL FOR CONSIDERATION." The motion to amend carried unanimously. The main motion to adopt the ordinance as amended carried unanimously. ORDINANCE AUTHORIZING THE LEVY OF TAXES FOR COUNTY AND S,TA,T PURPOSES IN WHATCOM COUNTY, WASHINGTON FOR THE YEAR OF 1988 PURSUANT TO HOME RULE CHARTER SECTION 6.10 Warner reported that the Finance Committee recommended adoption of the ordinance. WARNER MOVED TO ADOPT THE ORDINANCE. The motion carried unanimously.
