HomeMy WebLinkAboutPublic Services November 19 1987WHATCOM COUNTY COUNCIL PUBLIC SERVICES COMMITTEE November 19, 1987 The meeting was called to order at 6 :00 p.m. by Committee Chair Johnson with Hansey present. Hawley arrived at 6 :30 p.m. Also present were Council members Burton and Warner; Paul Rushing and Ed Henken, Public Works; Ed Henken, Engineering; John Anderson; Hamilton Dutcher; and several citizens concerned about the proposed litter control ordinance. ORDINANCE CREATING WHATCOM COUNTY IMPROVEMENT DISTRICT NO, 3 FOR STREET LIGHTING MAINTENANCE IN THE AREA KNOWN AS EMERALD LAKE IN WHATCOM COUNTY, WASHINGTON Ed Henken reported that of the ballots returned, 109 were in favor of the formation of the district and 55 were against it. HANSEY MOVED TO RECOMMEND ADOPTION OF THE ORDINANCE. The motion carried. RESOLUTION ADOPTING THE WHATCOM COUNTY 1988 ROAD CONSTRUCTION PROGRAM Ed Henken distributed and discussed an amendment proposed by Council Chair Burton to the Road Program. The amendment was that the dollar amount of item number 8 of alternate projects, the Haynie Road, be amended to $10,000, to be divided equally into preliminary engineering and right -of -way, and that the project be added to the funded portion of the One -Year Road Program as item number 20, reducing item number 17 by $10,000 and renumbering items 9 through 15 of the alternate program to one lower number, accordingly. There was discussion about the amendment. HANSEY MOVED TO RECOMMEND APPROVAL OF THE AMENDMENT TO DIVERT THE $10,000 AS STATED BY THE ENGINEER. The motion carried. Henken also explained some of the concerns of Pole Road residents about the project involving that road. November 19, 1987 Page 2 ORDINANCE AMENDING ORDINANCE 85 -3, AN ORDINANCE ESTABLISHING THE OFFICE OF THE COUNTY FIRE MARSHAL AS A FUNCTION OF THE DEPARTMENT OF PUBLIC WORKS AND PROVIDING FOR ARSON AND FIRE INVESTIGATION AS A FUNCTION OF THE SHERIFF'S DEPARTMENT AMENDING WHATCOM COUNTY CODE CHAPTER 2.04, SECTION 2.04.020A,- AND REPEALING SECTION 2, PARAGRAPHS 6, 7,, 8 AND 9 Paul Rushing explained the ordinance. HANSEY MOVED TO RECOMMEND ADOPTION OF THE ORDINANCE. The motion carried. RESOLUTION ADOPTING THE SIX -YEAR PHYSICAL PLANT AND FACILITIES CAPITAL IMPROVEMENT PROGRAM RELATING TO BUILDINGS AND FACILITIES FOR WHATCOM COUNTY, WASHINGTON RESOLUTION ADOPTING THE WHATCOM COUNTY 1988 ROAD CONSTRUCTION PROGRAM HANSEY MOVED TO RECOMMEND APPROVAL OF THE RESOLUTIONS, SUBJECT TO THE OUTCOME OF THE PUBLIC HEARING ON THE ROAD PROGRAM. The motion carried. ORDINANCE IN THE MATTER OF AMENDING ORDINANCE 87 -24, AN ORDINANCE ESTABLISHING LITTER CONTROL WITHIN THE UNINCORPORATED AREAS OF WHATCOM COUNTY AND PROHIBITING UNLAWFUL DEPOSIT OF REFUSE ON PUBLIC AND PRIVATE RIGHTS -OF -WAY AND EASEMENTS_,, AMENDING SECTION 2E AND ADDING A NEW PARAGRAPH TO SECTION 8 This ordinance had been referred back to the Committee from the Council for further study. John Anderson presented a petition to the Committee which stated that the language of the ordinance was too broad, too vague, and would define vehicles having historical value as a public nuisance. Public Works Director Rushing explained the problems which had led his department to draft the ordinance, and there was further discussion. The Committee agreed to hold the ordinance in committee and to ask other counties for copies of their ordinances dealing with this issue.
