HomeMy WebLinkAboutPlanning and Development March 18 1987WHATCOM COUNTY COUNCIL PLANNING AND DEVELOPMENT COMMITTEE March 18, 1987 The meeting was called to order'by Committee Chair Muenscher at 2:03 p.m. with all Committee members present. Also present were Council Chair Tom Burton; Dan Taylor, Planning Department; Roger DeSpain, Parks Department; Wayne Schwandt, Fourth Corner Development Group; and Neil Clements, KGMI. ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY SHORELINE MANAGEMENT PROGRAM, FOR THE CHERRY P0INT AREA Planning Director Dan Taylor explained some minor changes which had already been made to the basic document. (1) He then explained the recommended changes outlined in a memo he distributed to the Committee members. The first change dealt with a recommendation to change a statement on Page 4 of the amendments, dealing with public access, and to pass an accompanying motion. There was considerable discussion on that recommendation. WARNER MOVED TO RECOMMEND THAT THE LAST PARAGRAPH UNDER SUBSECTION 3F ON PAGE 4, THE POLICY ON PUBLIC ACCESS, BE CHANGED TO READ, "THE PARKS AND RECREATION BOARD OF WHATCOM COUNTY SHOULD PREPARE A CHERRY POINT SHORELINE ACCESS PLAN TO BE APPROVED BY THE WHATCOM COUNTY COUNCIL. THIS PLAN SHOULD BE BASED ON THE 1976 'MARINE SHORELINES STUDY OF PUBLIC ACCESS AND RECREATION SITES IN WHATCOM COUNTY. "'; AND, TO RECOMMEND THAT THE COUNCIL REQUEST THE PARK AND RECREATION BOARD TO PREPARE A CHERRY POINT SHORELINE ACCESS PLAN TO BE ADOPTED BY THE COUNTY COUNCIL. THIS PLAN SHOULD UTILIZE THE 1976 "MARINE SHORELINES STUDY OF PUBLIC ACCESS AND RECREATION SITES IN WHATCOM COUNTY" AS A STARTING POINT. SPECIFICALLY EVALUATION SHOULD BE MADE OF A POTENTIAL POINT WHITEHORN BEACH ACCESS OR VIEW AREA, AN ACCESS OR VIEW AREA AT THE JUNCTION OF ALDERGROVE ROAD AND POINT WHITEHORN ROAD, ACQUISITION AND POSSIBLE DEVELOPMENT OF THE ACCRETION SHOREFORM AREA NEAR GULF ROAD, AND CONSTRUCTION OF THE CHERRY POINT LINKAGE FOR THE PACIFIC COAST BICYCLE ROUTE. THE BOARD SHOULD DETERMINE BASIC QUESTIONS SUCH AS: WHETHER THE EMPHASIS SHOULD BE ON THESE AREAS ONLY OR WHETHER ADDITIONAL BEACH ACCESS ON PRIVATE PROPERTY SUBJECT TO THE DEVELOPERS' DESIRE SHOULD BE ENCOURAGED; AND WHETHER THE ACCRETION SHOREFORM SHOULD REMAIN IN PRIVATE OWNERSHIP, BECOME THE PROPERTY OF A STATE AGENCY, OR BE A FORMAL PART OF THE WHATCOM COUNTY PARK SYSTEM. THE PLAN SHOULD INCLUDE PRELIMINARY SITE PLANS, PRELIMINARY COST ESTIMATES AND IMPLEMENTATION AND FUNDING STRATEGIES. THE PLAN IS NOT EXPECTED TO BE A REGULATORY DOCUMENT, BUT THE BOARD SHOULD FEEL FREE TO REQUEST ASSISTANCE FROM THE PLANNING DEPARTMENT AND BUREAU OF BUILDING AND CODES AS MAY BE NEEDED. IT IS REQUESTED THAT THE PROPOSED PLAN BE COMPLETED AND AVAILABLE FOR COUNCIL CONSIDERATION BY JUNE 10, 1987. March 18, 1987 Page 2 There was discussion on the motion. The motion carried. (2) The next recommended change dealt with the addition of language to clarify the ability of the County to develop public access recreational facilities in the accretion shoreform area. WARNER MOVED TO RECOMMEND THAT ON PAGE 5, SUBSECTION 3G(7), THE POLICY ON THE ACCRETION SHOREFORM, THE FOLLOWING LANGUAGE BE ADDED: 11. . . OTHER THAN RECREATION DEVELOPMENT FOR PUBLIC AND QUASI- PUBLIC SHORELINE ACCESS, SUBJECT TO THE REGULATIONS IN THIS SECTION AND CONSISTENT WITH THE CONSERVANCY AND AQUATIC SHORELINE DESIGNATION POLICIES AND REGULATIONS OF SECTION 6.14.11 There was discussion on the motion. The motion carried. 3. Taylor withdrew a recommendation to change language on p. 11, subsection 5C(7). 4. The next recommendation was to change the distance from the property corner to the beginning of the accretion shoreform from 3501 to 5041, and to set the northern boundary of the accretion shoreform at 1221 from the center of the creek. JOHNSON MOVED TO CHANGE APPENDIX E, ESTABLISHING THE DISTANCE FROM THE PROPERTY CORNER TO THE BEGINNING OF THE ACCRETION SHOREFORRM FROM 350' TO 5041, AND TO SET THE NORTHERN BOUNDARY OF THE ACCRETION SHOREFORM AT 1221 FROM THE CENTER OF THE CREEK. There was discussion on the motion. The motion carried. Taylor then explained that the Council should at this time pass a motion of intent to adopt the amendments, rather than actually adopt the ordinance, so that in the event of further changes publication would not be required again. He said that the amendments would then be sent to the Department of Ecology, which would hold a hearing and then approve, reject, or attempt to negotiate changes to them. This process was expected to take from 70 -90 days, after which the amendments would again be before the Council for formal adoption by ordinance. PLANNING COMMISSION RECOMMENDATION REGARDING OPEN SPACE /TIMBERLAND APPLICATION OF MARK ANDERSON Taylor explained that the Planning Commission had recommended denial of the application because the applicant did not wish to allow public access to the property. PETITION TO ALTER THE PLAT OF ELDEAN PARK, FILED BY CONNIE BOYER The Committee reviewed the reports from Building and Codes and Engineering on the petition. JOHNSON MOVED TO RECOMMEND APPROVAL OF THE PETITION WITH THE CONDITIONS OUTLINED IN THE LETTER FROM DONOVAN KEHRER (BUILDING AND CODES). The motion carried.
