September 3, 1987
The meeting was called to order at 7:30 p.m. by Council
Chair Burton with Hansey, Hawley, Johnson, Roehl and Warner
present. Muenscher arrived at 7:35 p.m.

The minutes of the Council meeting of August 20, 1987 and
the Committee of the Whole meeting of August 27, 1987 were
approved.

REQUEST R AUTHORIZAIIQN 10 JQIN IN WASHINGTQN.STAIE SSOC
OF COUNTIES LIABILITX INSURANCE POOLING PROJECT
Executive Van Zanten explained the Washington State
Association of Counties' request for a written commitment to
participate in the WSAC liability insurance pooling project,
including a financial contribution to fund the study.
Warner reported that the Finance Committee recommended
authorizing the Executive to sign the written commitment.
WARNER MOVED TO AUTHORIZE THE EXECUTIVE TO COMMIT THE COUNTY
TO CONTRIBUTE $4,250 TO THE LIABILITY INSURANCE POOLING PROJECT.
There was discussion on the motion.
The motion carried.
REPQRT OF THE EXECUTIVE
The Executive distributed and briefly discussed the
following documents:
1. A memo from the Planning Manager of the City of Bellingham
concerning new street names in the area of the Bellis Fair
and Cordata projects.
2. The monthly report on the one -year road program.
3. A report on the development of the Whatcom County
Comprehensive Flood Control Plan.
4. A chronology of Lake Whatcom Watershed management planning.
5. Copies of a resolution and an agreement approved by the
City of Bellingham, relating to Road Improvement District
No. 9.

6. A memo from the Washington State Association of Counties
concerning a National Association of Counties resolution
and recommendation for dealing with the problem of state -
mandated local services.
The Executive also reported that the
terminate its contract with Whatcom County
services as of December 1, 1987.

Discussed possible impact of proposed Sumas Mountain ORV Park on
school to be built on Mt. Baker Highway at the foot of Sumas
Mountain if bond issue is passed; asked if adequate provisions
had been made for increased fire protection if the Park is
constructed.

Warner explained the substitute resolution and reported that
the Finance Committee recommended its adoption.
WARNER MOVED TO APPROVE THE SUBSTITUTE RESOLUTION.
The motion carried.

Planning and Development Committee Chair Muenscher explained
the ordinance, and reviewed the discussion which had taken place
in the Committee about the advisability of establishing a maximum
size for permitted indoor commercial recreation facilities in the
Tourist Commercial zone.
MUENSCHER MOVED TO ADOPT THE ORDINANCE, AND ALSO
INCORPORATED INTO HIS MOTION A MEMORANDUM DATED SEPTEMBER 3, 1987
FROM MARY CHISHOLM OF THE PUBLIC WORKS DEPARTMENT. THE
MEMORANDUM RECOMMENDED THAT INDOOR RECREATIONAL FACILITIES NOT
EXCEED 69000 SQUARE FEET OF AGGREGATE FLOOR AREA OF ALL BUILDINGS
AS A PERMITTED USE, LARGER FACILITIES BE ALLOWED THROUGH THE
APPROVAL OF A CONDITIONAL USE PERMIT, AND OUTDOOR RECREATIONAL
FACILITIES REGARDLESS OF THEIR NATURE AND SIZE BE ALLOWED ONLY
WITH THE APPROVAL OF A CONDITIONAL USE PERMIT. THE MEMO FURTHER
RECOMMENDED THAT THESE CHANGES BE ESTABLISHED AS ADMINISTRATIVE
POLICY UNTIL SUCH TIME AS THEY CAN BE INCLUDED IN THE PLANNING
COMMISSION'S NEXT REVIEW OF THE ZONING CODE.
There was discussion on the motion.
The motion carried unanimously.

Burton made the following statement and motion:
UNDER WHATCOM COUNTY CODE 3.12.070 THE WHATCOM COUNTY
COUNCIL HAS DELEGATED THE AUTHORITY TO ALLOW CLAIMS TO THE
WHATCOM COUNTY EXECUTIVE. THE EXECUTIVE HAS REJECTED THE $1,000
CLAIM FOR CORKY JOHNSON AND SENT IT BACK TO US. SINCE 3.12.070
IS A DELEGATION OF AUTHORITY AND NOT A TRANSFER OF AUTHORITY WE
STILL RETAIN AUTHORITY TO ALLOW CLAIMS. CONSEQUENTLY, I MOVE
THAT THIS COUNCIL REAFFIRM THE ACTION PREVIOUSLY TAKEN AND ALLOW
WARRANT NUMBER 3868 FOR $1,000 TO CORKY JOHNSON, TO BE PAID OUT
OF THE WHATCOM COUNTY COUNCIL'S BUDGET, AND DIRECT THE WHATCOM
COUNTY COUNCIL CHAIR TO SIGN THE LISTING APPROVING THIS PAYMENT.
There was discussion on the motion.
The motion carried 4 -3 (Hansey, Muenscher, Warner) on a
roll -call vote.

Warner reported that the Finance Committee recommended
approval of the resolution, but that the date for the hearing
should be changed to October 1, 1987.
WARNER MOVED TO APPROVE THE RESOLUTION WITH THE DATE FOR THE
HEARING CHANGED TO OCTOBER 1, 1987.
The motion carried.
