There was discussion on the effect of the motion among Council members and Larry Smith, a representative of ARCO. Smith explained that the original application had included a request for a 45- foot -or- higher sign at the location of the proposed business, and the Hearing Examiner had limited the height of the sign to 30 feet. It was that portion only of the Hearing Examiner's decision which was being appealed. Smith said that as a result of tests conducted after the hearing the company had decided that they needed a 100 - foot -high sign, and they had included these tests and the request for a 100 - foot -high sign in their written argument to the Council. Council attorney Randy Watts stated that the Council was limited to the written record established by the Hearing Examiner, and could not accept new evidence or requests. He said that the issue could be remanded back to the Hearing Examiner for a new determination on the height of the sign. HANSEY ADDED TO HIS MOTION THAT THE COUNCIL REMAND THE APPLICATION BACK TO THE HEARING EXAMINER TO ESTABLISH THE APPROPRIATE HEIGHT OF THE SIGN. There was further discussion on the motion.
