The meeting was called to order at 7:30 p.m. by Council
Chair Burton with all Council members present.

Warner reported that the Finance Committee recommended
approval of the bidders list and bid award recommendations.

Member of Lake Whatcom Watershed Committee; fears Management Plan
will be obsolete by the time it gets to the Council; need
stricter rules and regulations regarding the lake; improper use
of land near the lake is resulting in pollution such as the
dumping of RV holding tanks into the lake; current regulations do
not address this problem; the Health Department and Building and
Codes need to coordinate their activities better in regard to
these issues.

Expressed support for efforts to bring the Alaska Ferry to
Whatcom County.

The hearing on this ordinance had been continued from the
meeting of July 2, 1987. The ordinance was withdrawn at the
request of the Public Works Department.
ORDINANCE CREATING WHATCOM COUNTY ROAD IMPROVEMENT DISTRICT N0, 8
FOR STREET LIGHTING MAINTENANCE, LANDSCAEING MAINTENANCE AND
STORM DETENTION FACILITIES MAINTENANCE IN THE AREA KNOWN AS
CORDATA IN WHATCOM COUNTY, WASHINGTO1�
The public hearing on the ordinance was opened. Warner
explained the purpose of the ordinance. There was no further
testimony, and the hearing was closed.
Warner reported that the Finance Committee recommended
adoption of the ordinance.
WARNER MOVED TO ADOPT THE ORDINANCE.
The motion carried unanimously.

Department, the request had been held in the Planning and
Development Committee for 60 days.

CONSIDERATION OF AN APPEAL OF HEARING EXAMINER'S DECISION QN
APPLICATION NO C U 29 -87 IN THE NAME OF ARCO PETROLEUM
PRODUCTS FILED BY BARGHAUSEN CONSULTING ENGINEERS
HANSEY MOVED TO REVERSE THE HEARING EXAMINER BASED ON AN
ERROR OF LAW ON THE GROUNDS THAT A SINGLE SIGN FACING THE
FREEWAY, AMONG SEVERAL OTHERS WHICH DO NOT, DOES NOT INDICATE THE
BUSINESS IS ATTRACTING CUSTOMERS PRIMARILY FROM OUTSIDE THE LOCAL
NEIGHBORHOOD.
There was discussion on the effect of the motion among
Council members and Larry Smith, a representative of ARCO. Smith
explained that the original application had included a request
for a 45- foot -or- higher sign at the location of the proposed
business, and the Hearing Examiner had limited the height of the
sign to 30 feet. It was that portion only of the Hearing
Examiner's decision which was being appealed. Smith said that as
a result of tests conducted after the hearing the company had
decided that they needed a 100 - foot -high sign, and they had
included these tests and the request for a 100 - foot -high sign in
their written argument to the Council.
Council attorney Randy Watts stated that the Council was
limited to the written record established by the Hearing
Examiner, and could not accept new evidence or requests. He said
that the issue could be remanded back to the Hearing Examiner for
a new determination on the height of the sign.
HANSEY ADDED TO HIS MOTION THAT THE COUNCIL REMAND THE
APPLICATION BACK TO THE HEARING EXAMINER TO ESTABLISH THE
APPROPRIATE HEIGHT OF THE SIGN.
There was further discussion on the motion.
ROEHL ADDED A FRIENDLY AMENDMENT TO HANSEY'S MOTION TO STATE
THAT THE COUNCIL BELIEVES A 100 -FOOT SIGN WOULD NOT BE
UNREASONABLE.
The motion carried.

Muenscher reported that the Planning and Development
Committee recommended approval of the one -year extension.

Hansey explained the reasons for the re- introduction of the
resolution appropriating more money for the District and Superior
Court judges' salaries.
Johnson discussed a citizen's concerns about a County- leased
landfill at the corner of the Laurel Road and Guide Meridian, and
the steps the Public Works Department was taking to alleviate the
problems.
The meeting was adjourned at 8 :20 p.m.
