The minutes of September 17, 1987 were approved. RUOLUTION PROCLAIMING OCTOBER 4 THRQUGH 1Q, J987, S 114-H " IN k[HA QQM COUNTY MUENSCHER MOVED TO APPROVE THE RESOLUTION. The motion carried. Muenscher then read the resolution and presented it to 4 -H member Kelsey Smith. Mr. Smith spoke to the Council about the value of participation in 4 -H clubs. AEPOINIMENI QF UATE SENATQR TO THE 4 VE DISIRIC The Whatcom County Council was joined at this point by San Juan County Commissioners Douglas Corliss and Jeff McKay, and Skagit County Commissioners David Rohrer, Bill Vaux and Otto Walberg. JOINT RESOLUTION DECLARINQ THE APPOINTMENT OF PAS' MCMULLEN TO JUE 4QIH LEGISLAII-VE DISTRICI POSITION OF THE WASHINQTQN STATE SENATE WARNER INTRODUCED THE RESOLUTION, AND MOVED ITS APPROVAL. CORLISS SECONDED THE MOTION. There was discussion about the motion and the best method for voting on the appointment. WARNER AMENDED HIS MOTION TO REFLECT THAT THE VOTE ON THE APPOINTMENT COULD INCLUDE ALL THREE NOMINEES: PAT MCMULLEN, HELEN DAY AND CHILTON RYAN. There was discussion on the motion. Pat McMullen was unanimously named by all Commissioners and Council members present as their choice to fill the vacant Washington State Senate seat. U October 1, 1987 Page 2 HAWLEY MOVED TO APPROVE THE JOINT RESOLUTION APPOINTING PAT MCMULLEN. There was discussion on the motion. It was suggested that the document not be called a resolution. ROEHL STATED THAT HE WOULD ACCEPT THE MOTION WITH AN AMENDMENT TO DELETE THE WORD "RESOLUTION." ROHRER SECONDED THE AMENDED MOTION. There was discussion on the motion. The motion carried. There was further discussion about the nature of the document. VAUX MOVED TO CALL THE DOCUMENT A "JOINT RESOLUTION" BUT TO DELETE.THE "RESOLUTION NUMBER." ROHRER SECONDED THE MOTION. The purpose of the motion was to prevent the document from appearing to be primarily a resolution of the Whatcom County Council. The motion carried. Discussion followed on the procedure for appointing a replacement for Pat McMullen. There was general agreement with the suggestions that the candidates be interviewed by all Council members and Commissioners in an open meeting, and that the attorneys from all three counties be asked to collectively determine the appropriate procedure. The San Juan and Skagit County Commissioners then left the meeting. WARNER MOVED TO APPROVE THE BID AWARD. There was discussion on the motion. The motion carried. October 1, 1987 Page 3 REPORT OF THE EXECUJIV REPLACEMENT FOR SUEEHIOR COURT CLERK The Executive reported that she planned to have a recommended appointment before the Council at its next meeting. Warner reported that the Finance Committee recommended approval of the resolution and the minimum bid prices. WARNER MOVED TO APPROVE THE RESOLUTION WITH THE MINIMUM BID PRICES STATED IN ATTACHMENT "A ". Warner explained the ordinance and reported that the Finance Committee recommended its adoption. WARNER MOVED TO ADOPT THE ORDINANCE. There was discussion about the ordinance. Warner withdrew his motion so that the ordinance could be considered after a related resolution authorizing the necessary agreement between the County, City, and Trillium Corporation had been approved. WARNER MOVED TO ADOPT THE ORDINANCE. The motion carried unanimously. OPENING OF BID PROPOSALS FOR LEASING OE OIL AND GAS RIG HIS 0 COUNTY- QjiNEP LAND There was discussion about the correct procedure for accepting bids and objections. The meeting was recessed at 8:55 p.m., and reconvened at 9:03 p.m. Council Attorney Randy Watts explained that the Council should first consider any objections and then decide whether to go ahead with the process of opening and awarding the bids. Vice Chair Roehl opened and read into the record a letter from Richard LaMaster, objecting to the fact that while county land was being offered for lease in 16 separate parcels, county right -of -ways were required to be bid on as one package. He requested that the right -of -ways also be offered in smaller parcels. October 1, 1987 Page 6 Discussion followed concerning the objection. WARNER MOVED NOT TO ACCEPT THE BIDS; TO DIRECT THAT THE ROAD RIGHT -OF -WAYS BE BROKEN UP INTO SMALLER PARCELS; AND THAT THE HEARING BE CONTINUED UNTIL THE MEETING OF OCTOBER 15. There was discussion on the motion. Warner withdrew his motion. There was further discussion about the bid specifications among the Council and the two bidders, Richard LaMaster and W.G. Van Bebber. HAWLEY MOVED THAT THE BIDS BE OPENED. The motion carried. Vice Chair Roehl opened the two bids from Richard LaMaster and W.G. Van Bebber, and asked Council Attorney Randy Watts and Public Works Director Paul Rushing to review the bids and make a recommendation to the Council later in the meeting. It was noted that all of the approvals on the check -off list had not been obtained because construction of the building was not yet complete. October 1, 1987 Page 9 Council Attorney Randy Watts reported that the most responsive bid had been submitted by W.G. Van Bebber. HANSEY MOVED TO ACCEPT THE MOST RESPONSIVE BID, THAT OF W.G. VAN BEBBER, AND AUTHORIZE THE EXECUTIVE TO ENTER INTO THE APPROPRIATE CONTRACTS TO IMPLEMENT THE AWARD OF THE BID. The motion carried.
