July 2, 1987
The meeting was called to order at 7:30 p.m. by Council
Chair Burton with Hansey, Hawley, Johnson, Muenscher, and Warner
present.
APPROVAL QF MIMH M
The minutes of the Committee of the Whole meeting of June
11, 1987 and the Council meeting of June 18, 1987 were approved.
Approval of the Committee of the Whole minutes of June 16, 1987
was tabled until the "Other Business" section of the agenda.
EXECUTIVE ITEMS

Warner reported that the Finance Committee recommended
approval of both bid awards.
WARNER MOVED TO APPROVE THE BID AWARDS.
The motion carried.
REQUEST FOR AUTHORIZATION TO PURCHASE WHAICOM CHIEF INSURANCE, FOR
$18,945
Executive Van Zanten explained the proposed insurance
purchase.
Warner reported the Finance Committee recommended approval
of the insurance purchase.
WARNER MOVED TO AUTHORIZE THE EXECUTIVE TO PURCHASE THE
INSURANCE.
The motion carried.

DEPORT OF THE EXEQUTIVE
The Executive requested that the Council authorize the
Department of Buildings and Codes to accept a Coastal Zone
Management Grant in the amount of $14,000. The ordinance to
authorize incorporation of the grant into the Buildings and Codes
budget was scheduled for final consideration at a future meeting.
Warner reported that the Finance Committee recommended
approval of the grant.
WARNER MOVED TO APPROVE THE CONCEPT OF THE GRANT.
The motion carried.
MMU'lWalrone WIMISIGUM
Van Zanten reported that the sixth floor remodel was almost
complete, and the Public Defender's Office had already moved in.
She complimented Public Works employee Mary Chisholm on her
management of the project, which had been completed on time and
within budget.
The Executive explained that some passengers were having to
wait for the ferry to make a second run to the island, due to
increased summer traffic and the Coast Guard restrictions on the
number of passengers the boat can carry with only two crew
members.
Van Zanten explained that applications had been submitted by
Whatcom County organizations for the state's Early Action
Watershed Program, but that the Department of Ecology had
directed that County governments must apply for and manage the
subsequent grants. She said that she would work to change this
inappropriate requirement.

Testified in favor of the ordinance; thanked Bob Jurica, Paul
Rushing, and Corky Johnson for their work on the ordinance.
There was no further testimony and the hearing was closed.
Johnson reported that the Public Services Committee
recommended adoption of the ordinance with an amendment.
JOHNSON MOVED TO ADOPT THE SUBSTITUTE ORDINANCE WITH THE
ADDITION, ON LINE 22, OF THE EXPLANATION THAT METAL ARMORED
"SHALL MEAN THE METAL SHIELD WITHIN THE OUTSIDE CABLE SHEATH."
There was discussion on the motion.
The motion to adopt the substitute ordinance as amended
carried unanimously.
ORDINANCE AMENDING SECTION 15,16,050 OE THE WHAICOM COUN Y COD
FOR THE PURPOSE. OF ESTABLISHING ANEW PERMIT FEE FOR FIREWORKS
DISPLAYS
The public hearing on the ordinance was opened. At the
request of the Public Works Director, the hearing was continued
to the second Council meeting in September.
REQUEST FOR ERASURE OF LOT LINE BETWEEN LOTS 214 AND 220,
DIVISION 16 IN THE PLAT OF SUDDEN VALLEX, FILED BY LORNE
HAAEONSON
The public hearing on the request was opened; there was no
testimony and the hearing was closed.
Muenscher reported that the Planning and Development
Committee recommended that the request be denied because the lots
were not under the same ownership. The Haakonsons owned only one
of the lots, and had a contract to purchase the other lot from
its current owner.
There was discussion about this issue.
MUENSCHER MOVED TO APPROVE THE LOT LINE ERASURE CONTINGENT
UPON THE APPLICANTS OBTAINING WARRANTY DEEDS FOR BOTH LOTS.

Suggested use of noise meters as an alternative to the ordinance.
Lloyd Austin
1838 Lakeside, Bellingham
Stated that use of noise meters had not proved to be effective in
alleviating the problem.
There was no further testimony and the hearing was closed.
Johnson reported that the Public Services Committee
recommended adoption of the ordinance.

There was discussion on the motion.
The motion carried 5 -1 (Burton).

Discussed the disposal of sludge from Snohomish County on
agricultural land in Whatcom County and the possible hazards of
this practice.

Bonnie Davis
Osgood Road
Protested the application of Snohomish County sludge on land near
her property; there are wells in the vicinity and the area is
subject to flooding. Questioned whether Health Department had
investigated flooding potential before issuing permit.
The Council discussed the problem, and agreed to schedule a
Committee of the Whole meeting for July 9 to discuss the sludge
problem as well as the solid waste issue.
HAWLEY MOVED TO REQUEST THE HEALTH DEPARTMENT TO INVESTIGATE
THE SLUDGE APPLICATION AND REPORT TO THE COMMITTEE OF THE WHOLE
ON JULY 9.
JOHNSON MOVED TO AMEND THE MOTION TO ALSO REQUEST AN
ENVIRONMENTAL IMPACT STATEMENT ON THE SLUDGE APPLICATION.
The motion to amend failed.
The main motion carried.

Warner explained the ordinance, and reported that the

JOHNSON MOVED TO APPROVE THE MINUTES.
Warner explained a change in wording of one section in the
minutes, which had been recommended by the Finance Committee and
was reflected in the minutes which were before the Council at
that time.
