The Executive presented her proposed appointments to the
Council.
HAWLEY MOVED TO CONFIRM THE EXECUTIVE'S APPOINTMENTS.
The motion carried.
REQUEST FOR AUTHORIZATION TO SIGN UNION CONTRACTS
Warner reported that the Finance Committee recommended
approval of the union contracts.
WARNER MOVED TO AUTHORIZE THE EXECUTIVE TO SIGN THE UNION
CONTRACTS AS PRESENTED.
Hawley stated for the record that, although his wife was
employed in the Treasurer's Department, under the provisions of
RCW 42.23.040 he did not have a conflict of interest because the
compensation involved consisted of a fixed wage or salary.
The motion carried.
SECOND QUARTER FINANCIAL REPORT
The Executive distributed and discussed the report, as well
as a letter which listed some of the County's major financial
needs and requested the Council to state its priorities.

HEARINGS
ORDINANCE AMENDINQ WHATCOM COUNIX CODE BY ADDING CHAPTER
COUNTY JAIL HOUSING EEFS
The public hearing on the ordinance was opened; there was no
testimony and the hearing was closed.
Warner reported that the Finance Committee recommended that
following the hearing the ordinance be referred back to the
Committee for further study.
The ordinance was referred back to the Finance Committee.

The public hearing on the ordinance was opened.
Joe Parcher
2408 View Ridge Drive
Testified in opposition to raising permit fees; discussed costs
of various permits, particularly the plan check fee which he said
was too costly and not necessary in some cases.
Gordon Laird
1120 Ohio St.
Stated that the plan check process was a waste of time and that
the entire permit system needed to be changed.
There was no further testimony and the hearing was closed.
There was discussion about the ordinances and the concerns
expressed by the citizens.
Warner reported that the Finance Committee recommended
adoption of the substitute ordinance.
WARNER MOVED TO ADOPT THE SUBSTITUTE ORDINANCE.
Hansey read into the record a letter from Michael Brennan,
Executive Vice President of the Whatcom Chamber of Commerce and
Industry, in support of the increase in permit fees.

The motion to amend carried.
The motion to adopt the substitute ordinance as amended
carried 4 -1 (Hawley).

There was discussion about the provisions of the ordinance
relating to the transcript fee for appeals of Hearing Examiner
decisions.
JOHNSON MOVED TO DEFER THE ORDINANCE UNTIL LATER ON THE
AGENDA.
The motion carried.

Muenscher reported that the Planning and Development
Committee recommended approval of the request.

2582 North Shore Road
Stated that a document in his possession outlined a plan by the
County Executive to eliminate a number of the county's elected
offices. This contention was disputed by some Council members.
Carl Franks
Goodwin Road
Stated that the Council did not demonstrate enough concern for
citizens affected by spreading of Snohomish County sludge in
Whatcom County; said that materials in the sludge will leach into
the ground and affect wells and rivers.
Jim Gardner
Expressed concerns about sludge being stockpiled in fields rather
than in bunkers; the need for monitoring of the sludge spreading
if it continues; and the amount of time it will take for the
issue to be resolved.
Wayne Fonet
Asked about the possibility of the Council obtaining a court
injunction to stop the sludge spreading.
Bob Johnson
Osgood Road
Stated that the claim, made in the permit for the sludge
spreading, that wells in the area are drilled to hard -pan is
false.
Harriet Nielsen
3244 Hopewell Road
Inquired about the possibility of a bond to guarantee the
performance of the company involved in spreading the sludge.
Howard Knowlton
Distributed petitions in favor of the Sumas Mountain ORV Park.

REGARDING COST OF THE TRANSCRIPT IN APPEALS OF THE HEARING
EXAMINER'S DECISIONS AS FOLLOWS: THE APPELLANT SHALL ALSO PAY
THE TRANSCRIPT FEE AND UPON COMPLETION OF THE TRANSCRIPT ANY
ADDITIONAL FEE NECESSARY TO EQUAL THE ACTUAL COST OF THE
TRANSCRIPTION.
There was discussion on the motion.
