Als Batchelor, Planning; Jerry Mixon and Code; Tom Sutberry, Budget Director; Deputy Prosecuting Attorney; Mr. and and Mr. Vanderhoek. by Committee Chair Burton at o present were Carl John Tyler, Buildings and Dave Cottingham, Civil Mrs. Nielson; Alvin Zoerink; APPEAL OF PLANNING COMMISSION'S DENIAL OF NIELSEN REZONE REQUEST Carl Batchelor explained the Nielson's request for a Comprehensive Plan amendment to have their property zoned "Community Commercial" in order to be able to relocate their appliance repair business to an area of Point Roberts currently designated as residential, low density. He explained that the Planning Commission had denied the Nielson's request due to concerns about the impact on traffic on Tyee Drive; the undesirability of strip commercial development on Tyee Drive; and the fact that considerable land in the area had already been set aside for "Community Commercial" development. The Nielsons explained why they felt their proposed business would have little impact on the area, and offered some suggestions to mitigate any possible effects. The Committee agreed to recommend to the full Council that a hearing be scheduled on the Nielson's request for a Comprehensive Plan amendment, and also to recommend that the request be granted with the conditions that the amendment include the Nielson's property only; that the uses to which the property may be put be specifically limited; and that business access to the property be from McKenzie Street only. The Planning staff was requested to prepare the appropriate documents. CONTINUATION OF DISCUSSION OF A BUSINESS REGISTRATION PROGRAM.AND LIMITED AMNESTY POLICY -FOR NON - CONFORMING BUSINESSES Buildings and Code Director John Tyler suggested the use of a "Certificate of Occupancy," which is already required for County businesses, as a mechanism to verify compliance with the proposed business registration and limited amnesty program. An extensive discussion followed concerning the merits and disadvantages of the concept of an amnesty program, the structure and criteria for such a program, and the potential liability exposure which might result. March 2, 1988 Page 2 The Committee directed the Buildings and Code and Planning staffs to continue further investigation of the proposal as well as the legal issues involved.
