December 14, 1988
The meeting was called to order at 2 :00 p.m. by Acting Chair Emily
Jackson with Don Hansey present. Also present were Dan Taylor and Jerry
Mixon, Planning; Bob Carmichael, Prosecutor's office; Nell Clement, KGMI; Andy
Norstadt, Bellingham Herald; Stafford Smith; Stan Burns, Joyce Kolesar, Marie
Burns, Glynnls Christie, and Lola Loreen, Point Roberts' residents.
EMERGENCY ORDINANCE REGARDING A MORATORIUM ON GAS STATION PERMITS IN POINT
ROBERTS
Bob Carmichael explained that this emergency ordinance would be in
effect for 60 days which is the maximum length of allowable time for an
emergency ordinance. He also drafted a regular ordinance that would, if
passed, be in effect until January 1, 1990 or until the completion and final
approval of the Point Roberts Comprehensive Plan (whichever comes first).
Hansey asked if Carmichael felt this would stand up in court if contested.
Carmichael felt that the regular ordinance would stand up better than the
emergency one. Taylor stated that it is difficult to determine how much gas
is going into Point Roberts and this would help to measure the hazard.
Stafford Smith who is legal counsel for the residents of Point Roberts said he
agrees with the ordinance that has been written but feels It should also state
that there is no way for Whatcom County to get assistance to Point Roberts in
the event of a fire because of its location. This is the first moratorium
ever enacted by the County.
HANSEY MOVED THAT THIS ORDINANCE BE FORWARDED TO COUNCIL WITHOUT
RECOMMENDATION.
Motion carried.
ORDINANCE AMENDING THE TEXT OF THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE
AND THE INTERIM ZONING ORDINANCE TO PROVIDE A PERMIT REVOCATION PROCEDURE FOR
PERMITS ISSUED BY THE HEARING EXAMINER
Taylor explained that this would allow the hearing examiner to either
revoke or compel compliance. A person must validate the permit by complying
with the conditions. The hearing examiner is trusted to give permits and
should be trusted to force compliance to the original conditions. This would
lessen the load on the courts and speed up the process.
Jackson asked if it would be possible to make this a civil matter and
issue fines. They are currently considering this.
HANSEY MOVED THAT THIS ORDINANCE BE FORWARDED TO COUNCIL WITHOUT
RECOMMENDATION
Motion carried.
