Also present were Shirley Van Zanten, County Executive; Shirley Forslof, Auditor; Barbara Cory, Treasurer; Tom Sutberry, Budget Director; Doug Bill, Undersheriff; Peggy Ball, Mental Health; Mac Setter and Michael Sparks, Public Defender's Office; Mick Moynihan, Municipal Court Judge; Dave McEachran, Prosecutor; Glen Kiep, Marlen Hansen, and Brad Bennett, Public Works; Mike Brennan, Chamber of Commerce; Nat Dickinson, Purchasing; Harold Raymond, Personnel; Gary Wood, Juvenile Probation; Ed Henken, Engineer; Bob Tull, Attorney for Westside Record - Journal; and J.C. Hickman, Bellingham Herald. DISCUSSION /REVIEW OF PUBLIC DEFENDER'S.REQUEST. FOR S.QPPLEMENTA� BUDGET FOR ADDED DEPUjY AND.INVESTIGATOR Executive Van Zanten reviewed the Public Defender's request for more personnel. She explained that she had prepared an ordinance for introduction at the April 7 Council meeting which would provide funds for another Deputy Public Defender, but not for another Investigator. There was extensive discussion of the problem of the Public Defender's caseload. The Committee agreed to take up the issue again at its next meeting when the ordinance would be regularly scheduled for review. SUBSTITUTE ORDINANCE AMENDING WHATCOM COUNTY CODE PROVISIONS MAKING THE VIOLATION OF SAID PROVISIONS AN INFRACTION ORDINANCE ESTABLISHING A CIVIL INFRACTION PROCEDURE ORDINANCE CREATING ENFORCEMENT PROCEDURES FOR FAILING TO RESPOND TO OR SIGN AN INFRACTION The latest version of the "decriminalization ordinance" was discussed with Prosecutor Dave McEachran, who requested that it not be adopted in its latest form with the inclusion of'the offenses of Trespass, Obstructing, Minor in Possession, Drinking in Public, Dog Violations, Open Container, and Selling Alcohol to a Drunk. He said such an ordinance was illegal because the County did not have the authority to decriminalize offenses which are criminal offenses under State statutes. He also explained that the City was able to decriminalize such offenses because they only prosecuted violations of City ordinances, and left all other prosecution up to the County. April 4, 1988 Page 2 The Committee agreed to table the ordinances indefinitely, and to request the administration to draft a resolution which would address the issue of the State forcing the County to prosecute certain offenses as crimes but not providing any funding with which to do so. AWARDING OF BID FOR THE OFFICIAL.COUNTY NEWSPAPER, JULY 1,i 198.8 THROUGH JUNE 301 1989 Auditor Shirley Forslof presented the bids and her research on this subject to the Committee, and discussion followed on the various issues involved. The Committee agreed to hold the item over to its next meeting, and requested figures on the amount of money spent for advertising in Westside Record - Journal and the Bellingham Herald in fiscal year 1987 -88. ORDINANCE TO REVISE THE 1988 CONVENTION CENTER FUND APPROPRIATION The ordinance was briefly discussed. HANSEN MOVED TO RECOMMEND ADOPTION OF THE ORDINANCE. The motion carried. REQUEST FOR APPROVAL.OF BIDDERS LISTS FOR PRODUCE AND MEAT FOR THE JAIL AND NOR -BELL CARE CENTER FOR THE NEXT SIX MONTHS BID AWARD RECOMMENDATION FOR DAIRY PRODUCTS FOR THE JAIL TO THE LOW BIDDER, FOOD SERVICES.INC., FOR AN ESTIMATED TOTAL OF $15,606.30 BID AWARD RECOMMENDATION FOR GROCERIES AND SUPPLIES FOR THE JAIL TO THE LOW BIDDER. FOOD SERVICES. INC.. FOR AN. ESTIMATED TOTAL OF Executive Van Zanten distributed changes to the descriptions of the last two bid award recommendations, and reviewed the bids. VANDERPOL MOVED TO RECOMMEND APPROVAL OF ALL THREE BID AWARD RECOMMENDATIONS. The motion carried. BID AWARD RECOMMENDATION FOR A FLAIL BRUSH MOWER TO THE.LOW BIDDER, OUTDOOR POWER EQUIPMENT CO., FOR A MCCONNELL PA 97 FLAIL BRUSH MOWER AT A TOTAL BID OF $16.709,QQ INCLUDING SALES TAX The Executive reviewed the bid award. BID AWARD RECOMMENDATION FOR A CRACK SEALING MACHINE TO THE LOWEST RESPONSIVE BIDDER, SPECIAL ASPHALT PRODUCTS, INC.1 FOR A BEARCAT BK250 CRACK SEALING MACHINE AT A NET BID OF. $22,072.0 INCLUDING TRADE -IN AND SALES TA The Executive reviewed the bid award, and discussion followed. HANSEY MOVED TO RECOMMEND APPROVAL OF THE BID AWARD. The motion carried. BID AWARD RECOMMENDATION FOR DRYDOCKING. REPAIR AND MAINTENANCE OF THE WHATCOM CHIEF TO THE LOW BIDDER,�DUWAMISH SHIPYARD INC., IN THE AMOUNT OF $33,,946 64 The Executive reviewed the bid award, and discussion followed. VANDERPOL MOVED TO RECOMMEND APPROVAL OF THE BID AWARD. The motion carried. REQUEST FOR AUTHQ RATION TO SIGN A CONTRACT FOR STRENGTHENIN AND RESURFACING OF MIDDLE.FORK BRIDGE N0. 140. (MOSQUI.TO.LAKE ROAD BRIDGE) TO BE AWARDED TO COQNEY- MCHUGH CO. IN THE AMOUNT .OF $102,703.06 INITIATING RESOLUTION FOR PROJECT N0, 99170, THE STRENGTHENIN AND RESURFACING OF MIDDLE FORK BRIDGE N0, 140 The Executive reviewed the contract and resolution. HANSEY MOVED TO RECOMMEND APPROVAL OF THE CONTRACT AND THE INITIATING RESOLUTION. The motion carried. REQUEST FOR AUTHORIZATION TQ SIGN A CONTRACT FOR ALQQHOL PROTECTIVE CUSTODY SERVICES TO S.W.A.R.F.- RECOVERY NORTHWEST, FOR $29,783.00 The Executive distributed the contract, and discussion followed. April 4, 1988 Page 4 HANSEY MOVED TO RECOMMEND AUTHORIZING THE EXECUTIVE TO SIGN THE CONTRACT. The motion carried. SUBSTITUTE ORDINANCE AMENDING ORDINANCE N0, 83 -5. AUTHORIZING A FEE SCHEDULE FOR THE,WHATCOM COUNTY TREASURER The substitute ordinance was distributed and discussed. HANSEN MOVED TO RECOMMEND ADOPTION OF THE SUBSTITUTE ORDINANCE. The motion carried. RESOLUTION CLARIFYING RESOLUTION NO.. 87 -6i . ADDING THE MEMBERS OF THE BOUNDARY REVIEW BOARD TO THOSE EMPLOYEES DEFENDED BY WHATCOM COUNTY HANSEY MOVED TO RECOMMEND APPROVAL OF THE RESOLUTION. The motion carried. ORDINANCE AMENDING WHAI_COM COUNTY CODE TITLE 2, MEETINGS- -TIMES Hansey suggested amending the ordinance to read "The Chair of the Council Finance Committee Q,r_a designee shall take minutes at such Committee of the Whole meetings." VANDERPOL MOVED TO RECOMMEND ADOPTION OF THE ORDINANCE WITH THE AMENDMENT. The motion carried. DISCUSSIONZREVIEW OF CLERK'S REQUEST FOR SUPPLEMENTAL BUDGET TO MOVE STAFF FROM SEVEN HOUR TO EIGHT HOUR, DAYS The Executive reviewed the Clerk's request for more funding. The ordinance which would implement this request was scheduled for introduction April 7 and formal consideration by the Committee at its next meeting. FUTURE USE OF THE PARK QRV FUND This issue was briefly discussed. The Committee decided to ask Parks Director Roger DeSpain to be present at the next meeting to discuss the options. April 4, 1988 Page 5 REQUEST FOR AUTHORIZATION TO ISSUE A REQUEST FOR PROPOSALS FOR THE SALE OF THE NOE- BELL,CARE CENTER LICENSE FOR.70 BEDS The Executive reviewed the reasons for her proposal to put the Nor -Bell license up for sale. VANDERPOL MOVED TO RECOMMEND AUTHORIZING THE EXECUTIVE TO ISSUE A REQUEST FOR PROPOSALS FOR THE SALE OF THE NOR -BELL LICENSE. The motion carried.
