September 1, 1988
The meeting was called to order at 7 p.m. by Council
Chairman William Roehl, with Council members Tom Burton, Don
Hansey, Emily Jackson, Mary Vanderpol and Dan Warner present.
Corky Johnson was absent.

A. Monthly Road Construction Progress Report; Van Zanten
outlined progress on several projects. She said planned work on
Bennett Drive will not take place until it is known whether the
City of Bellingham plans to annex the affected portion.

B. Landfill Siting; Van Zanten distributed a letter to
Council members from Bob Jurica, Solid Waste Manager, explaining
what has been /will be happening in this arena.
C. Washington State Association of Counties Insurance
Pool; Van Zanten has been elected to be vice president of the
pool's board of directors. The Pool will take effect Oct. 1.
D. Initiative 97/97B; Hansey asked for a status report.
an Zanten said the legislative committee of the WSAC will meet
Sept. 27 to discuss their position on the issue. Hansey
complained that the voter's pamphlet, listing WSAC as a supporter
of Initiative 97, is going to press Sept. 15.

Due to a typo in the list of fees being charged in this
ordinance, Randy Watts recommended the hearing be kept open and
the ordinance readvertised with the changes. Roehl opened the
hearing; there was no testimony, so the hearing was kept open
until Sept. 15.
Warner reported that the Finance Committee wished to hold
this item over for further consideration. If substantial changes
are made to the rates proposed in the ordinance, it will need to
be readvertised and a new public hearing scheduled. The hearing
was opened; there was no testimony; it was held over until Oct.

VANDERPOL MOVED THAT THE ROAD BE VACATED UPON PAYMENT OF
FEES SET BY THE COUNTY.

Jim Maricle
Cedarville Road
Said he's tired of doing the County's homework, that the
burden of proof of safety (of the dump) should rest with the dump
operator, not the people who live near it. Roehl said it was his
perception that neither the Council nor the citizens were getting
good enough answers regarding this matter.
John Liebrandt
Cedarville Road
Said has called the Governor's office to complain about
the dump. Requested that the County start sending a truck full
of drinking water out to the Cedarville area to keep citizens
happy and healthy. Roehl said he would ask the administration to
send out a truck to help flush the water systems in that area.
Carl Casgard
Sand Road
Asked why county couldn't create an emergency dump and
close Cedarville. Roehl said the County has to jump through all
the legal hoops and must be careful in selecting a new site.
Dusty Anderson
2929 Goshen Road
Suggested the County start doing tests of wells on Sand
Road; also, that water filters be issued to people living in that
area.
BURTON MOVED TO AUTHORIZE THE ADMINISTRATION TO CONTRACT
WITH THE STATE DEPARTMENT OF SOCIAL AND HEALTH SERVICES TO
PROVIDE TESTING AT THE CEDARVILLE AREA WELLS FOR THE EXPRESS

PURPOSE OF PROVING OR DISPROVING PROBLEMS PEOPLE SAY THEY ARE
HAVING WITH THEIR WELLS.
Motion carried.
The meeting was recessed from 8:25 p.m. to 8:30 p.m.
Warner reported that the Finance Committee did not
recommend approval of this. He said he would vote against it.
WARNER MOVED TO ADOPT THE ORDINANCE.
Motion failed, with.Hansey, Vanderpol and Warner in
opposition.
Warner said Finance recommended approval. Burton asked
how this could be justified when health department appropriation
was not; Hansey said money already has been set aside for the new
copier, which will be purchased via this ordinance.
WARNER MOVED TO ADOPT THE ORDINANCE.
Motion carried unanimously.

Warner reported that Finance recommended approval. He
also commended Barbara Cory, Treasurer, for doing a "cracker -jack
job" on this project.
WARNER MOVED TO ADOPT THE ORDINANCE.
Motion carried unanimously.

Warner reported that Finance discussed this. Said why
should County pay when state won't? Van Zanten noted that if
this ordinance is passed, it will nullify the ordinance on which
the county is basing its contention that it should not pay these
fees. The matter is now before the Superior Court.
Roehl asked that the Council be updated at the next
meeting; the ordinance was held in committee.

drafted after hearing a request from Pamela Cushing, City Center
Development Authority. Vanderpol asked that the third "whereas"
be deleted, because it said the post office site is the favored
location for a new juvenile detention center.

RECOMMENDED CHANGES.

sound system. Roehl asked that staff consult with Mary Chisholm
about improving the system.
