June 2, 1988
The meeting was called to order by Council Chair Roehl at
7 :00 p.m. with Hansey, Jackson, Johnson, Vanderpol and Warner
present.

not suitable for a landfill, due to potential for contamination
of water supply and the Nooksack River; Cedarville landfill
should be closed; suggested that a new landfill be located
between Cherry Point and Ferndale.

Presented petition requesting that Foothills area zoning be left
as is in the 1976 Amendment to the Comprehensive Plan.
Jim Maricle
3326 Cedarville Road
Has B.S. degree in Chemistry; understands engineering and
environmental law; was responsible for permit applications while
working at Mobil Oil Refinery. Discussed leachate collection
system at the Cedarville landfill and the difference between the
amount of rainfall and the amount of runoff which is collected;
stated that the rest of the leachate was leaking out at several
points along an embankment. Stated that the landfill is
operating illegally; has no permit and no environmental impact
statement; Harper -Owes does not know what they are doing.
David Green

Stated that the landfill was built above a gravel pit; is source
of concern to the neighborhood; its operation should not be
extended.

Bob Harriman

Representative of several sportsmans' groups; discussed leachate
seepage which had been covered up with riprap rock; stated that
even a small amount of water contamination will affect fish;
leachate drainage into Anderson Creek threatens fish restoration
project there; urged Council not to extend operation of the dump.
Barbara Brenner
5617 Northwest Road
Harper -Owes should not be the firm hired to site a new landfill;
same firm is doing testing at TRC; Harper -Owes can't be trusted;
urged Council to take advantage of resources available at Huxley
College; more testing of wells should be done in the Cedarville
area; new dump should be located at best possible site; asked why
only two engineering firms had submitted bids for the contract to
site a new landfill; suggested that others might have been
pressured not to submit bids.
Barbara Green
5583 Knight Road, Bellingham
Urged Council to close Cedarville landfill; moved to area eight
years ago with the understanding that landfill would be closed
soon; expressed concern about leachate seeping into water supply
and the effect on land values.
Vern Johnson
Lummi Fisheries
Discussed the effect of the leachate on water quality and
resulting danger to the health of all aquatic life; urged that
extensive water quality studies be done in the area immediately.
Unidentified Citizen
Asked why the Council kept extending the closing date of the
dump. Chairman Roehl and other Council Members explained that
County officials had believed that the private sector.would
eventually be able to handle the County's waste; its failure to
do so now necessitated the siting of a new landfill and the
continued operation of Cedarville in the meantime.

Expressed concern about continued extensions of the operation of
the landfill; urged that the process of siting a new landfill be
expedited.
Jens Jensen
Sand Road
Asked why TRC was allowed to import garbage if the County
couldn't handle its own waste.
Dale Crouse
Stated that public disposal of waste was inefficient and that it
should be handled by specialists in the private sector. Chairman
Roehl explained that this was exactly what the Council had hoped
would happen but that the private sector had not been able to
solve the problem in Whatcom County.
Charlie Baker
Discussed the issue of waste being dumped at Cedarville which
other dumps had refused; stated that he had heard of hospital
waste being dumped there.
Pat Milliken
Discussed his concern about the effect of leachate from the dump
on the supply of drinking water; urged County to ensure
comprehensive testing of wells; stated that more work should be
done to encourage recycling.
Randy Kraft
Cedarville Road
Urged Council to speed up siting of new landfill; stated that a
better job should be done of policing the type of waste which is
dumped at Cedarville; Cedarville dump should be covered every
night due to unbearable smell.

Paradise Lakes Country Club
Stated that this was her organization's second request to the
Council for a dog control zone; discussed problems with wild dogs
and dogs running loose.
Gordon West
Peaceful Valley
Stated that he had complained about the dog problem for 12 years;
dogs run loose and run in packs; his dog has been attacked; need
to. control the problem.
Brenda Golden
Paradise Estates
Children and pets have been attacked and mauled by dogs running
at large; packs of dogs also create danger to wildlife.
Jim Mason
President of Paradise Lakes Country Club
Asked for County's assistance to improve safety of children and
pets in the Paradise Lakes area.
There was no further testimony and the hearing was closed.
Johnson reported that the Public Services Committee
recommended approval of the dog control zone.
JOHNSON MOVED TO APPROVE THE REQUEST FOR THE FORMATION OF A
DOG CONTROL ZONE.
The motion carried.
ORDINANCE REGARDING THE ESTABLISHMENT OF SPEED.LIMITS WITHIN
SCHOOL ZONES
The public hearing on the ordinance was opened; there was no
testimony and the hearing was closed.
Johnson reported that the Public Services Committee
recommended adoption of the ordinance.
JOHNSON MOVED TO ADOPT THE ORDINANCE.
The motion carried unanimously.

The meeting was recessed at 8 :25 p.m. and reconvened at 8 :35
p.m.
FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANC
RESOLUTION AMENDING RESOLUTION NO, 87-2q, A RESOLUTION 10 FEND
THE OPERATION OF THE CEDARVILLE LANDFILL SITE FOR RECEIVING
PUTRESCIBLE GARBAGE FROM JUNE 30, 1988 TO DECEMBER 31,. 1988
Johnson read a statement urging that the Cedarville landfill
site be closed to other than emergency use, and that the private
incinerators be allowed to handle the County's garbage.
JOHNSON MOVED THAT THE CEDARVILLE LANDFILL BE CLOSED AS OF
AUGUST 1, 1988 AND OPENED ONLY IN THE EVENT OF AN EMERGENCY
CLAIMED BY THE EXECUTIVE AND APPROVED BY THE COUNCIL; AND THAT
GARBAGE BE PICKED UP BY A HAULER OR TAKEN TO AN INCINERATOR.
There was extensive discussion on the motion. At the
request of the Council, Public Works Director Paul Rushing
reviewed his memo regarding the consequences of the continued
operation or closure of the landfill. He stated that closure of
the Cedarville landfill would leave approximately 35 to 40 tons
of garbage per day which could not be processed by the private
incinerators.
Johnson's motion failed.
WARNER MOVED TO APPROVE THE RESOLUTION EXTENDING THE
OPERATION OF THE CEDARVILLE LANDFILL TO DECEMBER 31, 1988•
There was discussion on the motion.
WARNER AMENDED HIS MOTION TO ADD TO THE RESOLUTION LANGUAGE
REQUESTING THAT THE ADMINISTRATION EXPLORE ALTERNATIVE
DISPOSITION OF WASTE WITH SKAGIT COUNTY, OR AT OTHER SITES.
JACKSON MOVED TO AMEND THE RESOLUTION TO ADD A STATEMENT
REQUESTING THAT THE PEOPLE OF WHATCOM COUNTY WILL, TO THE BEST OF
THEIR ABILITY, TAKE RESPONSIBILITY TO LIMIT THE WASTE STREAM BY
FULLY UTILIZING ALL METHODS OF RECYCLING TO REDUCE UNNECESSARY
WASTE.
Jackson's motion to amend carried.
Warner's motion carried and the amended resolution was
approved.

Finance Committee recommended its approval.

discussion of the issue of expediting the process of siting the
landfill.
JACKSON MOVED TO TABLE THE RESOLUTION UNTIL THE EXECUTIVE
COULD PROVIDE MORE SPECIFIC INFORMATION ON THE NUMBER OF SITES TO
BE CONSIDERED.

WARNER MOVED TO AMEND THE RESOLUTION BY ADDING A STATEMENT
THAT THE COUNCIL REQUESTS THAT THE CONTRACT CONTAIN A REFINED
SCOPE OF WORK WHICH INCLUDES METHODS TO SPEED UP THE SITING
PROCESS, AND PLACEMENT OF A LIMITATION ON THE NUMBER OF SITES TO
BE CONSIDERED.
Warner's motion to amend carried.
There was further discussion about the resolution.
