APPROVAL OF MINUTES The Committee of the Whole minutes of January 11, 1988 and the Council minutes of January 21, 1988 were approved. EXECUTIVE ITEMS BID AWARD RECOMMENDATION FOR THE REHABILITATION OF THE HANNEGAN ROAD BRIDGE N0, 252 OVER THE NOOKSACK RIVER TO THE LOWEST BIDDER. PROGRESSIVE CONTRACTORS INCORPORATED OF OSSEO, MINNESOTA IN THE AMOUNT OF $288,787.50 INITIATING RESOLUTION FOR PROJECT N0, 99130, THE REHABILITATION OF THE HANNEGAN ROAD BRIDGE N0, 252 OVER THE NOOKSACK RIVER Warner explained the bid award and initiating resolution and reported that the Finance Committee recommended their approval. WARNER MOVED TO APPROVE THE BID AWARD AND INITIATING RESOLUTION. There was discussion on the motion. The motion to approve the bid award carried. The motion to approve the initiating resolution carried. REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS DEPARTMENT OF ECOLOGY REGULATIONS AND GAS TAX.REVENUES Johnson discussed a letter from the State Department of Ecology which suggested that county employees could assist the State in monitoring compliance with woodstove emission regulations. He cited this as another example of the burdens the State attempts to place on counties. He also said that the road construction revenue from the gas tax should be spent on the County roads most in need of work. SCHEDULING OF COUNCIL RETREAD The Council agreed to schedule a retreat for Saturday, February 20, from 9 :30 a.m. to 2 :30 p.m. February 4, 1988 Page 2 HEARIN ORDINANCE IN THE MATTER OF AMENDING WHATCOM COUNTY CODE 9.32.160 SUBSECTION B, WHICH IS RELATED TO UNLAWFUL DISCHARGE OF FIREARMS AND BOW AREAS; CONCERNING THE WISER LAKE AREA The public hearing on the ordinance was opened; there was no testimony and the hearing was closed. Johnson reported that the Public Services Committee recommended adoption of the ordinance. JOHNSON MOVED TO ADOPT THE ORDINANCE. There was discussion on the motion. The motion oarried unanimously. OPEN SESSION No one spoke at open session. FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES ORDINANCE AMENDING ORDINANCE 87 -79 IN ORDER TO PROVIDE FOR COUNTY COUNCIL REPRESENTATIVES ON THE ALCOHOL SUBSTANCE ABUSE ADMINISTRATIVE BOARD AND MENTAL HEALTH ADVISORY BOARD Warner explained the ordinance and reported that the Finance Committee recommended its adoption. WARNER MOVED TO ADOPT THE ORDINANCE. There was discussion on the motion. The motion carried unanimously. OTHER BUSINESS OPEN SPACE APPLICATION FILED BY TOM MORELLI The application was received by consent and referred to the Planning Commission. February 4, 1988 Page 3 INTRODUCTION OF RESOLUTIONS AND ORDINANCES RESOLUTION CALLING FOR BID PROPOSALS TO BE SUBMITTED BY .QUALIFIED LEGAL NEWSPAPERS TO SERVE AS THE OFFICIAL COUNTY NEWSPAPER FOR THE PERIOD OF JULY 1, 1988 THROUGH JUNE 30, 1989 Warner explained the resolution and reported that the Finance Committee recommended its approval. WARNER MOVED TO APPROVE THE RESOLUTION. The motion carried. RESOLUTION FOR HEARING AND NOTICE OF HEARING ON SALE OF COUNTY TAX TITLE PROPERTY Warner reported that the Finance Committee recommended approval of the resolution. WARNER MOVED TO APPROVE THE RESOLUTION. The motion carried. RESOLUTION IN THE MA'S'ER OF ESTABLISHING A DATE AND TIME FOR THE PURPOSE OF ACCEPTING BIDS TO LEASE THE GAS AND OIL RIGHTS ON COUNTY -OWNED PROPERTY AND COUNTY RIGHT -OF -WAYS FOR TEN (10 ) YEARS OR FOR SO LONG THEREAFTER AS OIL AND GAS OR EITHER OF THEM IS BEING PRODUCED FROM SAID COUNTY -OWNED PROPERTY AND COUNTY RIGHT- OF -WAYS OR LANDS POOLED THEREWITH TO THE HIGHEST AND BEST BIDDER AND RECEIVING ANY .WRITTEN OBJECTIONS.IN ACCORDANCE WITH RCW CHAPTER 3.6_.34. RCW 36.75.040. RCW CHAPTER 78.16. AND RCW BSI 1 1 1� Warner explained the resolution and reported that the Finance Committee recommended its approval. WARNER MOVED TO APPROVE THE RESOLUTION. The motion carried. ORDINANCE AMENDING THE WHATCOM COUNTY CODE SECTION 2.02.040A TO ESTABLISH THE ANNUAL REORGANIZATION MEETING OF THE WHATCOM COUNTY COUNCI ORDINANCE TO REVISE THE 1988 CURRENT EXPENSE FUND, MEDICAL EXAMINER'S APPROPRIATION THEREIN ORDINANCE TO REVISE THE 1988 CURRENT EXPENSE FUND, SUPERIOR COURT APPROPRIATION THEREIN February 4, 1988 Page 4 ORDINANCE AMENDING THE TEXT OF TITLE 20, THE OFFICIAL WHATCOM COUNTY ZONING CODE, TO ALLOW PUBLIC FACILITIES IN THE NEIGHBORHOOD COMMERCIAL, GENERAL COMMERCIAL AND AIRPORT OPERATIONS ZONES AS OUTRIGHT PERMITTED USES; TO MODIFY.FOR CONSISTENCY THE LANGUAGE REGARDING PUBLIC FACILITIES IN ALL THE ZONES WHERE THEY ARE PERMITTED;. AND TO ALLOW THOSE PUBLIC FACILITIES RELATED TO HEALTH AND SAFETY AS.OUTRIGHT PERMITTED USES AND TO ELIMINATE THE 5.0' SETBACK FOR ALL PUBLIC FACILITIES IN THE AGRICULTURAL ZONE The above ordinances were introduced by consent and referred to the Finance Committee. EXECUTIVE SESSION The meeting was recessed into executive session at 8 :05 p.m. for discussion of pending litigation, and reconvened into open session at 8 :33 p.m. WARNER MOVED TO AUTHORIZE THE DEFENSE OF COUNTY EMPLOYEES CLAY, IF HIS ACTION WAS NOT DEEMED INTENTIONAL, AND KUEHNEL, COTTINGHAM AND WATTS.
