February 18, 1988
The meeting was called to order by Council Chair Roehl at
7:30 p.m. with Burton, Hansey, Jackson, Vanderpol and Warner
present.
APPROVAL OF MINUIS
The minutes of the meeting of February 4, 1988 were
approved.

Executive Van Zanten discussed the administration's decision
to change its previous policy and consider the State bid for the
first time. She reviewed the factors which led to that decision,
including the amount of money which could be saved, and explained
that the call for bids had stated that both price and warranties
would be considered.
Warner reported that the Finance Committee had recommended
that all eight bids be awarded to the State.
WARNER MOVED TO AWARD ALL THE BIDS TO THE STATE.
The Council agreed to allow representatives from local
automobile dealerships to speak.

Urged that future bid procedures be modified to be fairer to
local dealers; call for bids should be issued at the same time of
the year as the State bid to enable local dealers to compete on
the same basis; County should do business locally.

Supported Bob Diehl's statements.
The issues of the policy change concerning the State bid and
the fairness of the latest call for bids were discussed.
HANSEY MOVED A SUBSTITUTE MOTION TO REJECT ALL THE BIDS AND
RE -ISSUE THE CALL FOR BIDS IN AUGUST OF 1988.
There was discussion on the substitute motion.

The substitute motion failed.
The original motion to award all the bids to the state
failed.
WARNER MOVED THAT ALL OF THE BIDS BE AWARDED AS RECOMMENDED
BY THE ADMINISTRATION.
The motion carried.
BID AWARD RECOMMENDATION FOR _THE. RECONSTRUCTION OF LAKEWAY DRIVE
TO THE LOW BIDDER, WILDER CONSTRUCTION GO., INC. , _IN THE AMOUNT
OF $797,459
Warner reported that the Finance Committee recommended
approval of the bid award.
WARNER MOVED TO APPROVE THE BID AWARD.
The motion carried.
INITIATING RESOLUTION FOR PROJECT N0, 99134, THE RECONSTRUCTION
OF LAKEWAY DRIVE
Warner reported that the Finance Committee recommended
approval of the initiating resolution.
WARNER MOVED TO APPROVE THE RESOLUTION.
The motion carried.
REQUEST FOR AUTHORIZATION TO PURCHASE PROPERTY INSURANCE IN THE
AMOUNT OF $22,862
The Executive presented her request.
Warner reported that the Finance Committee recommended
approval of the request.
WARNER MOVED TO AUTHORIZE THE EXECUTIVE TO PURCHASE THE
INSURANCE.
The motion carried.
REPORT ON JOB AUDIT IN ELECTIONS DEPARTMENT, AND REQUEST TO
AUTHORIZE THE AUDITOR TO EROCEED TO PERMANENTLY FILL THE
POSITIONS
The Executive reviewed the results of the audit, and
requested that the Council accept the audit and authorize the
positions to be permanently filled as recommended.

approval of the audit results and recommendations.

new Department of Combined Treatment Services had completed their
move into the Courthouse Annex.

ORDINANCE AMENDING WHATCOM COUNTY CODE PROVISIONS MAKING TH

The public hearing on the three interrelated ordinances was
opened. There was no testimony and the hearing was closed.
Warner explained the history and intent of the ordinances.
He reported that the Finance Committee recommended their
adoption, including one substitute ordinance which incorporated
the Committee's recommended changes.
WARNER MOVED TO ACCEPT THE SUBSTITUTE ORDINANCE AMENDING
WHATCOM COUNTY CODE PROVISIONS MAKING THE VIOLATION OF SAID
PROVISIONS AN INFRACTION WITH THE DELETION OF LINE 18, "SECTION
2.40.110, EMERGENCY SERVICES," FROM THAT ORDINANCE, AND TO ADOPT
ALL THREE ORDINANCES.

Roehl divided the motion.
The motion to accept the substitute ordinance with the
deletion of "Section 2.40.110, Emergency Services" carried.
There was further discussion on the motion to adopt the
ordinances.
BURTON MOVED TO TABLE THE ORDINANCES AND REFER THEM BACK TO
THE FINANCE COMMITTEE FOR AN EVALUATION OF WHETHER THEY MEET THE
CONDITIONS OF PROVISO "I" IN THE 1988 BUDGET.
The motion carried.
The meeting was recessed at 8:50 p.m. and reconvened at 8 :58

OPEN SESSION

656 West Pole Road
Presented petition from West Pole Road residents requesting that
the speed limit on the eastern half of the West Pole Road be
reduced from 50 m.p.h. to 35 m.p.h.; discussed neighborhood
concerns regarding the speed limit and the scope of the
reconstruction project on that road.
Chris Crabtree
844 West Pole Road
Purchased his property on West Pole Road one year ago; would not
have bought property if he had known about reconstruction
project, which will place his property within 30 feet of the
road; expressed concern for his children's safety.
The petition and the other concerns of the West Pole Road
residents were referred to the Public Services Committee.
FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES

franchise request; was told that the hearing would be scheduled
for the Council's second meeting in March.

ORDINANCE TO REVISE THE 1988 CURRENT EXPENSE FUND, MEDICAL
EXAMINER'S APPROPRIATION THEREIN
Warner explained the ordinance and reported that the Finance
Committee recommended its adoption.
WARNER MOVED TO ADOPT THE ORDINANCE.
The motion carried unanimously.
ORDINANCE TO REVI�S,E THE 1988 CURRENT EXPENSE.FUND. SUPERIOR COURT
APPROPRIATION THEREIN
Warner explained the ordinance and reported that the Finance
Committee recommended its adoption.
WARNER MOVED TO ADOPT THE ORDINANCE.
The motion carried unanimously.
ORDINANCE AMENDING THE TEXT OF TITLE 20„ THE OFFICIAL WHATCOM
COUNTY ZONING CODE, TO ALLOW PUBLIC FACILITIES IN THE
NEIGHBORHOOD COMMERCIAL, GENERAL COMMERCIAL AND AIRPORT
OPERATIONS ZONES AS OUTRIGHT. PERMITTED USES; TO MODIFY FOR
CONSISTENCY THE LANGUAGE REGARDING PUBLIC FACILITIES IN ALL THE
ZONES WHERE THEY ARE PERMITTED; AND TO ALLOW THOSE PUBLIC
FACILITIES RELATED TO HEALTH AND SAFETY AS OUTRIGHT PERMITTED
USES AND TO ELIMINATE.THE 50' SETBACK FOR ALL PUBLIC FACILITIES

Burton reported that the Planning and Development Committee
recommended adoption of the ordinance with the suggested
correction.
BURTON MOVED TO ADOPT THE ORDINANCE WITH THE AMENDMENT.
Roehl divided the motion.
The motion to amend the ordinance carried.
The motion to adopt the ordinance as amended carried
unanimously.

Jackson reported that the Public Services Committee
recommended that the request to appoint Tim Lockery be approved.
JACKSON MOVED TO APPOINT TIM LOCKERY TO FILL THE REMAINDER
OF THE UNEXPIRED TERM UNTIL DECEMBER 31, 1989.
The motion carried.
HEARING_ EXAMINER'S RECOMMENDATION FOR APPROVAL OF REQUEST FOR
MODIFICATION OF SITE PLAN APPROVED UNDER FILE M.D.P. 1 -75 AND S-
76, FILED BY RAYMOND D. WEDEN AND ASSOCIATES
Planning Director Taylor and Ray Weden explained the
proposed modifications.
Burton reported that the Planning and Development Committee
recommended approval.
BURTON MOVED TO APPROVE THE HEARING EXAMINER'S
RECOMMENDATIONS.
The motion carried.
MEMO FROM COUNCIL MEMBER JOHNSON REGARDING BID AWARDS, TO STATE
Roehl read Johnson's memorandum, which outlined his concerns
about the procedures the administration used in its latest call
for bids on County vehicles, and the decision to change the
County's policy of not utilizing the State bid.

The question of guidelines and timing for future bid calls
on County vehicles was referred to the Finance Committee. The
Committee was directed to work with the administration to
establish standards and schedules.

Warner explained the rationale and intent of the resolution.
WARNER MOVED TO APPROVE THE RESOLUTION.
There was discussion on the motion.
The motion carried.
The Council directed that copies of the resolution be sent
to the appropriate congressional and legislative delegations, and
to the Governor.
EXECUTIVE SESSION
The meeting was recessed into executive session at 9:30 p.m.
for discussion of labor contract negotiations, and reconvened
into open session and adjourned at 10 :02 p.m.
