August 18, 1988
The meeting was called to order at 7 p.m. by Council
Chairman Will Roehl, with members Emily Jackson, Dan Warner, Don
Hansey, Mary Vanderpol and Corky Johnson present. Tom Burton was
absent.
READING AND. _APP.RO.YAL..OF MINUTES
Following the flag salute, the minutes of the August 4, 1988
meeting were approved.

Executive Shirley Van Zanten said the project will take
about 18 months to complete, 500 boxes of paper at $105,000.
Part of the money exists in this year's budget; more will need to
be appropriated next year. After discussion the merits of this
proposal and its possible continuation to other County
departments, Warner reported that the Finance Committee
recommended approval.
WARNER MOVED TO AUTHORIZE THE EXECUTIVE TO ENTER INTO THIS
AGREEMENT.
Motion carried.
Warner reported that the Finance Committee recommended
approval of the bid award.
WARNER MOVED TO APPROVE OF THE BID AWARD.
Motion carried.
Jackson reported that the Public Services Committee
recommended approval of the application.

a. Van Zanten praised the efforts of Gail Kelley, noting
that as of 8/16/88 the County had gone 57 days without time loss
injuries.
b. Fourteen counties have joined the Association of
Counties Insurance Pool, Van Zanten reported. The counties are:
Benton, Clallum, Cowlitz, Franklin, Garfield, Grays Harbor,
Jefferson, Kitsap, Lewis, Mason, Pacific, Skamania, Spokane and
Thurston. Asotin, Island and San Juan counties have indicated
they plan to join.
C. Regarding the city of Bellingham's proposed
annexation of the urban fringe area: Van Zanten has directed
County Planners to study the matter and expects to have a report
in early September, so the County can take a position on the
issue.

Roehl opened the hearing, there was no testimony, Warner
gave a Finance Committee report.

Hearing, which had been continued from a previous meeting,
was opened:

Custer School Road
Wanted explanation of ordinance, was given one by Johnson.
She said she supported it.
Johnson said the Sheriff's Department told the Public
Services Committee it wants to find out who would pay for the
towing of these vehicles.
JOHNSON MOVED TO HOLD THE HEARING OVER UNTIL SEPT. 15.

John Liebrandt
Cedarville Road
Complained again of gasses in his home, which he said are
caused by Cedarville landfill. Claimed he heard Dan Warner and
Emily Jackson laughing at him after last meeting. Griped about
Dave Bader, incorrect handling of leachate (hose broken, not
replaced).

Read a letter to the Council, which opposed the annexation
proposed by Bellingham. Called the city's administration "a pack
of rabid vampires sucking the life blood from Whatcom County."
Asked Council to take a position on this issue.
Susan Bruland
8927 Custer School Road
Champion of County Sheriff's requests for more deputies.
Said she has show horses that need protection; has been shot at
by wild neighbors; said many people in Custer area have armed
themselves and this could be dangerous. Money spent on
microfilming could have paid for deputy salaries.
The meeting was recessed at 7:55; reconvened at 8 :05.

Jackson reported that Public Services recommended

Diane Harper, Planner, explained the ordinance, which
would give the County more flexibility in its search for a new
landfill. Jackson reported that Public Services recommended
adoption.

Harper explained that the Planning Department gave out
incorrect hearing dates to people interested in this matter when
it was before the Planning Commission. Therefore, in fairness to
them, it would be appropriate to schedule another hearing, she
said.
JACKSON RECOMMENDED THE COUNCIL REMAND THE ORDINANCE TO
THE PLANNING COMMISSION FOR A HEARING.
WARNER SUGGESTED THE PLANNING COMMISSION ALSO LOOK AT
STRIP MINING AND RECLAMATION IN AGRICULTURAL ZONES, BEFORE
BRINGING THE MATTER BACK TO THE COUNCIL.
There was no vote, but consensus on the recommendations.

Roehl asked that a request from attorney Phil Serka
regarding the KNTR Radio Appeal be placed as item 4 under other
business.
WARNER MOVED TO ACCEPT THE DECISION ON REMAND.
Roehl said he opposed the motion, and that he wanted the
Planning and Development Committee to review it, although the
original appeal had been reviewed by a Committee of the Whole.
There was discussion.
HANSEY OFFERED A SUBSTITUTE MOTION TO REFER THE MATTER TO
THE PLANNING AND DEVELOPMENT COMMITTEE.
Motion carried.

This item was to have been reviewed by Planning and
Development, but was not.
WARNER MOVED TO RETURN THE MATTER TO PLANNING AND
DEVELOPMENT.

This item was to receive further review from Planning and
Development but did not. Council decided matter had been
discussed enough, that the role had been clarified.

Roehl reported that Serka had just been retained by the
appellant and did not think he could meet the Aug. 24 deadline
for written argument.
ROEHL RECOMMENDED THE DEADLINE BE EXTENDED FOR ONE MONTH.

Warner reported that the Finance Committee recommended
approval, with a change to item number 5 (to read "have joined"
instead of "have agreed to join."

Hansey introduced the resolution and explained its origin.
HANSEY MOVED TO APPROVE THE RESOLUTION.
There was more discussion. Johnson said he wanted the
chairman to write a nasty letter to the Washington Association of
Counties, asking them why they couldn't send someone to talk
about Initiative 97. Roehl said he would do so.
