Mary Vanderpol was absent. Also present were: Shirley Van Zanten, County Executive; Tom Sutberry, Budget Director; Barbara Cory, Treasurer; Shirley Forslof, Auditor; Nat Dickinson, Purchasing; Linda Gill, Judge Rhea, District Court; and Judge Moynihan, Superior Court. 5. ORDINANCE REVISING THE 1989 CURRENT EXPENSE FUND SUPERIOR COURT, DISTRICT COURT AND NON - DEPARTMENT APPROPRIATIONS THEREIN FOR ADDITION OF COURT COMMISSIONER AND RELATED STAFF POSITIONS Discussion about the duties of an added Commissioner. The new appointee will do all first appearances for both courts. A District Court Commissioner can do everything a District Court Judge can do whereas a Superior Court Commissioner cannot do jury trials. JACKSON MOVED TO RECOMMEND APPROVAL TO COUNCIL. Motion carried. 6. REQUEST FOR APPROVAL OF BIDDERS LIST FOR THE SUPPLY OF FRESH FRUITS AND VEGETABLES FOR THE JAIL FOR THE NEXT SIX MONTHS 7. BID AWARD RECOMMENDATION FOR THE SUPPLY OF DAIRY PRODUCTS TO THE JAIL TO THE LOW BIDDER, DAIRY DISTRIBUTING, INC., AT AN ESTIMATED TOTAL OF $14,211.50 8. BID AWARD RECOMMENDATION FOR THE PROVISION OF GROCERIES AND SUPPLIES TO THE JAIL TO THE LOW BIDDER, FOOD SERVICE, INC., AT AN ESTIMATED TOTAL OF $23,433.05. JACKSON MOVED TO RECOMMEND APPROVAL TO COUNCIL. Motion carried. 1. RESOLUTION OF WHATCOM COUNTY, WASHINGTON, DECLARING CERTAIN REAL PROPERTY SURPLUS AND AUTHORIZING ITS SALE BY NEGOTIATION OR AUCTION IN COORDINATION WITH NOOKSACK, SUMAS AND EVERSON Cory explained that this an old township and contains 5.6 acres of land. RESOLUTION TO SET A HEARING ON SALE OF COUNTY TAX TITLE PROPERTY, REQUEST NO. 22 JACKSON MOVED TO RECOMMEND APPROVAL TO COUNCIL. Motion carried. 3. SUBSTITUTE ORDINANCE TO REVISE THE 1989 CURRENT EXPENSE FUND, NON - DEPARTMENTAL APPROPRIATION THEREIN FOR SEVERANCE PAYOUT This came about because it was determined when Keith Willnauer became Assessor that he could have his sick and vacation time paid out. This amount will cover other payouts including the Treasurer and Auditor. JACKSON MOVED TO RECOMMEND APPROVAL TO COUNCIL. Motion carried. 4. ORDINANCE TO REVISE THE 1989 CURRENT EXPENSE FUND, NON - DEPARTMENTAL APPROPRIATION FOR AUDIT COSTS Withdrawn. 6. ORDINANCE TO REVISE THE 1989 CURRENT EXPENSE AND PHYSICAL PLANT AND CAPITAL FACILITIES FUNDS FOR BUILDING IMPROVEMENTS Van Zanten explained that this covers the new sound system for the Council Chambers and prepare a sidewalk going to the jail administrative offices. She also mentioned that the smoker's kiosk will be up by late October. 10. RESOLUTION AUTHORIZING BINDING ARBITRATION TO DETERMINE ASSETS OF WHATCOM COUNTY - BELLINGHAM HEALTH DISTRICT Van Zanten said that the City wants today's value but the County wants it to be a fair return on their initial investment. How should the base be set? She stated that the City wants a proportion of the grants but the City taxpayers did not pay for this; it will have to go to arbitration. She stated that it is undecided if it will be one or more arbitrators. JACKSON MOVED TO RECOMMEND APPROVAL TO COUNCIL. Motion carried. Jackson asked about Ken Brown's pay during the time he was acting as Assessor. He was Chief Deputy and was paid as such. Van Zanten said she had no authority to pay him otherwise. She stated she had asked Watts about this.
