WHATCOM COUNTY COUNCIL
January 19, 1989
The meeting was called to order at 7 p.m. by Council Chairman Don Hansey,
with Council members Will Roehl, Mary Vanderpol, Dan Warner, Toni Burton, Corky
Johnson and Emily Jackson present.
Following the flag salute, the minutes of the 12/29/88 special meeting were
approved as presented.
EXECUTIVE ITEMS
Civil Service Commission Appointment
The Executive requested the reappointment of Frederic J. Zell to a second
f u I I s i x -year term to run f rom 1/1 /89 to 12/31 /94. Th i s term of of f 1 ce by state
law is six years (RCW 41.14.030).
WARNER MOVED THAT THE COUNCIL CONFIRM THE RECOMMENDATION.
Motion carried.
County Board of_Ap-p-eAU -8ppoi ntments.
The Executive requested the following reappointments: Mark Bratt to a
second full three -year term, from 1/1/89 to 12/31/91; Jeph DeLorme to a second
full three -year term running from 1/1/89 to 12/31/91; and Jim Maushak to his
second full three -year term running from 1/1/89 to 12/31/91
WARNER MOVED THAT THE COUNCIL CONFIRM THE RECOMMENDATION.
Motion carried.
Mental Health Advisory Bard
The Executive had planned to request that Barry P. Antos be appointed to
a first full three -year term to run from 1/1/89 to 12/31/91, to replace Mary
Ellen O'Keefe who declined reappointment when her term expired. However, she
requested that this item be withdrawn from the agenda until a later date.
Rural Library Board
The Executive requested that Thomas Stitt be appointed to a first full
five -year term, from 1/1/89 to 12/31/93. He is replacing Sherman Polinder who
is not eligible for reappointment. The term of service on this board is five
years according to RCW 27.12.190.
WARNER MOVED THAT THE COUNCIL CONFIRM THE RECOMMENDATION.

Exec utIvp_!s_Reoort
A. Solid Waste Update: A report was distributed (on file), which included
an update on the landfill siting process. Johnson asked when the public would
be told how many sites are being considered, along with their locations. Van
Zanten said she did not know, but that the County would want an option to buy
the properties before going public with them. She said from 10 to 15 sites may
go to the Solid Waste Advisory Committee, following staff's comparison of the
40 sites now on file with the fatal flaw criteria. SWAC will recommend three
to five sites, and the County will do a full environmental impact statement on
those.

B. Juvenile Detention Center: The County's architect reviewed the site
on Ellis Street, which had been announced in the media as the ultimate site
during the past week. The architect raised some questions about the structure,
but Van Zanten said she hadn't yet reviewed the report and could not make any
recommendations or full comments at this time. Hansey said purchase of the
property is subject to the architect's review. The Council has 60 days in which
to consider the option. Jackson asked if the existence of an underground gas
storage tank had been detected by the architect, and Van Zanten said she didn't
know but that it is an issue to consider.
OPEN SESSION
John Llebrant
Henry Street /Cedarville Road
Jim Maricle of Cedarville has done some rainfall calculations which
apparently show that in the last four months the County has only hauled away 1/2
the runoff from the dump, since the rainfall amount is greater than the amount
of leachate collected.
Kim Wiel —Hyatt
North Shore Road
Asked that the Council take steps to protect Lake Whatcom Watershed,
particularly by placing a moratorium on logging around the lake.
Art Hyatt
North Shore Road
He urged that the Council adopt the resolution drafted by the Friends of
Lake Whatcom, which was presented to the Lake Whatcom Watershed Committee on
Jan. 10.
Barbara Brenner
5617 Northwest Road
Complained about public access to public records. Apparently the Executive
and Bob Jurica had, for a few weeks, refused to release a public document from
the Department of Ecology. Brenner obtained a copy from the Department of
Ecology in the mail.
Van Zanten said she planned to release the DOE's comments in a package
with other comments from other agencies. She said it was not attempt to violate
the law, but to do things in an orderly fashion.
Bonnie Strode
Water District 10 manager
Reported that the district's board of commissioners voted to support the
Friends of Lake Whatcom's requests that were presented at the Jan. 10 Lake
Whatcom Watershed Committee meeting.
Ted Smith
911 Key Street
Endorsed the Friends of Lake Whatcom. Praised Barbara Brenner. As for
the proposed rezones in the Pacific Highway area, he asked that the Council be
aware that its record on zoning down to agricultural or forestry uses is not
good; zoning up to commercial, etc. happens quite extensively.

Point Roberts
Represents the Point Roberts Taxpayers Association. Would like there to
be a public hearing on the gas station moratorium issue, in Point Roberts.

Likes the idea of a public hearing. Feels there needs to be enough. notice
for people to participate.
Fred Miller
Friends of Lake Whatcom
Submitted a copy of a video tape of the Trillium logging proposal hearing
and a copy of the Forest Practices manual. He said he has a plethora of material
available for Council's perusal.
Warner noted that he is impressed with the number of people who comment
on environmental quality. Johnson said he thinks the Council should have its
public hearing on the gas station moratorium in Point Roberts.
FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES
Resolution to se l l property acquired by County on tax foreclosure ( request number
4) (public hearing was 1/5; was referred back to Finance)
Warner said that the law does not provide a statutory obligation to col l ect
liens against a property that are imposed by the water district, but that there
is not a prohibition against it.
WARNER MOVED THAT THE RESOLUTION BE APPROVED, AS WAS RECOMMENDED BY FINANCE
(WITHOUT THE WATER DISTRICT SERVICE CHARGE ATTACHED), AND THAT THE FINANCE
COMMITTEE BE ASKED TO WORK WITH AN ATTORNEY TO REVIEW AND CREATE A POLICY TO
INCLUDE, AS A PART OF THE SALE PRICE, THE WATER DISTRICT LIENS.
Motion carried.

map . to general commercial for approximately 32 acres east of Interstate 5.

Ordinance amending the urban fringe subarea comprehensive plan map ... and zoning
map ... to light impact industrial for eleven parcels .. on the east side of
Pacific Highway between Horton and Stuart roads (Olivine and Palm Peg_ Corp.
request)
Burton reported that the above two items would be kept in committee. In
the Committee of the Whole meeting on 1/12, Planning Director Dan Taylor was
asked to develop landscaping requirements that could be adopted into the text
of the zoning laws, prior to anything being done about these two requests for
rezones.

Burton said Haines and Crandall applications were kept in committee; Lee
will come back in a few weeks with a better timber management plan, then be
forwarded to the Council.
INTRODUCTION OF RESOLUTIONS AND ORDINANCES ( *Consent Items)
Johnson explained that this resolution amends the employee handbook that
is distributed to County employees. Harold Raymond, Personnel Director, noted
that the last edition was published in 1986. He distributed a one -page summary
of the changes (on file). Johnson reported that Public Services recommended
approval.
JOHNSON MOVED THAT THE RESOLUTION BE APPROVED.
Motion carried.
Warner reported that Finance Committee recommended approval of the
resolution, which sets a hearing for the property sale on Feb. 16.
WARNER MOVED THE RESOLUTION BE APPROVED.
Motion carried.

The above three ordinances were introduced by consent and referred to the
appropriate committees. Burton suggested that there be a public hearing on the
gas station issue at Point Roberts. There was discussion about the options

surrounding this issue.
JOHNSON MOVED THAT THERE BE A SPECIAL MEETING ON FEB. 9 IN POINT ROBERTS
IN ORDER TO HAVE A PUBLIC HEARING ON THE GAS STATION (CONDITIONAL USE) ORDINANCE.
Motion carried.
Johnson said he is re- introducing this ordinance, following the receipt
of a petition from people interested in seeing it proceed. The petition is on
file. The ordinance was referred to the Public Services Committee.
REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS
County Flag: Jackson reported that she had presented the flag at the
Centennial Ball in Olympia, which was a great success. Vanderpol commended
Jackson on her efforts to not only have the flag created, but to get it presented
at the state capitol.
Solid Waste Information Access: Jackson complained about the
inaccessibility of some information; she spoke of the DOE report that Brenner
had referred to in open session. She said she thought the public should have
access to the 40 preliminary sites. There was discussion about the unclear
language in the consultant's procedure list.
DOE Meeting invitations: Jackson noted that there was an invitation -only
meeting with the DOE in February, to which Hansey had been invited (as a health
board representative) but she had not. Warner said he had not been invited.
Jackson, Warner and Johnson asked Hansey to find out how the invitations were
distributed; Johnson said governmental agencies should be able to appoint their
own representatives to attend such meetings.
Councii Retreat: After some discussion, it was agreed that the retreat
wi I I be from 8 a.m. to 2 p.m. on Saturday, Feb. 18 at the Fisherman's Cove
Restaurant, Gooseberry Point (Hansey will select an alternate if it is
unavailable).
Hansey asked for agenda suggestions, to be submitted to him by Thursday,
1/26.
The meeting was adjourned at 9:45 p.m.
